  1. Hi Having recently checked my Equifax file I have discovered I have a default from British Gas from April 2004, for an account relating to an address I moved out of in 2001! I was unaware of any outstanding debt, but now I could do with some clarification of the rules regarding utility defaults so I now how to proceed. I wasn't even aware that it was possible to default on a utility bill, I thought they just issued CCJs... PIAB x

  3. Well, the 19th has been and gone, and no sign of any CASH! I phoned S,C&M one day last week to check if they had received my letter and they told me that they were snowed under and it would take about two weeks. They also said that I would receive ANOTHER letter specifying when and how the payment would be made. I've now sent my LBA for my Lloyds Visa. They wrotre back to my prelim acknowledging the ruling of the OFT, saying they DISAGREED with it, and had no intention of back dating the reduction to £12 charges!
  4. Thanks guys! Silence from S,C&M. Their offer letter requested the signed conditions to be returned before 19th July (14 days from the date of their offer letter). I don't know if that means the payment is scheduled to be made within that time period?? I'm worried now that I've delayed it by rejecting the conditions, wich were pretty insignificant anyway.

  6. I filed my AQ yesterday morning using BankFodder's 'Draft Order For Allocation Questionnaires' and the suggested text to avoid a Stay. When I got home I saw two letters from Sechiari Clark and Mitchell on the mat... One saying they intend to defend the claim and asking me to have an account review... And one saying the charges are lawful and justified but they are waiting for the OFT to clarify the situation and in the mean time if I sign to agree their conditions Lloyds TSB will pay me in full! BY JOVE... I DO BELIEVE I'VE DONE IT!!! I'VE WON! What do I do now? Should I accept the conditions? How long do they take to credit my account?
  7. Lloyds acknowledged service of claim 8th June, Defence filed 20th June. Allocation Questionnaire need completing by me and returning to the court with £100 fee by 9th July. Bizarrely a letter the arrived this morning, dated 22nd June, from Kerry Parfitt, Customer Services Recovery Centre, Andover. 'I wrote to you four weeks ago to update you on our investigation of your complaint....I would be grateful if you could bear with us for a little so that we may try to reach an amicable conclusion' !!!

You can check if you have a default on your credit files by ordering them from Credit Reports: Get your Credit Report from Experian UK, Online Credit Reports and Credit Reporting from a Leading Credit Agency: Equifax and Credit report information for consumers - Callcredit. Make sure you don't buy one of their expensive subscription services, you should only be paying £2, for a paper copy of your credit file which they will post to you within a few days. Capital One will offer to settle in full within about three weeks of you issuing the claim, it is extremely unlikely to go to court. If you do have a default on your file you must make sure that you specify the need for it to be removed on your claim form, in which case Capital One will HAVE to remove it to avoid going to court.
  9. I'm not clear whether Capital One are still applying the refund of £8 per charge to your account? I am assuming that they are? If they are then issue a claim as follows: Do a schedule of ALL the charges levied to your account, work out the Statutory Interest on the WHOLE amount. On your Particulars of Claim on the court form N1 state that you have requested a refund of the whole amount but have only received £8 per charge (ie. 20% of your total claim) so you are deducting that figure from your claim, along with 20% of the total Statutory Interest figure.   10. As per my last post, Experian have removed the default, as have Equifax. Call Credit is still currently showing a default but I hope that's just due to the cycle they operate as regards updating their records. I'll find out tomorrow. To be honest the whole process has been pretty straightforward, and Capital One didn't put up much of a fight. They were very helpful initially in fact, sending my copy statements almost straight away. More than I can say for Lloyds TSB! I finally got My Lloyds TSB Visa statements on Saturday after three months wait, letters, phone calls...
  11. Last Friday Lloyds Card Services told me the statements had been sent out Thursday... Over a week later and no sign...
  12. Experian sorted, Equifax sorted, Callcredit still showing default... Must call them/Capital One tomorrow.
  13. Well done Mancetti! That was nailbiting stuff, I've got all this to look forward to...! Did Lloyds never make you a partial offer? I presume all you ever got from them was the standard 'Like any business, we do make a charge for some of our extra services..' letter.
  14. I don't understand Lloyds' policy. I've received one letter from Debbie Gilbert (Customer Care, Andover) in prompt response to my prelim (within a week), then no response at all to my LBA,even though I gave them 3 weeks. I've now issued the claim form, am I likely to receive the £750 settlement offer even at this stage? I could certainly do with it! As for my credit card, I'm still awaiting statements 3 months later....!!!
