  1. My son missed an appointment which fell in between his signing on date and because the next appointment was excused because of the bank holiday he went to sign on today only to be told his benefit has been stopped. The reason he missed the appointment was because the appointment card or slip of paper was stapled at the back of his original appointment slip so he did not notice the appointment, plus the fact he is on diazipan and morphine medication which causes all sorts of problems. \they told him to do a rapid reclaim which he has done,but can he appeal against this decision.   2. Thanks for your reply, I don't know what has happened the man said he refunded it on the 22nd and now 5th Jan 2013 no refund nowhere? Cannot even contact them as it will cost money. really don't know what to do. Thanks Mashmallow
  3. Wonder if anyone can provide advice on this issue with paypal. Bought some goods of a web site, good were wrong contacted the compamy and was told to send back which I did. Got an -mail message from paypal stating that a refund was made by the said company and pending 2/1/13. Up to now no refund has been refunded. The goos were paid via my Nat West Debit card. The refund was made by the provider on the 22/12/12 and now it is the 4th Jan. What can I do about this any input would be greatly appreciated. Regards, Mashmallow
  4. My son has had a letter from EDF demanding 150.00 or the baliffs are coming 17th December to force entry. They have not read the meter i over 2 years and just provided estimated bills h e has being paying them around £40 per month and now this. I dont know what the correct bill is because it has been left for all this time, I guess it is partly his fault for not being on the ball. He is on benefit and cannot pay them anything untill the 26th when his benefit is due. Don't know what to do when they arrive. Any advice would be appreciated. Regards, Mashmallow

  6. My son had a visit from two officers from TV licencing he did not have a licence in place and told them that he froze it back in September because he was going to Scotland which he did. He contacted them a few weeks back to reinstate the licence and was spoken to like a criminal, the guy was most unhelpful and demanded payment eventhough he asked for a payment card, he did not have any cash in the bank as he is on JSA. The guy was so rude my son put the phone down on him, being a hot headed person. Hence the visit, they asked for his reasons which he explained and they seemed to be quite understanding. But I have my doubts as they read him his rights and gave him a Tv payment card. Do you think it will still go to court? Any advise would be greatly accepted. Not sure where to post this? mashmallow
  7. My partrner has a loan for £400 and they have been charging £15 per £100 for rolling over. Now they are increasing their charges to £20 per £100, can they do this and how can we deal with this loan in order to clear it insted of paying charges every month, we cannot pay the £400 outright. Any advise would be apprecaited. Regards Mashmallow
  8. Thanks St007, Once again for the information I am going to put forward these questions to him and also sending an e-mail to our MP once again. Apparently the solicitor said the barrister engaged has experience in this field and from the start we believed it now only to be told we might have to take it to the small claims court, this does not sound right. Stu, I spoke to the solicitor and bascially told him that all this has been wasted time he is going to speak to the barrister about compensation and will write to the council once again to chase up the disrepair. In the meantime we are thinking of taking this case to the small claims court but as this is still under the solicitors instruction not sure of where we stand. We have already done a damage form which the solicitor has got and apparently he said all proceedures have been followed. So really don't know what to do. Like to know what you think, and by the way thanks for taking the time for your help. Thanks Mashmallow
  10. Thank you once again Stuart I will ask for these documents but I have a feeling because it has gone to their leagal department they may refuse. I will read all the documents you sent and I am going to ask for a claim form. It looks like the solicitor is not doing much more and funds will run out so looks like court action ourselves to get some redress on this issue. I will keep you informed if you don't mind.   11. I thank all of you that have advised me, I am a bit thick and have no clue of what to do. We did contact the MP Margaret Hodge who basically did nothing on this problem, I am beginning to think the solictor is out for one reason to make money. He gave the council 7 days to do a pressure test and just one item and this was about 15 days ago, have not heard nothing back from the solicitor. The legal aid will run out and I know whats next he will say take it to a small claims court which he has said already after narly 2 years is there some one I can complain to about the solicitor leading us up the garden path? and wating our time and tax payers money to no avail. The surveyor that done the report was paid half by the council itself and half by the solisitors, there was numerous items pointed out to the council and to date nothing has been done. After all this I can see it going to the small claims court. The solicitor even said if you take it to the small claims court he could assist should I ask him for all the paperwork sent back so my son can apply to the local court and tell him to go and junp off blackpool tower now rather than waste anymore time? I am so grateful for all the input I have received and I have always contacted the CAG for various problems and I have so much trust and beliefe in them and also you kind people. I thank you Mashmallow PS I am going to ask for a claim form now from the council and then consider court action myself any further guidance on this would be grately appreciated

