  1. I don't know how Lloyds get away with it. Consider the following: 1. Deceit to shareholders (thus tax payers) regarding the Merger with HBOS i.e Eric Daniels is on film saying what "an enormously good deal" it was in January 2009 Ian Fraser - Business and Financial Journalist Ian Fraser Blog Archive “We’re creating a Great British bank” but we now know that in October 2008 HBOS was technically bankrupt and would have gone down but for secret loans of £25.4BN from the Treasury. Just a couple of weeks ago, Archie Kane confirmed that senior executives at Lloyds knew exactly what state HBOS was in when they did the merger - it was a dead duck. A dead duck that, just 3 months before the secret loan, was asking its shareholders for £4BN and saying the Bank was not in any trouble. 2. October 6th 2008 the Prime Minister was informed by other third parties, in detail, that HBOS was a frauduent Bank. He was sent substantial evidence of massive fraudulent activity and his Office responded to the senders to say GB was glad they felt they could send their concerns directly to him and he was forwarding the information directly to HM Treasury for comment. That was the same week the Treasury gave HBOS £25.4BN. The Treasury subsequently replied to the senders (who sent a futher 5 letters with more evidence) to say what a fantastic deal the LLoyds - HBOS Merger was for everyone - including the taxpayer. 3. On the 2nd June 2009 at a Debate in Westminster, 8 MPs and a Government Minister requested the FSA do an investigation into the allegations of fraud at HBOS. The request was repeated by Vince Cable and others. On the 19th October 2009, a detailed Report containing substantial evidence from the many victims of the HBOS fraud, was sent to the FSA. The Report was then sent to the Bank of England, MPs and Government agencies. Hector Sants and Mervyn King have written personally to the authors of the Report confirming they have taken it "very seriously". David Cameron, George Osborne and Neelie Kroes' Offices have also replied. John McFall's office replied only to say the Treasury Select Committee do not get involved with individual cases (there are many thousands of victims of this fraud.) The FSA have now commissioned a further Report by an independent thrid party organisation into the fraud - but Lloyds Banking Group, in the full knowledge of this investigation and how damaging the results may be, did not advise the shareholders of it prior to the latest Rights Issue. Conclusion - I don't have one except to say I am at a total loss to understand how our Government has allowed this Country to be completely crippled by banks who, in the case of HBOS - Lloyds, are fraudulent and corrupt companies.

I have put the following request up as a petition at No. 10: "This petition asks that banks and bankers should be held totally liable for their actions and that this should include prosecution where applicable. That banks should be severely disciplined for any breach of their Code of Conduct, the FSA Principles or the terms of the Government bailout. That banks should be entirely transparent in their dealings. That malpractice, maladministration or negligent action in a bank which results in unfair treatment of its clients, including historic cases, should be immediately resolved and the victims compensated. That the Government forms an entirely independent body as an additional and totally impartial regulator and that this body is the public watchdog of a new improved banking system. This body would include representatives of SME, consumer action groups and the public. That the actions of those 'Masters of The Universe' who have received millions of pounds while bringing the Country to its knees, should be fully investigated."   3. Hi, Just wanted to let everyone know about a petition PublicvsBanks. I put the petition up because I'm sick and tired of the way we, the public are treated by Banks - in my particular case HBOS. Last Tuesday, my MP James Paice and 7 other MPs held a debate in the Westminster about the way one branch of HBOS was treating its customers. Vince cable has asked for an FSA investigation of the subject but I don't want to leave the clean up of banks to MPs and I don't want a clean up restricted to HBOS which is why I've put up the petition. I've heard and read hundreds of horror stories about banks in the last couple of years and how they've literally ruined many people's lives. So, if you have been affected at all, join the petition. I hope you will take the time to listen to 'File On Four' as it really exposes a sickening example of how badly some banks treat us. I am posting this as a victim of this scandal and the BBC programme came about as a result of a two year investigation my husband and I have had