  1. Hi Take it easy Check out post 3041 this has Smarterchicks questions in it. Thanks doc
  2. Hi Take it easy I'm rather disappointed that you haven't afforded, to some of us answers to the questions that Smarterchick had posed earlier today. I was looking forward to your replies. All I've read this evening is a "tit for tat" "cat calling" "mud slinging" tirade. I had hoped for better things. Alas it would appear that it is not to be.:? Doc
  3. TIE Forgive my ignorance8-) ... I hate TLA's (three lettered acronyms!!)) ...what does TCF stand for?? Sparkie Should we be discussing arguments to be used for Tuesday's High Court case, the night before, on this forum? Doc;)
  4. As you have stated .....in your post....you are very knowledgeable in matters of a financial nature:- (Quote TIE) "I can assure you that I do not work for Swift, but I do understand credit, lending and securitisation which is why I can categorically state that most posts on this board regarding technical issues are so factually incorrect that they are dangerous. Not a single post discussing loan sales to Kestrel, securitisation, servicing, accounting, trading styles, company names, etc. are inproper." Perhaps I can ask you again to share your expert knowledge and enlighten all of us on here.....I do enjoy a good factual, open, honest and transparent debate....I am always eager to learn. I ask you therefore to point out the errors and inaccuracies so that we may learn together on the best way forward with this company. I throw down the gauntlet.....I do hope you have the ball bearings to take it up???
  5. Take it easy Perhaps that is what you should do?? I know what you're at........ :D...!!!!??? Maybe you could share some of your vast knowledge and experience in these matters with us all......after all you seem to view everyone on this forum as errant debtors,.....who should pay up and shut up....after all why should we be allowed to have access to the law that is meant to protect both the lender and the customer. Perhaps we should go back to the dickension days.....throw us all in the debtor jail....without any recourse.....better still let's tear up the statute book!!:)8)
  6. Swift Advances Swift Advances is a niche lending business providing secured housing loans to borrowers in the UK. Based in Essex, Kestrel is the holding company for Swift Advances. above taken from this website Alchemy - Deals Listed From Wikipedia, A holding company is a company or firm that owns other companies' outstanding stock. It usually refers to a company which does not produce goods or services itself, rather its only purpose is owning shares of other companies. Holding companies allow the reduction of risk for the owners and can allow the ownership and control of a number of different companies. In the U.S., 80% or more of stock, in voting and value, must be owned before tax consolidation benefits such as tax-free dividends can be claimed.[1] Sometimes a company intended to be a pure holding company identifies itself as such by adding "Holdings" or "(Holdings)" to its name, as in Sears Holdings. The Company as a Holding Company Ownership of 51% of shares gives majority voting rights at an AGM and on the payment of dividends the largest share of profits. 51% gives as much control as a 100% holding. Individuals or other organisations (e.g. pension funds, insurance companies, banks) can own shares. Unit and Investment Trust companies for example exist by owning shares of other companies. Some companies (holding companies) may seek to own sufficient shares (51%) to control other companies. Holding companies themselves do not make goods or provide services, the companies they own with 51% will do this. The owned companies may be: Subsidiary companies The holding company owns more than 50% thus giving control. Associated companies The parent company owns 20-50%. This is a large shareholding should provide considerable ifluence (but not control) over the associated company. How much influence will depend on ownership of the other shares. Owning 49% and wanting control when a rival company has a 51% stake may be a less than appropriate strategy. Related companies as similar to Assocaited companies. They typically own fewer than 20% of shares in another company. This hlding may be held ecause good dividends may be expected or the two companies are co-operating with each other in some area of business. Small shareholdings may be held by banks or Unit or Investment Trust companies as ingredients in their portfolio of ownership. Public Limited Companies PLCs are usually holding companies. The parent or holding companyçs profits arise from the aggregate of profits from other companies it owns (its corporate portfolio). Parent companies may have a corporate head office and will employ corporate executives/managers, accountants, legal staff, and other administrators. Sears Plc, GEC Plc, Unilever, British Petroleum Plc, United Biscuits, Allied-Lyons Plc are all holding companies which control many other companies whose products and services are household names (Persil, Selfridges, Vent-axia, Dolcis, Tetley Tea) Holding companies make profits and returns for their shareholders by buying, running and selling other companies. They do this via: the profits of companies they own (typically 51% control) or participate in (less than 51% - without control) acquiring other companies and selling at a profit; Such acquisition may include buying another holding company, splitting up the held companies and selling some or all of these to redeem all or part of the initial purchase cost. Some of the acquisitions may be retained in the holding company's (purchasers) portfolio. Benefits of a Holding company the parent has a portfolio of market interests. A company that operates in only one market, such as hotels is subject to the economic and competitive health of that industry. A holding company spreads risk and has more opportunities. With a down-turn one of its market sectors, it can switch its interests and concentrate more on other sectors or divesting and entering other markets. Each subsidiay is separate a legal entity, they are not all absorbed in one homogenous company and any given subsidiary can be readily sold off (portfolio divestment). A holding company is a convenient structure for this. the rules of majority shareholding mean that a holding company controls by owning only 51% of shares in a subsidiary. This is a cheaper option than buying the company outright. it is difficult to control very large organisations. In a holding company, the Directors of member companies, can be given degrees of autonomy to manage their companies effectively. A holding company aids the devolving of responsibility, authority and action. with subsidiary companies maintained as distinct entities in holding companies further businesses can be acquired by merger or take-over and added to the group portfolio. Annual Accounts and Accounting Rules The preparation and presentation of the annual accounts of holding companies are defined by accounting rules and standards.

