  1. Charlieboy Happy and mistie are quite right to advise you to reject this dishonest and inadequate offer. The OFT never said that the £12 level was fair. They merely set £12 as an absolute ceiling that they could charge, largely because the banks still refuse to admit how little it actually costs them for their 'charges'. They are only entitled to recover their costs, and £12 still has a large profit element included. They are using the OFT ruling as a justification for further unlawful charges, which are neither 'fair', nor 'correct and valid'. By doing this they are trying to legitimise the retention of much of your money that they have taken unlawfully, and you are owed this back with interest. Please can you confirm the contact address you use, because there's been some confusion in the threads about ownership of this shower. They are now part of Morgan Stanley, but one thread says to contact Lloyds about this. The only reason I haven't yet SARd these people is because of confusion over addresses and no coordination of the Goldfish claims. I hope these postings help you to recover what ir rightfully yours. The big interest comes with the 8%, and you don't include this in the letters - only with filing at court. You talk about removing a default. Don't include this unless you have a default that was for less on the day of the default than the total unlawful charges added before that date. Varangian

  9. Anthony You must study the FAQs carefully as everything is explained there. This section deals specifically with interest http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/25457-guide-reclaiming-bank-charges.html?garpg=4 Basically, if you put all the details into the advanced spreadsheet then all the interest (overdarft and the 8%) is automatically calculated for you. With the letters you request the overdraft interest as well as the unlawful charges. The 8% interest doesn't get added on in the initial request letters as they may offer to settle before court stage. However, if you file at court then the court will allow you to add the 8%, calculated by the spreadsheet on a daily basis since they took each item of your money. Varangian Guard

  15. Hello huskey Nationwide were one of the worst for closing accounts until about a month ago. Previously it was automatic, but since then they just write a snotty letter saying they won't close the account as long as you are a good boy/girl and agree to abide by the trerms and conditions next time. The closing of accounts in these circumstances has lead to a flood of complaints to the Ombusman who has stated that this should not be done for 'punitive reasons' (ie out of spite). In the case of A&L, I believe that some complainers were awarded compensation of about 200 quid for this too The picture seems to be that they won't now risk closing just for this reason, but of course if you have other issues with them (like excessively over OD) then they could argue that the closure was not punitive. That said, you MUST have a parachute account just in case. From what I gather people are finding that basic accounts are easy to get, with proof of residence and a few recent statements. Accounts like NatWest STEP are basic - no cheque book and no OD, but at least you get a solo card and you can arrange debits etc. If you can't get another account for some legal reason about the bankruptcy then I suggest that you PM one of the Mods rather than make a general posting. Jon I agree with trojan - just update this. from my reading of the threads, you can keep adding further charges up until you file with the court, which is the one that really matters Make sure that on the date of filing, you include EVERY PENNY that you can;) , but don't change it after that for the same claim. Check this to be sure before you file, but then you should always get the court claim checked by a Moderator anyway, to avoid mistakes. Good luck Varangian Guard take no prisoners

  18. Hello Jack To get any help you need to provide full details of what has been done so far. You also need to start a thread in the Yorkshire Bank forum, as this is the welcome one. There you will make contact with all the people also chasing YB and can read all about how the cases with them are going or have gone. It doesn't sound as if you are aware of the process to follow, so you do need to study carefully our details on the processes, as explained in the FAQs, accessible from the forum homepage. You should have waited to claim till you knew exactly what you were owed, or you will just loose money. How did you present the calculations? What letters have you sent and how did you present them? What timescale have you followed? What did your claim include and what did you base it on? Try presenting some of this info to the Yorkshire Bank forum and people can then see what your position is.   19. duke I use the complex spreadsheet and its easy when you've put the details in. As well as the cumulative penalties, the middle worksheet (charges and interest) has another yellow column for Interest on Penalties. This only registers where the OD level is sufficient. Basically, you put that figure in as the Interest on Penalties (OD Interst). Its not a lot and some people don't think its worth bothering with - up to you. The main interest is the 8% that you don't mention till the court stage. That shows on the third worksheet called 8% interest. Varangian Guard
  20. Mr E I SARd for current and business accounts.about 30 days ago. I received the current account statements in 3 envelopes at different times. They did make a complete set, with some bits duplicated. Still nothing for the other account, and no other enclosure. It all seems to be a bit of a dog's dinner but at least I have enough now to send a prelim letter for one account:) You didn't say when you sent the SAR, only that there were 10 days between arrivals. Give it the 40 days as stuff seems to keep dribbling in, then contact them if not. Varangian Guard
