  1. Hi CD, I got that letter too (yesterday). See if anyone can help us here - if not maybe start a new thread?

     

    At least it looks like we can take action together and support each other. I haven't caught up on all the threads of the last few days to see what the guidance is at the moment will try and do that but can anyone help us out?

    Hi Charlie, that's good to know! We'll have to see how things develop for us both at Leicester, though it's not looking great :( :

    A combination of the two AQ deadline extensions the Leicester judge gave DG and the court's own massive backlogs mean that in my case they got an extra 7 weeks crossing nicely into the High court test case happening.

     

    Lets see what the Leicester judge decides next, will we just get a letter putting everything on hold...

    An AQ was issued: My deadline to submit was 30th May, HSBC's extended deadline was 17th July and they filed by fax on the 17th.

     

    Was waiting to hear from Leicester Court re their backlogs. I rang today and was advised I will get a letter soon staying the case in the light of the High Court Case.

  4. Just a quick question as I while away the days waiting for Leicester Court to deal with their backlogs :rolleyes: (it's been 10 days since DG finally sent in their AQ and court tells me it could be up to another 10 days before the documents get sent up to the judge):

     

    I haven't been sent a copy of DG's AQ, and it's 10 days since they faxed it to the court. Does it matter? Will I just get a copy with the courts paperwork when the judge decides on a court date etc?

    Upon considering the papers in this case and the allocation questionnaire filed by the Claimant it is ordered that unless by 4pm on the 17th July 2007 the Defendent do file their completed questionnaire, the defence is struck out.

     

    :( Disappointingly... DG finally submitted their AQ by final deadline of 4pm yesterday, the court told me that they FAXED it over at 11am.

     

    The court person I spoke to couldn't tell me what was likely to happen next because of the backlogs at Leicester, so I'll keep ringing every couple of days.

     

    Does this mean that as the court ended up giving DG a full 6wks longer to submit their AQ and I may now end up getting a hearing date next (is that the possibility?) - that the courts AQ process and backlogs, in my case has just delayed everything for 6weeks to the benefit of DG and the detriment of getting me nearer a resolution or have I missed the point?

     

    Should I have been sent a copy of DG's AQ? and is there anything else I should be doing with the court or DG?

  6. They have been known to submit AQ's but often dont, unfortunatly Leicester CC seems to be suffering more than most with the backlog so brace yourself for the agony :(

    (At the very least if DG do unfortunately file the AQ can I hope the court is precise and sticks to the exact deadline? - not giving them any more leeway for getting the AQ in just because of their backlogs in actually putting paperwork on the system?)

    Does anyone know if it's likely HSBC will actually finally submit their AQ now they've had this ultimatum? I'd just like to mentally prepare myself and not kid myself I'm closer to victory than I actually am! lol

     

    And if HSBC don't submit their AQ on the 17th what steps do I take?

     

    The way the courts been running, I'm afraid I'll be in an agony of not knowing for days as the court won't be able to confirm it because of their backlogs in putting stuff on the system. Which is how it's been so far...

Hello, this took some time! - my AQ deadline for submitting was 30 May, then Leic County Court gave HSBC an extended deadline of 8 June which they missed (I rang court every few days to find out next stage but they said they had an admin backlog) so the directions from the court only finally arrived today:

    Then there's something much further down the form that says (and is dated 28 June?):

  10. Hi here's my update on how current timelines are working out:

    I filed my AQ on the final date of 30th May, HSBC didn't even file by the courts extended deadline of 8 June. The court (Leicester) were only able to finally confirm this to me on the 12th June due to their backlogs with filing everyone's AQ's on the system. When I rang the court to find out next steps (ie would they issue an unless order etc) they said I wouldn't find out what the judge would decide to do for at least another two weeks due to their backlogs and admin turnaround times.

    Is this what other peole are experiencing in terms of timelines?

    HSBC are really benefitting from this and it's just stretching it out unnecessarily as most people are saying. I'll just be using the time to read up on the court bundle in preparation then to make sure it's spot-on.

  11. I rang my local court and they've finally logged my AQ today (my deadline for submission was the 30th May) hurrah - so it's on!

     

    They told me HSBC didn't submit theirs for the deadline (what a shock) so the court is giving them till this Friday 8th June and then the Judge will decide how to proceed depending on whether they do or don't file....

     

    At last things should start moving towards an outcome - I can't wait

  12. Hi all,

     

    My local court requested an AQ to be completed by Wed 30th May and I dropped it off personally on the 30th (with a draft order for directions) and paid the £100 fee.