  13. Hi Stu, Many thanks for your time and reply. I sent a complted form to the council in the very beginning and I obtained a reference number but no reply came back. My son told the solicitor that this was done and he totally ignored what my son said and he keeps on ignoring on what we say, his reply was "this has been done" but we have no record of this. No tests were carried out and still none the wiser. All the council did was fix the leaking pipe and rescreeded the bathroom floor. My son is so fed up now with the whole situation he feels like giving up. We have now taken the owness on ourselves to put the property in good repair and especially after hearing what the solicitor has said it seems its a no go. We live in Dagenham and the council is barking and Dagenham council. All I want now is compensation for the stress they have caused me and also inconvenience of moving things back out of the bedsit in order to prevent further damage.
  14. Would be grateful if some kind person could shine some light on this nightmare. My son was offered a bedsit after waiting on the council list for 5 years, a bedsit was offered which he accepted. Henoticed a very strong damp smell and pointed this out to the housing officer whilst viewing the property and was told there was a flood from upstairs thus the smell and it would go away. Hence, various problems started arising such as the bath pipe was leaking and left undetected, a leak in the kitchen, mould growing in the hallway, the bathroom sink fell off and a few other problems mainly of a stron odour so strong that it was contaminating my clothes, food and everything in my flat including books and my sofa bed which was black in colour and was going white. He moved back in with me and after about 20 visits from various trades attending the problem nothing was solved. That is when I asked for assistance in disrepair from a solicitors and was grate to have legal aid as I had a good case apparently. A surveyor was engaged to do a thorough examination of the property paid half by the council and half by my assistant. The council attended the flat and said the leak was fixed which it was and the floor in the bathroom re-screeded, apart from that nothing else was done, the sink was left half way fitted, cupboards in the bathroom left broken, bath panel left off, I could send the photos but would take too long. My solicitor has time after time given them nearly 2 years to complete the mentioned works and 15 days ago he gave them 7 days to do a pressure test if nothing else and now he tells me because the claim for disrepair and damages to my belongings come to under £5000 if the council do not do anything I will have to take it to a small claims court myself as my assistance will run out, so all this time and money wasted for nothing has gone where and to whos benefit, I would like to know. He is still paying rent for a property he cannot live in. Why did he not say this to start with it is leaving me to believe my solicitor and the council are both [causing problems] somewhere.   15. I would appreciate any advice on these people formerly MMF chasing a wage day loan about 5 years ago. I stopped paying them because they was continuing to add charges and I repaid this loan 5 times over. MMF have been chasing with threatening letters and now letter from Marshall Hoares threatening to visit. What should I do about these clowns? Please anybody Thanks Mashmallow
  16. Please can someone give me some insight on what to do. My Bulldog took ill Monday just gone Bank Holiday, I was frantic and had no means of transport or money to pay for a vet to visit I called the RSPCA and they finally agreed to assist me by sending an inspector to collect my dog on condition they did not need to treat him but put him down which I agreed as he had lost control of his body and could not get up, he is 13 years old. They took the Dog and said they would call me. I foolish enough was in such a panic that did not manage to take the details of where they where they were taking him or what is going to happen. It is now Thursday evening and after 16 calls to them and their HQ's no one has called. We are all going mad. I feel I might as well have taken and thrown him in the dust bin after 13 years. I actually had to feed him with a wooden spoon and wipe his backside and wipe his nose he was fine up till MOnday. Any advise would be gratetly apprecaites. Many thanks Mashmallow

  18. Thanks for this information, the latest is this it is not just mounld apparently there is an underlying problem to do with the pipes infact I think it might be sewage. The bedsit abousultely stinks all my possession smell every down to a carrier bag, the brand new sofa bed I bought which was black in colour had patches of white all over, the wardrobes stink and yes there is also mould. My son was lucky enough to be entitled to legal aid, a surveyor done a full report but the council is refusing to do all the mentioned works which include pressure testing the pipes,]. So at present nothing is happening my tenancy which is unsecured up to now, I took the property on the 18th April, he has not even been given a proper tenancy agreement to state that he is now a secured tenant and to tope it all up the solicitor is now saying he may not get the funds to engage a barrister to attend court?????? This is driving him mad and me also because he is staying with me and there are so many arguments and rows. All he wants is his own space. He now just wants to give the property up and not pay no more rent. I suggested going to court himself and fighting the case, the solicitor is not doing a good job and the council don't seem to care about going to court?????? I hope there is a light at the end of this tunnell he has been waiting for his own space for years and yes he should not have accpeted the propery but he was fooled that the smell was only a bot of damp. If I could down load the photos the surveyor took you would be shocked at the state the streets are cleaner and nicer to live in. Please someone help???? Many thanks Mashmallow:mad2:

  20. Thanks for your input, I think your agency are pleased to get commission in your placement so I think this may be a little different situation. My agency are telling me I have lost my holiday entilement becasue I did not put it in by the 23rd March which was only last week. No one even had the decency to remind me to take my holiday, plus the fact I cannot take the money because I am working with them and I cannot really have the cheek to say I am off for a week when I start a two week booking which has now turned into a 5 week booking. Is this how you are treated for being a good worker and a dependable one. Please any advise would help. Thanks Mashmallow:mad2:
  21. Thanks for replying so quickly and moving my post to it's correct detintion. Because they put into another booking after the previous (thus earning my hours for holidays) how could I say no I am not doing it bcause i will loose my holiday pay, i had no choice but to fo the booking. How can you say you will do a three week booking and then say you want a week of for annual leave. it should apply differently if this is the case for temporary workers. Some companies do lay down the law if you don't use your days you loose it - but I have no choice to take what comes and when it comes. So I feel I have been treated unjustly. Thanks Mashmallow
  22. I am working for an agency at present and i hd accumulated 38 hours holiday and because I was placed in another position straight after therefore could not book any holidays. I now found out my hours earned within the few weeks before I have lost because i did not take them when stated as I was in another temp position. What can I do about this I am gutted, its my hard earned money and they can just take it without letting me know. Please can anyone help and advise. regards, Mashmallow
  23. Site team, I have looked into some of my paperwork and found the origin claim form from Banbury County court, I cannot find the judgement one. At that time we sent in an I/E sheet stating that my partner could only afford £20 and it was agreed to date. The charge order was at Romford Court on a seperate occasion whilst the debt was being dealt with at Banbury. Shoosmiths are still harassing and demanding an I/E sheet to be completed otherwise further action. Where does he stand with this. I have already sent off an harrassment letter and also a SAR.