to do in order to try and prove what was going on. Even now, the bank refuse to admit any culpability. We are hopeful that the result of both the BBC expose and the Debate will be a better deal for small businesses and some decent treatment for all bank customers spandavia INSIDE HBOS WHAT DID WE BUY? After two years of HBOS strenuously denying anything was amiss with their risk management, the BBC can and has legitimately challenged this claim. The programme shows how neither the Bank's own risk structure nor the regulators had any control of internal procedures at HBOS and how the Bank then mercilessly persecuted those customers adversely affected by their Executive's mistakes in an attempt to disguise what had happened. HBOS has had billions of pounds of public money to bail them out and cover their debts – but what were we really paying for? Sub Prime and the effects of Global Recession? Or yachts and champagne for the boys? Was HBOS really a Bank or just one big jolly for the top dogs? Thousands of people have been affected by the story the BBC will tell, business owners, their employees, shareholders, unsecured creditors and, of course, the taxpayer.   7. That is certainly what they seem to have done - but the question is, is it legal? Why should a customer pay interest on a one off insurance fee or an arrangement fee? for example; if a loan is, say £3000, the insurance is £750 and the arrangement is £150 (all entirely possible), the customer is actually paying interest on almost £4000 for a £3000 loan. if the loan goes over 5 years at 5 to 6% over base (still entirely possible even on a secured loan), the customer is now going to pay closer to £5000 for a £3000 loan. Surely that isn't right? best span

I spoke to Tony Hetherington over a year ago about this. at that time there had just been a very inaccurate article in the Times about it and the mail wouldn't cover it because they said the Times already had. It is amazing (and quite frightening for democracy) how scared the newspapers appear to be when it comes to uncovering this type of scandal and corruption. The Sunday Herald appears to be as good as it gets - although I do think another paper is going to cover it soon. again thanks for the comment best span

Hi everyone, I haven't posted for a while and mostly because I've been trying desperately hard for nearly two years to get a resolution from HBOS over a really dreadful situation that started years ago with their reported 'rogue banker'. But it appears to just go from bad to worse even although I've gone so far as to write to the Prime Minister about it and he has replied to say he is taking the matter seriously. That was two months ago and nothing has happened. Also, 6 MP's have met in the Commons to discuss this matter and have asked for a meeting with the Chairman of the bank, Lord Stevenson. He won't meet them and has proposed one of his pitbulls for the meeting. the following article gives a brief outline of the situation and I hope you'll have time to read it:Hbos Faces Hard Questions Overuse Of Troubleshooters Who Misappropriated Company Money (from Sunday Herald) It's a disappointing article in that several people spent 8 weeks talking to the journalist and one even swore an affidavit that would have exposed the real level of corruption in HBOS. But the legal department of the paper watered it down so much it bears little resemblence to what we actually told them. Here's a more specific (and honest) article from our local paper: Business News, Cambridge and UK business news - PM takes up bank corruption battle I'm posting this because I hope that there will be someone on here who can give legal advice - particularly to do with perjury commited by Senior bank executives in an attempt to cover up internal scandals and, in my case, to evict the victims of that scandal from their home. It could also be an important case to anyone who can't pay their bills or mortgage because of the actions of a bank (just about the whole country) because a Judge has already refused to evict us 4 times in the last eighteen months because he has recognised that the Bank are at fault. I know homefodder asks for details of litigation and my husband and I are about to start a litigation against specific HBOS executives, which we were specifically advised to do by the Judge at our last eviction hearing even although he acknowledged we don't have the funds for expensive lawyers. The Bank were so worried we would introduce the perjury issue at that hearing, they sent two barristers, a Senior bank executive and the Deputy Chairman of the London law firm, Denton Wilde Sapte, to the Cambridge County Court to try and secure the eviction. We're back in Court for their next attempts in January - so it would be great to