  1. this dont sund good for the OP, what he should have done is place the plate on retention when he first had the accident ( obviously telling the insurance that he intends to do so, i dont know of any insurance companies that will refuse), that way he could have kept that plate within the terms of cherished transfer, but leaving the length of time he has dont look good for him, DVLA are quite correct in what they say so its now impossible for him to get that plate transfered under there terms, sounds like a £6k plate lost to me, i have private plate myself and i wouldnt have chanced leaving it on a scrap vehicle, its simply not worth it unless you want to get into problems, you should have known the DVLA rules from when you first had your plate aswell , sorry its a bit blunt and i can see that you would be miffed about the whole thing but not much you can do about this one

  3. im in the trade and this thing cant go anywhere as far as i can see, the car went into dealer hands, he drove it and knew it was faulty, its upto him to decide to what extent that fault maybe so he can offer a deal accordingly but if his own conclusions of repairs costs are wrong then thats his problem, he offered a deal and the customer accepted that deal, if it was me i would send him a letter explaining this also mentioning any legal action will be met with a fight and in the event the dealer lost a court battle ( which he would) then you would claim all your legal costs back from him, im sure he will find that he has to give in and go away unless he does want to risk paying for your court costs
  4. sounds to me as though you dont have courtasy car cover on policy (even if you dont approved insurance repairers will normally provide one) if you pay specifically for the benefit then the car is normally provided by a hire company and your insurance would have told you when you called , there not under obligation to tell you though as you cant expect them to know what your needs are so its down to you to make requests based on your needs, to be honest i cant see that you have the extra courtasy car cover so think you may well find that you are responsible, also when you did hire did you tell them it was to be covered by your insurance???, if you did then i think they will have advised you that you will be responsible if your insurance dont pay up so again it seams like you might be on a loser here
  5. in the event of an isurance claim to repair or replace the glass you will find that you are responsible for any charges under the terms ofyour hire agreemant unless otherwise stated so take a look at what that agreement says, its as simple as that really, you paid and hired under those terms, a stome flying up is accidental just like if you hit another car is accidental, you dont intend it to happen but sometimes it does but whether you pay is in those terms of hire and they can enforce that agreement upon you if they wish to do so, also worth noting somtieme a chip is not worth repair even when it only seams minor ( somtime repair will still show or may not last out long term) so in that case the repairer will advise accordingly so if he advises new screen to be fitted then its likely they will take that advise and have a new one, you may not be able to ask for old screen as you dont own it in the first place and its likely the repairer will take away for disposal anyway, you will aslo find they are correct about not giving you the invoice ( although i cant see any harm in showing it to you at least) they just cant hand it to you to keep for yourself, so your best bet here is to ask them to call you when they have recieved the full written invoice and go down there and ask to see it and at least that way you know your paying only what you have to ( quick note here thoguh if cost is more than there insurance excess for windscreen cover then only pay that excess) as thats the only thing under terms of hire that you will be responsible for
  6. ed is correct here, clutch changed on advery and in your book, fith gear jumping out is a gearbox fault and has nothing to do with clutch, dont assume because you use a clutch to change gear automatically means the two are the same thing becasue there not and even if clutch was incorrectly fitted it would not cause that problem, also synchro stop gears crunching between shifts so again its not a synchro problem ( although the synchro is part of the gearbox), you really are wasting your time here, sorry
  7. you may well be correct but that would be something the seller had done and therefore would be his problem with the garage that fitted/not fitted it, and the car is no longer owned by that person so the current owner has no comeback on the garage in question, as i said before the currect seller has no contractual agreement with that garage as they didnt pay for that work/invioce it would be like me complaining to the gas board about your gas bill?? obviously they would tell me to go away but again i also say where is evedence to prove it never had the clutch anyway unless the gearbox was taken out to find out if it looks old or new? incidently in the past we have had people have new clutches fitted at a rate of 1 per month when we discover they have bad habit of riding the clutch and burning it out so is that our fault in these circumstances? i think not even though some would disagree, one old lady had 3 clutches in her car ( 2 of which we footed the bill for) on the 3rd occasion we went to collect her from her home to pay her bill and she drove her car back and with our lad as passenger and it was then that we discovered how bad her driving was as she was constantly riding the clutch and couldnt even hear how bad she was making the engine scream due to have bad hearing aswell, we explained to her politely as we dont like to tell people there getting old and not as good as they once was, she said she hadnt had the car long and was surprised at us thinking it her driving and off she went, 3 weeks later the car comes back, this time with her son who is not happy at all, we explained everthing to him and he didnt believe us so we said we will fit another one on the basis that we pay if we are wrong and they pay if we are right but he must come to the garage when we say the car is ready and he did so, we then asked him to go passenger with his dear old lady for a test drive , 10 mins later he came back and appoligised for everthing and paid up and we then sugested he sells that car and helps her get an automatic
  8. just a quick point going back to the porsche thing ! i work for an independant and we do plenty of work for dealerships including diagnosis and this is because some dealerships either arnt knowledgable in certain areas or lack good tech staff for diagnosis, this is not the case with all dealers of course but are some out there that regularly farm out work to independant so in theory sometimes you pay the dealer price but really the car is sorted by a cheaper more knowledgable garage so always consider that and as i said before a good reputation and good service is worth far more than any branded stamp on an invoice or service book
