  2. Ok thanks for the advice. Hubby reckons I should right it off and put it down to experience. Afterall, two Halifax claims won in one week isn't bad. Thanks for all your advice Sea-side - Donation on way when monies reach account. In process of doing a claim for my brother as well and he sent his prelim off last tuesday and received a letter today saying that his complaint has been denied (the usually Bog off letter) I go the same letter but 3 weeks into court claim, not after a week. Should he issue proceedings now or go on to issue the LBA? Advice greatly appreciated.

  4. Think I may have screwed up!!!! Phoned the Halifax to find out why they had not included 8% interest in the settlement of my claim. They said that although I had included the interest calculations in my particulars of claim, In the total box at bottom I had only put the charges amount. So that is all my claim is for and that is what they have paid plus costs. Is there anything I can do or should I just right it off to experience. Can anyone advise please.
  5. Just phoned the Halifax and apparently, although I put in my particulars of claim box the interest amount and interest charged at daily rate. In the total box at bottom they are saying I only put total for charges, so that is what they have paid plus costs of £80. Not quite sure what to do now.
  6. Thanks sea-side Mack and Chopski's threads seem very similar to mine. I have drafted a letter to Halifax could you let me know if you think its OK to send. Response to settlement offer. Dear Mr Dean Thank you for your letter dated 25/05/07. I respectfully accept your offer of £XXXXXX as partial settlement of my claim. My claim is for £XXXXXX as outlined in my Particulars of Claim, plus court costs of £80.00, and this claim will continue until payment is made in full. I wish to stress that I do not accept your offer as settlement and the money transferred to my account should not be viewed as my acceptance. Should you wish to settle my claim in full, then please forward the balance of the claim (£XXX) without further conditions and I will inform the court that the claim is settled. I trust this clarifies my position. or Dear Mr Dean Thank you for your letter dated 25/05/2007. I respectfully decline your offer of £XXXXXXX. I commenced legal action against you for the full amount £XXX plus interest of £XXX and costs on 01/05/07 (served 08/05/07). I wish to stress that I do not accept your offer as Full and Final settlement and as partial settlement only, and the money transferred to my account should not be viewed as my acceptance. Should you wish to settle my claim in full, then please forward the balance of the claim (£XXX) without further conditions and I will inform the court that the claim is settled.   7. Hi Mack, really sorry to hear about your mum, hope she makes a good recovery. I have had a letter (sounds like the same as yours) offering reimbursement of charges and costs but no interest. Did you ring them? Not quite sure how to word the letter yet though.
  8. Thanks for the advice Jowalshy Has anyone had any responses to the above letters, whats the usual outcome. If they remove the money from my account, are they likely to go to court or do they usually simply pay the interest in after receiving the letters above.. Not sure I want to take the risk of losing the settlement already offered. Can anyone help please
  9. Sorry sea-side, feel really thick!! Can't find the letters you refer to. Only the Particulars of claim and spreadsheet. I have already sent these. Should I send them a partial offer letter saying I want the interest - do you think I will get this? Or is there another letter I should send - or should I ring them?
  10. Hello everyone, Well I WON!!!!! Wen away for the weekend and got back to 2 letters from the Halifax, one saying PEE off, complaint denied. The other saying that not viable for them to defend and would refund charges and the court cost of £80. They have not refunded the interest £300.81. What should I do, they have already put the money (except interest) into my account. Can anyone advise please. Thanks

  12. Hi Mack, just a quick update. I haven't heard anything from my current account yet but Halifax settled before I filed at court today for full settlement on my Visa card. One down one to go.

  16. Hi Everyone, I WON!!!!! Can't believe it. Was supposed to file court proceedings last Monday 14th May but couldn't (didn't have the money) so tried to do it yesterday and computer was playing up. This morning I received a letter from them offering full refund of charges as a good will gesture. I didn;t think they would buckle before filing at court. I have another claim against them for my Halifax Current account, deemed served on the 8th May, acknowledged on the 14th. Not heard a dickie bird.

  19. Hi Mack, No reply yet for me either, Keeping checkng my account as well, we live in hope. Keep you updated on any developments. I have also got a claim to file against Halifax Visa. Going to file in the next few days.
  20. Hi Mog, File your claim, I filed mine on the 1st May, deemed served 8th May, acknowledged 14th May. It's a waiting game but but get their eventually!
  21. Thanks Seaside, Glad to see u won your nephew's claim. Haven't heard anything yet from them - had a letter sent to me recorded delivery today but wasn't in to get it. I wonder if it's anything to do with my claim? Lets hope so, will go and get it tommorow, can;t think what else it can be!!
