  3. Returned the agreement signed on Friday 14th , recieved another letter last Thursday saying we are still awaiting your reply to our letter dated 11th July (i.e above letter). Phoned Deborah D'Aubney only to get her voice mail , so left a message asking her to contact me and i havent heard anything since. I have now check moneyclaim and i get status of claim defence You are unable to take any further action online on this claim. The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly. So i guess i just have to wait to go to court now.
  4. This has probably been covered a million times , had a look at the FAQ and couldnt see anything relating to what charges i can claim back. Can i claim late payment charges on credit cards? and also i used to have a loan with First National Bank PLC which i found a few old statements for when having a clear out and ive seen that i was charged an overdue payment fee of £30 on a few occassions can i also claim this back? I expect that both answers will be yes but wanted to be sure before requesting all my statements. Thanks in advance

  6. Recieved letter from D G Solicitors We are instructed by HSBC Bank plc in respect of the claim you have recently issued. HSBC is entirely confident that its charges are reasonable , are properly and fully disclosed in its terms and conditions , and that it would successfully resist any challenge in the Courts in relation to them. HSBC is , however , mindful of the management time and irrecoverable legal costs associated with litigation in the small claims regime. For those commerical reasons alone , and without any admission of liabilty whatsoever , HSBC is prepared to make a payment to you in the sum of £3873.85 representing the charges applied in full and final settlement of this matter.HSBC does , reasonably , require your confirmation that you will treat this payment as confidential. Has everyone who crossed out the line : I agree to keep the fact of the claim and HSBC's ex gratia payment strictly confidential : still got the cash? also do i need to go to moneyclaim site and stop the action. I have recieved more charges since i sent off the claim for the above amount , can i start another claim to recover these?

  9. Recieved a letter today from D G Solicitors reading : Dear Sir Re : Yourself v HSBC Bank plc We have been instructed in relation to your claim you hvae recently issued against hsbc. To enable our client to consider your claim please supply a breakdown of the amount you are claiming. What do i send them? A complete list of every individual charge or just what the charges total up to and then seperate list how much interest i am claiming? Also recieved letter from moneyclaim saying that Acknowledgment of Service has been filed and then ive got a copy of the Acknowledment of Service. D G solicitors 12 Calthorpe Road Edgbastion Birmingham Are the solicitors involved and they have ticked the I intend to defend all of this claim box.

  12. That would make a daily rate of £9.27 , does that sound right?
  13. Would my total charges be including the interest? If so it works out to be 3753.85 x 8% /365 or if it doesnt it would be 3133.50 x 8% /365.
  14. Recieved letter from bank saying that they have stated their position in previous letter so starting claim with money claim although having a few problems with particulars of claim. When clicking the reserve the right to claim interest tab i get pop saying Do you want to reserve the right to claim interest? Since you have indicated that you wish to claim interest on the money the defendant owes you, you must include the following text in the particulars of your claim: The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}. where it says {put the amount} is that the total amount of my claim including interest and also what do i put in {enter the daily rate of interest}? Hope someone can help me out , thanks in advance.
  15. I didnt get any kind of reply from my prelim letter and the 14 days will be up tomorrow. Will be posting LBA tomorrow afternoon.
  16. Ive already sent my prelim letter off , do you think i should send a dpa request tomorrow then just delay my LBA by a few days?

  19. I dont know if i should print my statements off as i just browsed through each month online and totted up the charges , came to £2991 Sent my prelim letter off yesterday so the clock is now ticking.
  20. Been reading through the forum but cant find how you work out how much i should deduct from what theyve charged me. E.g. Ive gone overdrawn and got charged 10 times resulting in a total charge of £300 , do i claim the full amount or do i have to deduct say £120 as a reasonable charge? Thanks in advance.