  9. Hi Sparkie Just a "wee" nudge to let you know that I PM'd you a few days ago!!! :D Doc
  10. Hi Sparkie It's great to hear you back on the site again. Can Swift be retrospective in adding these trading styles onto their Credit Licences? or is it a case of ooopsss !!! too late you've committed an offence?? Regards Doc
  11. Hi Pinky69 Many thanks for the phone harrassment letter. I wonder can you comment on a form of words for the chasing of a debt that a previous DCA said they couldn't locate a signed agreement from the Original Creditor? Regards Doc:)
  12. Hi I'm sorry if I'm in the wrong forum, however, let me ask a quick question. Cabot keep ringing at all hours of the day (8:00am) and up to just before 9pm, they are chasing a debt that I have received confirmation from another DCA who I had SAR'd for details of me owing the money. The previous DCA wrote back and said that they could not find an enforceable CCA, however they said that we should still pay the money (£400 apprx) as we had received the goods. Would anyone have a form of wods that I could write back to cabot with as they are starting to really really get on my nerves. Regards Doc:)
  13. Yes funny....my OH has just advised me of the same! Bit too late isnt it for them to change their charges....does this mean they'll refund them to us!!!????
  14. Young Paddy bought a donkey from a farmer for £100. The farmer agreed to deliver the donkey the next day. The next day he drove up and said, 'Sorry son, but I have some bad news. The donkey's died.' Paddy replied, 'Well then just give me my money back.' The farmer said, 'Can't do that. I've already spent it.' Paddy said, 'OK, then, just bring me the dead donkey.' The farmer asked, 'What are you going to do with him?' Paddy said, 'I'm going to raffle him off.' The farmer said, 'You can't raffle a dead donkey!' Paddy said, 'Sure I can. Watch me.. I just won't tell anybody he's dead.' A month later, the farmer met up with Paddy and asked, 'What happened with that dead donkey?' Paddy said, 'I raffled him off. I sold 500 tickets at two pounds a piece and made a profit of £898' The farmer said, 'Didn't anyone complain?' Paddy said, 'Just the guy who won. So I gave him his two pounds back.' Doc2527:D
  15. Hi Sparkie Forgive me in adding this to your thread, however I felt others should see it as I had just accidently come across it:- http://www.consumeractiongroup.co.uk/forum/bank-charges-finance-industry/234186-financial-ombudsman-comes-under.html#post2594577 Doc
  16. Hi Sparkie I'm sorry to have learnt that you have been unwell. Here's wishing you a speedy recovery and a Very Happy and Prosperous New Year from Me and Mrs Doc to you and Mrs Sparkie!! :) :) We're all wishing you well. Doc
  17. Hi swifteater Good to have you back on the forum again:) Do you not feel stuffed also??
  18. Hi Sparkie Don't beat yourself up. You have not failed and you have no need to be sorry to folks about. You are a beacon of hope for all of us, who have also suffered under the hand of these unscrupulous barstewards. I am and always will be in complete awe of your expertise and knowledge. They will deserve all that they have coming to them....very very soon. I used to feel that the justice system was fair....now I am sure they also will come under the spotlight, in the same way as bankers and MP's have. Sparkie, I know that you will find another angle. Best wishes Doc:)
  19. Do we know where they have gone?:rolleyes:Are they like John the Baptist in the wilderness? "Making straight the way"!!! I wonder who the chosen one will be!!??
  20. Hi PKelly It's good to hear the Irish lads are in fine fettle. I have a friend who knows them both very well and he has nothing but great things to say about them. He tells me that they are two very sound, pleasent and intelligent fellas, and no one could pull the wool over their eyes when it comes to the ins and outs of the law. However he does assure me that he wouldn't like to go home short changed to them, as they are a mighty force to be reckoned with. Lets just say I'm glad I'm not up against them, unlike some of the arcadia bunch.....!!!!
  21. I think these rabbits are riddled to their core with "Maximus extortionatus atrocius" Who is at risk? All rabbits and birds ,whether wild or domestic are at risk. How is it spread Maximus extortionatus atrocius is typically spread by blood sucking parasites and in particular the robbing barsteward flea, Spinelessbackbonelisyllus cunning caaantulis. This flea is frequently found on wild birds and transmission in the absence of third charge unregulated agreements is unusual,. Signs and symptoms The incubation period varies depending on the strain and its virulence and is typically at least 2 weeks after signing. Accompanying the classic bulging pockets and bank balances that most of us associate with Maximus extortionatus atrocius, are localised swellings around the head, face, ears, lips, anus and genitalia. Severe swellings can lead to blindness and distortion around the face within a day or so of the onset of symptoms, leading to difficulty with feeding and drinking. Progress of the disease may be slower in well paid for legal eagles and recovery is sometimes possible with the intensive grinding of individuals down at county court level. However, Maximus extortionatus atrocius can be a very protracted and profoundly unpleasant disease and possession is generally recommended. Management of Maximus extortionatus atrocius There is no specific treatment for the virus and any treatment offered is merely supportive through counselling at very expensive rates. Treatment is occasionally contemplated but would not usually be recommended for rabbits with the full-blown disease since affected individuals suffer dreadfully, have a low chance of survival and they remain a source of infection for other rabbits.