     

    I rang today to check if DG had filed theirs so I could send another nudge letter but was told the court had a backlog and were still logging AQ's from 25 May...so mine isn't even on the system yet and probably won't be until the end of this week - consequently don't know yet if DG have filed either and can't find out the the next steps to take yet. I'll just have to be patient again I guess....

    thanks Pete, I checked on here before I set off for the court to file the AQ today - it's just such a shame the court was closed for an extended bank holiday when I got there! (lol! Oh how I'll look back and laugh one day). My deadline's tommorrow and the court's actually been closed since Thursday - they could've put that information on the paperwork or at least put an answermessage on any of the 5 numbers I rang before I set off today!

     

    Oh well tommorrow there's no stopping me, just want to get it done and dusted.

    Lattie, totally agree with the strategy for the nudge letters. I have no expectation of a quick response from DG at all but it will just help to show that we've been endeavoring to keep the lines of communication open with DG and trying to avoid wasting the courts time further down the line (unlike the banks) as well as keeping us visible to DG as you pointed out.

  14. Evening folks just checking in for advice before I file my AQ at my local court tommorrow.Can't believe I'm at this point! My final date for filing is the 30th so I'm going to drop it off at the court tommorrow (Tues 29th) with my £100 fee.

     

    I've completed and attached 1) a draft order for directions and 2) the summary paragraph (section G-other information). Is that everything I should be sending at this point? (I take it the 3 sets of more detailed documentation and court bundle have to be prepared for when the judge gives directions or sets a court date?)

     

    Should I also send a copy of the AQ (with attachments) and another breakdown of charges to DG solicitors by special delivery tommorrow?

     

    After that I'll call the court on Thursday to see if HSBC have filed their AQ by the deadline (3Oth) and if they haven't i'll send them the recommended nudge letter?

  15. i wrote one thread when peeps were doing the aq and another when the aq's were mostly dispensed with - there are nudge letters in post one of both - you'll find one pretty close to what you want - just tweak any of them - they aren't official - just out of my head!!!!!When you have filed your AQ................

    here's the aq info

     

    on, the other front - of this two pronged thing - have you sent dg a breakdown of your charges - it is advisable to do that, as they always ask for one before they offer anything - so it saves a couple of days.

    and unless your claim is for under 1500 and wouldn't incur the filing fee of 100, i suggest leaving it until the aq is nearly due before filing it - as dg have been coming in with offers just before the due date in several cases.

     

    i'd do the draft directions - (anybody who has to do the aq - i'd say yes, for sure)

    Just a question:I did send DG a copy of the charges breakdown with the first nudge letter on the 10th May - the day before I got the defence notice and AQ request from my local court.

    Shall I send another copy of the breakdown to DG with a second nudge next week, if so is there another cover letter I should send this time as I sent the one referring to possibly not requiring an AQ but have actually had the AQ request from the court since?

  17. morning! I read about yesterdays Lloyds judgement but have to plough on regardless I guess (though I'll be reading up on the full judgement in detail). Funny it hasn't put me off just made me more prepared to see it through even though I was really nervous at the start.

     

    Where I'm at is that on 4 May I got the Notice of transfer of proceedings from Northampton with from what I've been reading sounds looks like a standard 5 point defence and a note that the AQ may be dispensed with unless the district judge orders otherwise and that an allocation fee may be payable and to contact the local court for more info.

     

    I just managed to send off the first nudge letter to DG on 10 May (as per Latties advice) but on the 11 May got the Notice of Defence filed from my local court and an AQ to fill in for the small claims track by 30 May and stating that the £100 fee is payable on filing of the AQ.

     

    I also had a mediation info leaflet (ha) included both times but with no other reference to it.

     

    It's been so useful to have read up on everyones experiences here so far so I need to start completing the AQ it not too sure if I need to send the draft order for directions too as I've heard mentioned?

  19. Mia, DG (the solicitors) will defend (if they get a chance). Over the last few days a new pattern has emerged, we think the courts could be short circuiting the system to reduce their work load. Read this thread but dont be alarmed by my comments its actualy good news because it should force DG to make more offer's faster.

  20. Hi guys, moving forward at last:

    After I registered for MCOL on 27.03.07, got a letter saying it was posted to HSBC on the same day and would be deemed to be served on Sunday 01.04.07 (yesterday). I've had the acknowledgment of service from DG already! (dated 29.03.07).

     

    If so, the 28 days works out to be a Sunday 29.04.07 is that right? Then what time on that day should I be (hopefully if HSBC don't defend) aiming to push for judgement and can I do that on a Sunday?

     

    Funnily, I'm getting calmer about doing this the further it goes...
