  1. Thanks 2Grumpy ..just got in from work will send the acknowledgment of service of now before todays last post collection Issue date was 13 june 2013 + 5 days + 14 so should get to the court in time.
  2. I was thinking of sending this as my defence... (please don't laugh if it looks bad ) or would you think another course of action better? I dispute the above claim in full for the following reasons. The debt is the combination of two debts that were merged without my knowledge 1. HSBC personal loan. 2. HSBC bank account. The debt from the bank account is £750 (approximately) this is from an old bank account that was in debt by about £40 .. the £750 is made up almost entirely of bank charges that I dispute as being disproportionate to a £40 debt. My loan stood at £1200 and I was making payments on through Metropolitan collection service , however on checking my balance after a payment the loan stood at £2,000 ,when I contacted Metropolitan collection service to question this I was told both accounts had been merged ,something I had not been informed of prior to this and had no knowledge of. I believe this was a deliberate attempt to trick me into paying a debt that was in dispute, at best this is bad practice and at worst it is obtaining money by deception. In my opinion the act breached the original loan agreement so the total amount became in dispute, I await your response in this matter.

Would have to dig out details ..Think its been 6 years + on the bank account without a payment as it was built up of £700+ bank charges.. however it is possible that when they merged the loan and bank account i made a payment before i realised.. and last payment would have been about 3/4 years ago on the loan.. dx i read the link you put up (a lot of it went over my head... i think Kay had a better grasp of the help she was given ) i will look back at post 9 thanks again guys..

  5. Thanks Scarlet and Brigadier.. dx will get the scan up asap ... I dont think Marlin (Restons) know that the 2 debts were merged when they bought the debt it was merged at a time when metropolitan collections were dealing with it so not sure if it was them or HSBC who merged it.. I only found out when the balance on my loan (that was in default though i was making payments) went from £1200 to £2000 when i rang to ask Metropolitan why this was i was told my outstanding bank account had been merged to my loan amount... from that point i refused to make anymore payments. I think its possible the new owners of the debt are unaware of this. Thanks again guys
  6. Hi hope you guys can help.. Had a bank loan of HSBC about 10 years ago ... i was making payments but due to other debts building up i fell behind and ended up on a dmp.. At the time i also had a bank account with them that was something like £40 in debt .. . I asked them to close the account and i would pay the £40 through my dmp they refused so "stupidly" i refused to pay the £40 and changed banks. About 4 years ago my loan stood at £1200 i was making payments .. . untill they added over £750 to my loan (metropolitan finance at the time) This was £700 in bank charges on my old account.. My new debt was £2,000. I refused to continue to pay and the debt was passed around a number of companies... A few months ago i recieved a letter saying my debt had been sold to Marlin Europe (Restons solicitors) Today i have Recieved a claim form ,response pack, form of admission and defence/counterclaim form adding onto the original debt £75 court fee and £80 solicitors costs ...I got to admit im flapping a bit now as i didnt think once the debt was sold the new owner would have the power to do this... Any help would be greatly appreciated , (next steps, what the court letter means,has there been a court hearing,will court bailiffs come to my home) sorry for the lenghthy post... Thanks for reading.
  7. Any help guys...? Was thinking of replying that i dispute the full amount as when the 2 debts were merged.. (without my knowledge) it breached the the loan as well as the disputed bank account (£700 charges) .... if i dont hear of anyone i will go with that as a defence..

  9. Thanks Davecres, i will be making sure there is only enough funds as i need to pay in that account, have a second account with same bank so its easy to transfer funds in/out also a 3rd account with another bank just in case things go pear shaped

I Have £800 debt with quickquid that they wanted in 1 payment ... i offered payments of £50 then £150 then 3 further payments of £200 i got this Email back "We received your email regarding your loan balance and your situation has been noted. Collection procedures will continue until an acceptable payment arrangement is made. ".... After looking on here i put together this reply.. As i stated in my previous email ALL contact will be done through email (or post) . This is because of legal advice given to me. You say "Collection procedures will continue until an acceptable payment arrangement is made" Do i take this to meen my offer has been rejected? I still have all texts and emails from you telling me i have extra funds should i want them , telling me i can roll my loans over ,increasing my credit untill it got to the point i started to struggle and then asking for £800 when you have on file that i get paid £1060 per month thus leaving me with £260 to last me four weeks. I will be making copys of all these messages from you and forwarding them to the relevant authorities (OFT , Trading standards ext) as i belive you use this system to prey on people who you already know have a bad credit history. I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997. If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Be advised that any further telephone calls from your company will be recorded. The reply i got was Thank you for contacting us to inquire about how to pay off your balance. The payment plan we can offer is detailed below. £100.12__________due 31/08/2012 £100.00__________due 28/09/2012 £100.00__________due 31/10/2012 £100.00__________due 30/11/2012 £100.00__________due 31/12/2012 £100.00__________due 31/01/2013 £100.00__________due 28/02/2013 £100.00__________due 29/03/2012 via debit card ending XXXXX To confirm your agreement to this payment plan, please reply to this email stating that the terms are favorable. You must include the original email with the terms to which you are agreeing in your response. Once we have heard back from you, we will set up the agreed upon debits to come out of your bank account or be charged to your debit card. Collection procedures will continue until an acceptable payment arrangement is made Dont know if it was my email but the terms they sent were better than i had asked for.. Hope this helps..... and to the pros on here sorry if any incorrect wording or spelling mistakes.
  11. the council have agreed to take my debt back, but the baliffs still want there £270 charges. they done a visit and a levy that i was tricked in to letting them do what can i do about it? this is for council tax
  12. hi the council have agreed to take my debt back but im being told i still have to pay 270 balliff charges they done 1 visit and then i was tricked in to letting them do a levy. i dont understand why i would owe themthat much. is there anyway i can refuse to pat this amount. and am i better starting a new thred now?

  21. hi im using someone elses account. i made the mistake of letting dukes balliffs enter myproperty i signed a form but was not aware it was to levy my items. i owe council tax 270 but with baliff charges its now 540 after i signed the form they told me they wanted 73 pound a week i had just lost my job and have 2 children. they come back today while i was out, they rang me and told me they was at my property and was getting ready to kick, my door down and remove my property. after a few more threats i returned home and told them to let me seek advice. they gave me until tommorow 24/03/09 at 12 oclock to pay or they will enter my property and because i have a dog if im not homeit will be removed by the dog warden. i went cab they told me they cant break my door down and go to the direct link and ask them to to ask council tax to take the debt back. they are looking in to it and have e mailed dukes baliffs to put my account on hold. but the baliff have sent me a text message and a voice mail saying they are still coming for the money or my stuff. can they do this? itsdukes baliffs there behavour thretening and want to make a complaint but will it help? they wont accept a repayment weekley now im working again, they want it all now i dont have it. this has really scared me over the way they was with me. can anyone give me advice please,an can they still take my stuff now my account is on hold by the council tax. and can dukes refuse to hand the account back over? i have logged this with police as im scared of the threats an i feel i was conned in to signing thanks
