  1. I put a claim through court for my credit card charges just as the courts were staying bank account claims. My claim was stayed, when I wrote to the court they stated that as my claim says bank account instead of credit card account they wouldn't remove the stay. (this was on the breif details of claim part) I've left it for a few months as I thought there would be nothing I could do but now I could really do with the money they owe me. Is there anything I can do to get these charges back?
  2. Hello Finally today I recieved my statements for my two loan accounts with Lloyds which have ppi on them. I sent my first letter in March this year! I had to continually hassle the ombudsman. Lloyds cashed my £10 cheque in April and kept insisting they'd sent the statements even though they didn't even bother to correspond with me only the ombudsman. Now i've got them I'm not sure where I go from here. Do I need copies of my agreements? I've read though lots of posts but can't seem to find the answer. Also what sort of letter do I send first?   3. Hello all I emailed [email protected] on behalf of myself and my husband and straight away she emailed back to arrange a time to call us. She said the stays were incorrect and she is willing to pay out both of the claims. Thats another £1000.00 on its way to us! We only claimed the 8% interest but we're very happy. Another donation on its way soon!
  4. Me again, The questions in the leaflet amaze me further considering I have no overdraft with Barclays and had no bank account with them only a Barclaycard credit card. The first question is: What is happening? which tells me about the test case. Then: What will happen to customer complaints about unauthorised overdraft charges? well thanks for letting me know about unauthorised overdraft charges, not that it actually has any bearing on my case. Thirdly: Why are the banks allowed to stop dealing with unauthorised overdraft charge compalints during the test case? And on and on.... Hello Barclays, I had a credit card with you, do you not understand that this letter and leaflet has nothing to do with my case? I'll be copying this letter and leaflet to send with my letter of complaint to everyone to let them know just what a bunch of no brain people this company is full of.

I've had a letter off Barclays regarding my court case titled: Unauthorised Overdraft Charges ("bank charges") The next line reads: You have referred your complaint about bank charges for determination in Court. I had a Barclaycard which is a credit card and does not have a facility for an overdraft. Barclays are applying for a stay on my claim due to the test case. They have enclosed a leaflet titled: Unauthorised Overdraft Charges Court Action It is a question and answer sheet about Unauthorised overdraft charges. When I first looked at the letter I thought 'oh well I'll have to wait' as I'm sure some other people will do. BUT, hold on a minute, how can they justify sending out letters and leaflets like this which have no bearing on the credit card issues whatsoever? We need to write to the OFT, FSA, FOS and Barclaycard and also the courts to let everyone know what they are trying to do and that is intimidate people into thinking there is nothing to do but wait for the outcome of the test case. Hello all, An update of whats happened so far: I wrote to Airtours on 2nd June requesting a resolution or at least a reply within 14 days, the reply I got was the standard letter saying they'll get back to me but it can take up to 28 days this was on 13th June. Well of course I received no other letters off them so after giving them a little more time I wrote to them on 27th July demanding a reply stating the timescale they had given themselves and the fact they had failed to stick to it. I sent the letter on 27th July and I'm still waiting! Has anyone got any good news about what the outcome of this will be? Cheers DF
  9. Alliance and Leicester tried to do this to me so I wrote to them asking why and would they consider leaving it open as I felt the closure was in retaliation to my claim. I told them I would write to the Banking Standards Board, The FSA and The Financial Ombudsmen. They replied stating 'in light of your comments we are willing, on this occaision, to allow your account to remain open and we accept your desire to keep the account open as acceptance of the account terms and conditions. With this in mind, I can confirm that any future charges raised will correctly stand.' Needless to say I no longer use the account. (My charges were £35.00 a time.) My advice would be to use your parachute account instead. I do!
  10. No luck for me on this one. They are saying I didn't use my account after 1998 so they do not have to keep statements. I know the account actually closed in March 2003 when I paid it off but still they say there are none of my statementsavailable.
  11. Solicitor recieved my letter accepting the settlement on Monday. Money in the bank on Tuesday. How's that for efficient?
  12. Hi Consumer version used on these two claims. That is what I thought would get my Business claim struck out, I used consumer UCTTR and UCTA also the claim was overstated! I informed Lloyds I'd entered an N244 and sent an updated spreadsheet with a letter asking them to wait for amendement to come back so I can reserve it! They didn't bother to wait and decided to pay out. Claim paperwork posted for personal accounts yesterday special delivery so here's to a short wait. A bit of good news today: MBNA - won without court action. Cheque is only £36.00 less than what I asked for.:o Whoopie!!
  13. After winning on my business account with Lloyds after not much hassle compared with some people I'm sending my claims to court for Lloyds personal and joint (both closed accounts). I've had one letter from Lloyds after I sent my prelim and this was the standard fob off letter. I've since been ignored. It took just under 2 months after I filed in court for me to win on my business account so we'll see how quick they pay up this time! DF