have some advice before we start. If anyone can help, please post a reply or PM me and I can send the details that we sent to the MP's and also the Prime Minister. The police and our local fraud squad have attempted to help but have been fobbed off by the Bank. And yes - this is also an unbelievable case of bank charges and interest - we've been charged a fortune in the last year four years and in the last year for an account that was closed in August 2007 but continues to incur interest on a daily basis. If I didn't know how many people have been ruined by this situation, I would have to laugh at it because what the article doesn't bother to say is how the bank manager and his dodgy friends used BoS clients money to fund their prostitutes, their luxury holidays arrived at by private jets, their luxury yachts and properties around the world and their champagne and oyster diets! This little [problem] has cost HBOS between £500M and £1BN and it has affected thousands of people. But as you'll see in the article - they have nothing constructive to say. In fact, they've chosen the route of victimising the victims of this crime. In my own case, not content with destroying my family business, HBOS senior executives are also hell bent on evicting us from our house - even although a Judge has refused to do so on four occassions. By the way, if anyone on this site has any knowledge of perjury laws, I'd be really grateful if you would PM me as I really need some advise. the police have been helpful but I fear they are not well practised in the avoidence of legal Corporate trickery. many thanks Spandavia

Hi everyone, I have used this excellent site many times and found it very helpful - particularly the threads about Baliffs in the past who I have had occasion to encounter (lovely chaps) specifically because of the actions of BoS. My (our) situation with BoS is that our Bank manager turned out to be a complete villain who cost the Bank the better part of £500M (yes that is millions) due to a [problem] he was working with a consultancy firm. In short, the manager (who was also a director and head of high risk) forced his business customers to use this consultancy firm at a cost of £2000 to £10,000 per month plus expenses and VAT (in some cases this went on for 4 years). If the customers refused, the Bank manager pulled the plug on the accounts. They also put employees of the Consultancy firm into people's Companies as Directors (or even CEO) and then proceeded to run the Companies into the ground having injected large amounts of Bank funds into them. Needless to say the funds were never put there for the benifit of the Companies but the manager and the Consultantants were living the life of riley with luxury holidays on private jets, chauffeurs and an all round millionaire lifestyle. The manager was sacked in March 2007 and it was well documented in the press 'HBOS suspends Rogue Manager'. Since he was sacked, 40+ Companies the Consultancy firm were involved with via BoS and the manager have gone into administration, liquidation, been dissolved or struck off. It's all documented at Companies House and BoS have lost millions - and so have lots of their customers, their shareholders and unsecured creditors. But the thing that is most appalling about this is that the Bank has denied any of this has happened and have blamed and penalised the customers for their losses - many of whom have now lost their businesses and their livlihood. Several of us have got together to fight this situation and have done a lot of investigating over the past 16 months - so we have a lot of evidence. But the one thing I can't understand - and I'm hoping someone on this site will be able to help me with is this: How exactly do the Banks get their employees to act so badly and deliberately lie to and cheat the customers? I'm sure most people that work in Banks are just regular, reasonable people. So what is it that allows them to behave so unethically and in some cases down right evilly? Is there some sort of internal code they have to abide by or they lose their jobs? Is there some sort of incentive scheme that's tantamount to blackmail? We have had replies from people at the Bank on behalf of the CEO that are total mis-representations of the truth - and they know it. We've had replies from their lawyers that are unbelieveable in their distortion of the truth. And yet they appear to feel entitled to do this and worse to thousands of customers - and it's getting worse all the time. Any one got any explanations please? Also, if any one has any blatent examples of lies and deceit from BoS I'd be really grateful if you would post them. I really believe this has to stop or the whole Country will suffer (as if we're not already). many thanks Spandavia.
