  1. Hi The Mould, Ell-enn, Ford, Thanks all for your input. I've sent my complaint to the Financial Ombudsman Service regards Bank of Ireland's interest rate rise, perhaps they can make the Bank behave themselves in which case there would be no arrears. Maybe pig's will fly eh? I've also complained about the £25.00 charge for letters they have applied to the debt and a field counsellors visit which we (joint-mortgage with my wife) knew nothing of at the time (seems the letter was either held up in the post or just held up). Finally I've complained because they were told in in 2013 I was ill and needed time to motivate myself - I didn't expect it to take 6 months but that depression for you. They were also asked not to telephone the house, but they did. In fairness it seems unreasonable not to have wrote to them to seek an arrangement to clear this arrears, but anyone suffering depression will agree that life doesn't seem a priority when miserable and debt's don't matter because one might not be here tomorrow. I'm glad medication has sorted me out and I can see straight again. I'm writing to the Bank tomorrow to offer an undertaking to maintain payments (unless the FOS can make pig's fly) and a small sum off the arrears. We, as a family, have had to further cut back and make sacrifices to achieve this - believe me money is really tight on benefits so finding £2040.00 extra a year to pay the Bank has left a nasty taste in the mouth. The Mould - I'll read the Court Order but I suspect Ell-enn is right, I'll let you know. Ell-enn - I'll contact Shelter, thanks for the advice. Ford - I'm eternally grateful to you, thanks for the link. Sorry if I've gone on a bit, the day started off quite grey (mood-wise) but is on the up and up. Best wishes Brian

  4. Hi Ford, Thank you for taking the time to respond, I appreciate it. They have sent a letter referring to the suspended possession order and given us 7 days to pay the arrears of £1,400.00 and thereafter maintain payments. They say they will go to court for possession if we do not comply. I haven't got £10.00 let alone the amount they are demanding. As the order is already suspended I didn't think a further application was required, and I haven't seen any third party (CAB, Shelter, etc) because of social anxiety disorder. It's been a long day already, a warning sign for me that I'm worrying too much! Thanks again for your help Ford. Regards Brian
  5. Hi Ford, It was a suspended possession order. The terms were to clear the arrears and maintain payments. The arrears were cleared (they were caused because I was off work ill, and there was not enough money coming in to meet the full amount they asked for). The current situation has been caused because benefits have been cut, and they are demanding an additional £170.00 a month. Arrears have built up so we are looking at re-possession again. If I wasn't suffering from depression/anxiety I'd be back in work - and probably paying them under protest. Best wishes Brian
  6. Thank you Andy, I've used the time to look over the site to see if I can find anything relevant, however I'm more confused than informed. I've invested a lot of time in preparing a complaint to the Ombudsman and intend to send it on Tuesday so if anyone can suggest an efficient alternative please let me know as soon as possible.   7. Hi all, I'd appreciate any advice on my immediate problem please. I have a mortgage with Bristol & West/Bank of Ireland. In 2007 I took ill and fell into mortgage arrears, Bristol and West got a Possession Order so I borrowed money to clear the arrears. Due to the unfair interest rate rise imposed by Bristol & West/Bank of Ireland plus personally being unable to function properly due to depression, arrears have accumulated so the Bank is not threatening to use the existing possession order to go for eviction. I have complained to Bristol & West/Bank of Ireland, in March 2014, about the interest rise, plus the charges they keep adding which is making matters worse. Their response to my complaint was unhelpful so I am writing to the Financial Ombudsman to complain - I believe I have six months to complain to the Ombudsman which is fortunate as I cannot predict when depressive episodes may strike nor how long they will last. I do know I cannot afford to pay them £1500.00 in the next seven days, nor do I have anywhere to move my family (wife and 3 children under 16). Does anyone have any advice or could point me to information that might help please? Thanks in advance Brian
