  2. Hi Kim, Very good luck to you, I won my case with Abbey just a month ago now. Be warned, they are taking them to the very last point now, trying to ween out the weaker victims, please don't give up on your case, keep at it, because they will cave sooner or later....your right. I don't quite know how it stands when it comes to a court case, as they select a court nearest to you, unless someone was representing you...maybey it won't go that far? Laws
  3. Dear all, I am sorry I didn't write sooner, on the 29th of Jan 07, Abbey folded on the completion and recipt of my court bundle pack. They claimed that it was more cost effective for them to pay me that it was to go to court....but I say they knew they could not win and just wanted to see how far I would take it!!!! Ha ha ha......£1038.85 refunded 2 days before the court hearing! Please people, take your cases to the very last point, I know it is stressfull, my hair was going grey, but they are pushing more and more people to see just how far they will take it. I have 4 friends from work and my sister that were using my info from this site and they too have been refunded....but watch out, 2 of them got payments into their banks as refunds and they knew nothing of them until they got their statments. Remember to tell the court ASAP Everyone of us that got our money back will be making donations to Consumer Action, where would we have got without your help and constant support.....NO WHERE!!!!! I have my court date...31st of Jan 07, but I'm trying to make sense of the court bundle, but I just can't get my head round it, its like a completely different langusge, and I can't even state which part, because its the whole thing. I'm trying to get my court bundle together to give to the judge, and that has to be in by the 10th of Jan, and I have absolutly no idea what I'm doing here....please can someone help me? I need a court bundle that makes sense so I know what I'm doing when I go to court, or they are going to see right through me! Laws
  5. Dear all, I never thought it would get this far, and now I'm really worried. I have the court bundle pack, and my date for court is the 31st of Jan 2007, Abbey have not shown any signs of giving in, and no letter or cheques have landed on my doorstep yet??? I have tried to read the bundle pack, but I just can't get my head around it, I cannot make head nore tail of what it all means, Can someone help me? My court case needs to be givein the to judge by the 10th of Jan, and time is running out fast! Please help me! Laws:confused:
  6. Hi I'm Laura, I am in the middle of making a claim to the court for just under £1000 with Abbey. I have got most of my help from people on the site here, and without them, I would surely have crumbled at the 1st step. Thank you everyone. I have so far got £222 a GWOG (Good will offer gesture) from Abbey and I wrote to the court and told them of this......but what really boils my blood is they put that payment into my account before I had a chance to say no! Very sneaky! (See Karnevils warning on this) I filled in my Allocation Questionaire and sent it back, now I'm waiting for a response from either the bank or Abbey, but its taking a long time and I'm getting worried......is this normal, will it take a while for the court to write me?
  7. Ok I get on that and get it all posted tomorrow back to the court. Getting nervious, got all my paperwork to read thought now before I go to bed, I just hope it doesn't go as far as the court day, but I know Abbey...... But its me that will get the upper hand in the end! thanks again Tamadus,
  8. Yeah the £222.00 was part of the full amount I was claiming, so I guess best to tell the court then? Should I add it into the AQ part G (Other info) then?

I also have another question......As Abbey refunded 8 of my charges into my account, even though I did not actually except their good will offer of £222.00, should I mention this in section G of the AQ (Other Infromation) I spoke to a lady at customer help for the small claims online, and she seemed to think that should be the case, but she did also say they don't really deal with the AQ's in her department, so I don't want to take advise from someone that is not 100% sure? I'll send a letter to the court anyway, but I don't know how to word it, has anyone else ever had this where the banks pays a good will into your bank accounts even though you said no I want the full amount?
  11. Cheers, oh and by the way, thanks for the link to the AQ form help. I was lost without that! Right, I'll read through this over the weekend, and crossed fingers I won't have the chance to use it, and Abbey will fold.....but you never know, I have to be ready to support my case. I'll keep the post updated on what happens.

So If I end up having to go into court....What details do I need to take with me, is there something I can read or take witrh me to support my reasons and claim, something that makes me sound like a threat and that I know what I'm talking about? Can anyone guide me with a link.....sorry, is that lazy?

  15. Hi All, Thanks again for the support, this is really helpping me to get it together and sort it out. I don't know why but I keep thinking that I going to be the 1st person to fail at getting their money back. I feel I have bitten off more than I can chew, but I know its worth it, and the reason I haven't just given up is because deep down I know my claim is right. Thank you Tamadus for the advise on the AQ, I'l look at the litigation library this morning, and get it filled out. I'll be in contact if I can't find the details.