  13. Hi everyone, I (and lots of others) are involved in an horrendous situation with [my bank] re a rogue banker. As a result of this I've spent the last year doing a lot of research about them and I've read a lot of Bank annual accounts and Chairman's statements. I never know whether to laugh or cry when I read these things (especially the remunerations). So, as a bit of light relief yesterday, I wrote my own version of a Chairman's Statement. I wrote it to amuse my family who arte living this banking nightmare. But, as I also spent a lot of yesterday reading the horror stories on this site, I thought it might amuse other victims. It's not specific to any particular Bank and is entirely ficticious. I'll post some info about [my bank] later but in the mean time, hope you enjoy this: CHAIRMAN'S STATEMENT. Dear Sir / Madam, I write to you as the Chairman of the Company. As you know, this has been a challenging year in our sector. We've all suffered everything from 'rogue' traders, 'rogue' bankers, false rumours, sub-prime, credit crunch, our clients, Gordon Brown and [edit], Alistair Darling (not to mention Mervyn King – so I won't). Never the less and on the whole, we have performed exceptionally well and I have managed to sustain a record wage and an excellent bonus. I am confident we will continue to achieve more obscene profits next year. However my friends, I would be lying if I did not admit we are in a spot of bother and we need your assistance. As you know, we are trying to raise a few billion pounds in a Rights Issue to stabilise our situation. This may seem a lot of money especially as our current share price is lower than the price of the shares we are asking you to buy but, believe me, all that will change once you give us your money. And with this in mind you must look at this offer as a real 'once in a life time' opportunity - and one that our competitors will no doubt emulate in the very near future! If you pick up your share option you can be quite sure that, when we come out of this global Credit Crunch at sometime in the foreseeable future, you should start to see a reasonable margin of return. I should say straight away that none of this financial turmoil is my fault. I have heard several criticisms levied at the heads of the big 5 and I find all negative comments entirely unfounded and even a little unkind. What sensible person would believe the CEOs or Chairmen of such large organisations have anything whatsoever to do with the day to day running or policy making? We simply don't have the time. To be honest, with a constant daily schedule of breakfast meetings, golf, lunch, golf, public engagements, golf, cocktail parties, crazy golf and Award ceremonies, I very rarely actually see the inside of my office and I haven't read my mail for over 5 years. Therefore, if anyone in this Company has cocked up and made a dogs dinner of our finances, it certainly wasn't me. I cannot stress too highly how important it is you cough up the dosh and get us back on an even keel. The alternative doesn't bear thinking about as there is every possibility we could even end up like that Newcastle mob. This would mean millions of people losing their money, their businesses and their homes. What's more, I would be one of them. And let's keep things in proportion here.- just because I earned a couple of million last year and live in a multi million pound mansion, this does not mean I'm not in the same boat as everyone else. If you prick me I bleed and, where as it is sad to think someone might lose their three bedroom semi and their job stacking shelves in the local supermarket because of the credit crunch, it's would be nothing short of a [edit] tragedy if I lost this cushy number and my Stately pile. Let's face it, I've got a lot to lose. In my position as your Chairman I have decided the prudent strategy, with regards to any little hiccups we've had in this year, is to draw a line in the sand. Moving forward, let us collectively do our best to turn this situation around. For my part, I have issued instructions to my chiefs to save every penny possible. We've raised the interest rates, called in every loan we've ever made (regardless of whether or not they're due), we're repossessing at a rate of knots and we're getting rid of as many staff as possible. We're also closing branches, moving the call centres from Bombay to Glasgow (cheaper wages) and we haven't paid the broadband bills so 'internet banking' is permanently down and our customers can't get their money out. Now it's your turn. Give us your support and your money. Together we can save the Company. I apologise in advance that neither I nor the CEO will be attending the EGM but as I have already explained, we don't actually know very much about this business anyway and we have far more pressing engagements....   