    i take it the taken protection part wasnt aimed at me

     

    i have since receive a letter from Capquest advising it will take 28 days to look into this and they would be grateful if i could send them any receipts or statements i have.

     

    1. Surely they are stating there they will break the 12 day time limit

     

    2. Why would i want to prove anything

     

    also i got my credit file from experien and equifax and i cant seem to see this debt anywhere on there. Would there be any reason for this?

  2. His charges could vary from £20 to £300. I have had £260 debited one month due to dd returns and they were all charges. I found that my charges always came off at the start of the month and were always a round figure.

     

    Definetly sit down and take you time and i found it helped by typing them into a spreadsheet when going through them.

I have got to the stage where i had to take court action but because i live in scotland and my claim was over £1500 i have had to progress through the FSO which i have sent the details on the 1st of may. On the second of may i get a letter saying they will put £750 in my acc as a goodwill gesture and that is there final answer. I have handed a letter into the branching stating i will accept this as partial payment but will proceed to reclaim the rest and have made an official complaint to the FSO.

     

    Now, the money is in my acc today what should i do with it?

     

    Can i pay off other debt with it has i have told them i will accept it as partial payment or should i transfer it into my lloyds saving acc and keep it there until matter is fully resolved?

    Sent off the CCA on thursday by recorded delivery and this the first communication i have had since the above posted letter i received.

     

    Got a this letter this morning.

    Why have i received this or does anyone know the point of it. It has a halifax logo at the top in blue but i have a funny feeling that the letter is a photocopy and the stamp mark on the envolope was from FLEET just where capquest offices are.

     

    Is this their reply to my cca?

  6. Thats weird them not giving you a debit card. I had a cheque guarantee one for ages then they took it away cause i was using switch to go overdrawn getting cashback. Believe my credit rating is a disgrace but the lady said usually if you go 6 months without getting a charge or going overdrawn they will usually issue you a card. I done this and have now got a debit card albeit not a chq guarantee card and i have not been earning alot due to short temping contracts.

  7. Just like to say well done. I am about to fill in the forms to take capital one to court. What was it like, what court?

     

    Did they give you a offer at first as C1 have paid a small amount to my acc but i want to claim the whole thing and am stuck filling in the amounts

  8. Hi,

     

    i am at the same stage with lloyds. I sent the first two letters and only got back the tcs letters. I phoned the FSO and they sent me out a pack to complete and also sent back a photocopy of everything i had sent and received from lloyds by recorded delivery that was on the 29th of march and i called yesterday and the lady said they are just about to start work on mail received the start of april.

     

    I am claiming back £2000. In the letter to FSO i also added the 8% as we should be entitled to this as it is not our fault scottish small claims is only upto £750.

  9. I am claiming £280 from capital one(not including interest). They have paid my DCA £118 to reduce the debt. I have sent a letter accepting this as partial payment and advised of court action, but how do i put this on my court papers.

     

    Is anyone able to copy and paste part 7 or will i have to type it all out?

    Received letter from capquest after sending them a letter stating the account was in dispute with halifax.

    Furhter to your recent correspondance and in order to process your communication further, we will require you to provide the following information by 09/04/07.

     

    Full details and supporting documentation of your dispute with the above client

     

    Your account is on hold for 10 days however, if we do not receive the above information by 09/04/07, your account will be passed to our collection department for further action.

    just to add the last payment/transaction i made to this acc was on the 9/09/2002.

     

    What should i do now, should i send them the CCA request above?

    just thought i would let you know that Ge Capital have paid up. I was claiming £48(house of fraser) and £204(debenhams) from them and sent the first letter on 20-03-07. I received a letter to day where on the first page it stated the t&c's but on the second page he said he would settle. This is without interest but after the first letter i will accept.

    ge money just sent first letter

    capital one just sent letter before action

    halifax just sent first letter then mysteriously receve this threat from Capquest/ h l legal

     

    So if i was to send the cca and they didnt have it in 14 days, i would still owe money but would not be able to go to court to get it. If they got it after that?

     

    Is that why you advise go for the appeal letter first

    I have just received a letter from H L Legal who have been appointed by capquest saying they are going to start legal proceedings for £3664.36 plus costs.

     

    I have recently applied for my statements from hbos for unfair charges and have not heard from this company for along time could it be a coincidence.

     

    1. On my statement it says that my final balance was £3169.22. so where has the extra £500 came from as debt people dont usually add interest.

     

    2. What is a CCA. From what i can see it has something to do with the agreement and getting the debt transferred back to the bank?(this was a credit card)

     

    I called capquest and the guy wants me to send in my incoming and outgoings( i am on benefits) i also advised i was disputing with hbos and he said i should put this in the letter. I would prefer to deal with the bank as i do not like debt agencys and there tactics how can i do this.

    26/02/07 sent letter detailing charges(£1820)

    12/03/07 got standard reply saying they are in the tc's

    13/03/07 sent letter advising of possible court action

    at the end of this week it will be past 14 days and no reply.

     

    By reading other threads i have found out i can no longer do 2 claims as i live in edinburgh and the court wont accept it.

     

    I called the FSO today and they are going to send me a pack out and the guy is also going to send another letter to lloyds on my behalf.

     

    I would greatly appreciate to hear from people that have used this route or in the process of this

  15. This £12 has been deemed the maximum you can be charged by a credit card company but IMHO is still unfair.

     

    I have recently had the same letter from C1 and am going to send the lba letter but stating that "I will accept your offer of XX as partial payment but intend to claim the full amount"

     

    As far as i am aware many people have went on to get the whole amount plus interest back.

  17. I think i may have this wrong.

     

    What i am looking at is i am owed £280 by Capital one.

    I am looking to add interest but not at the statutory rate of 8% more like the rate that they charged me of 29% on money owed is this possible.

     

    I don not have statements just a list of charges with dates.