15. As you are probably aware, it is very hard to get a major National newspaper to comment on individuals versus the major banks. But, after a nine month struggle we finally got an article in the Times yesterday about the appalling behaviour of HBOS. Please click on this link, read the article and add your comments and experiences with HBOS and BOS.   17. Hi, I am right in the middle of a horrendous situation orchestrated by the Bank of Scotland. In an attempt to cover up a scandal caused by a 'rogue' banker (twice reported in the Sunday Telegraph) and a consultancy firm, they have first crippled my company with illegal charges, then tried to put us out of business and finally they have tried to evict us from our family home. Fortunately the Judge, in a hearing to suspend a warrant for eviction, was appalled by the Bank's behaviour and suspended the warrant indefinitely. We continue to do battle with the Bank but it has prompted me to think that other people might be in a similar situation because of this scandal. So, I'm posting this to ask if anyone has problems with BOS relating to their rogue banker (suspended in March of this year from the Reading branch of BOS) or, even more pertinent, if they have had any dealings with a company called Quayside Corporate Services Ltd? I know this site is more for individual consumers than company or corporate problems but I know that other people have also been victims of this situation and I hope that I will find them through sites like this. If anyone fits the bill please PM me. I am going to run a daily blog about our life with no business, no money and no reply from the Bank.   18. Hi, We may be able to help as we have experienced a similar situation with the same company and the local council. We have proved they acted illegaly with regard to charges and that this was endorsed by the council. We also have evidence that the system they operate to record details in support of their charges and visits is fundamentally flawed and open to mis-use - which is a criminal offence.   21. Hi, Re herbie's post above - ANSWERS ON A POST CARD: I've been doing the sums for a while now and the really frightening thing is how many extra bailiffs will have to be employed? They'd need several thousand certificated bailiffs to effectively deal with the no. of warrants issued! I have this vision of an army of uniformed men in little white vans terrorising the country! And here's an interesting scenario - let's say we have 3000 or so bailiffs (that's the figure I came up with for the 2006 warrants issued considering a bailiff might do 10 visits a day) and all of them have to go through various proceedures with the courts to enforce their business. The same courts that already have a back log of work - so they're really going to be pleased with this extra work load. Then the bailiffs will, in many cases be calling the police for assitance or the public will be calling the police for protection. And how happy are the police going to be to be called out hundreds of times a day re bailiffs? Anyway they won't be able to do anything because their hands will be tied - so will they even bother to turn up? Or will they make half hearted visits two or three hours after they've been called and after the damage is done? Result? The safe guards that are apparently being put in place will work as well as the current ones i.e. they won't. But the difference this time is that the bailiffs will legally kick doors down and use physical force on people! And all in England's green and pleasant land!!!   22. This is such a disappointing post. The great thing about this site is that what ever views people have, they are genuine! They're not just obvious spin or damage limitation. Personally I think it's quite insulting and very obvious what is going on here and it's a waste of everyone's time! I posted questions to Catchthescum because I thought, at the very least, he would answer them himself and answer honestly precisely because this is a forum and an excellent place to put all genuine thoughts or comments. I've heard that there are many bailiffs who don't want the extra powers proposed in the TC&E Bill because they feel they will be putting themselves at risk (in the same way that many of us feel the Bill will be putting the public at risk).   23. Hi catchthescum (nice name), I'd like to ask you a question (three actaully). You're obviously a bailiff and a disgruntled one at that for alleged abusive language from people you collect from. But your contempt for anyone you consider a debtor appears to be apparent even from the name you are giving yourself for this site. So my questions are: given that anything to do with bailiffs and the collection of goods or money from someone with an apparent debt (and I say apparent becuse it is not always the case that the debt exists) is a very emotive and potentially volatile situation - do you, as a bailiff, think it's a good idea that bailiffs should be given the powers to break into people's houses? Don't you think people will retaliate to the invasion of their property and that this will cause considerable violence? And do you, as a citizen, think it's right for this government to overturn a right the British people have had for over 700 years, to be safe and protected in their own homes? I'm not asking this to be facetious or confrontational, I'm genuinely curious. Every one has an opinion on this matter and, as a bailiff, I wonder if you would give yours. Other side of the coin so to speak. I've only seen one other posting on this site from a bailiff (of course I haven't read every single posting on every thread) and he was an ex-bailiff and very detrimental about your profession. He confirmed what the majority of people on this site are disputing i.e. phantom visits, overcharging and menacing conduct. Is your view different? Regards Spandavia