  9. im sure they will fix for you but also when they had car in workshop it was put down as no fault found and would be because no fault present at that time so there not technically in the wrong, also yopu mention great service for brand???? it doesent work like that, it comes down to the garage and what there like and not the brand of car, i could get far better service on my focus at the local jo bloggs workshop than i could down at the porsche dealers !!! you see hat im saying here???, good trusted garages and not just because its a merc,jag, porsche or whatever, i sometimes do wonder why people think they should get better service based on a brand though, maybe you can answer that??,
  10. im not sure what the arguement here, the owner should inform his insurance who will then contact kik fits insurance and an offer will be made based on it market value as long as the mods were also insured unless he is successfull at claiming uninsured losses ( maybe hard with that one though if the mods were not insured as this means they shouldnt have been there) you really cant go telling kwick fit that you want this much or that much because you will achaive nothing, just inform your own insurance
  11. how can your garage confirm clutch was not replaced? thats impossible unless they remove the gearbox and i cant see that happening when they would have to remove gearbox first !! also filters etc arnt something you can complain against as the condition depends on mileage and environment covered since being changed, but more importantly here is that you have in my opion no way of going anywhere whith this claim as everthing is circumstanstial and any previous work or servicing is a contract between the garage and the person paying at that time and not transferable to subsequent owners/drivers, i really cant see you getting anywhere with previous owner either as the contract is still between him and his garage and i cant see him taking up issue with that garage about a car he no longer owns !! ( would you do that?) sometimes we live and learn with these things but frankly i cant see the point in chasing after money after the fact when it could be argued that you had opertunity to look over the car and have it checked correctly prior to the sale, your arguement is you thought all was good and welll maintained but previous owners argument is the same thing as yours so where does any claim come into play here?? i think its a loser
  12. yes the other car was horizontal to me meaning i had frontal damage and he had side damage ( it was a straght forward T bone scenario) , i am fully comp insured and when i went over the brow of the hill i was present with about 40ft till impact so by the time i could see him it was already too late, he had an old car worth probly aprox £200 thats all and damge would have written it off but he dint want to lose his no claims for the sake of a £200 car and thats why he has never informed them, my insurance actually agreed under the circumstances i could not have avoid this accident and he should not have been manouvering in such a dangerous place but they still never persued him and my argument is why should i lose my no claims for something so obviously not me at fault, it seamed like my insurance took easy option and paid low figure for my repairs so paperwork is minimised
  13. traffer i think you might be reading this wrong, i know these engines well and they suffer as in my above post, also i dont think they mean the cam lobes i think they mean the fingers that the lobes push down onto but like i said i know these engines well and have seen many fail in this manner including completly destroyed camshafts and on a couple of occassions destroying the cylinder head where the camshaft sits meaning replacemnet cylinder head and all assocaited parts being the only fix possible !!!, if in doubt ask vauxhal tech and they will confirm what can happen to the engines
  14. if you drove the car for a few moths without problems then its most likely that the original work carried out was ok , if there was a problem with there fitting of the timing chain that would have probly shown up quite quickly as that area with without dobt rear its ugly head if things arnt right in there, you have the 1 lt ecotec engine and this engine is prone to having the camshaft carriers come loose ( they have a very low torque setting on them ) and thats not much more than being finger tight so its not uncommon for these to work loose and i would advise anyone with these engines to have them inspected on a regualar basis, so lets get back to your problem !! if the dredded cam carriers come loose this can thaen lead to the camshaft running out within its housing ( not being held tightly and vibratting and witht he extra play present due to the carriers being loose), this in turn can lead to failure of the "fingers" ( slippers as some call them) sometimes jumping out from under the camshaft or sometimes breaking i two as sugested by your garage, i have even seen them break the camshafts in two aswell from this problem on several occassions, so unfotunately for you on this occassion and in my mprofessional opinion i am incline to agree with tha garage that says its not down to the origianl work being done and is now a seperate problem, also worth noting sometimes this problem can sometimes show itself as being a noisey / tapping engine just before the problem occurs, sorry to bring bad news but this is what it sounds like to me and i have been a mechanic for 25 yrs
  15. another victim of the boys in blue fitter gang by the sound of it !!, they also have a tendency to spray shockers with WD40 and then ask the customer to go and take a look saying that the shockers are leaking !, big business for them up in high places there that lay down financial targets for monthly takings on each branch and of course who gets to pay for all the financial targets??? the consumer of course who else, im sure they should be sending out xmas cards to customers by now to all there loyal customers who give up there spare time and money to be hanging round these places having unessary work done !
  16. i really do hoe that AA rep relpies back with more than just a call this number and actually explains all this and gives my money back in full emediately but somehow i think i got more chance of getting the lotto and buying my own breakdown company !
  17. wheres the AA guy gone from this thread ?? or is it like there desks and too full of complaints that they cant cope, i know quite a bit about them and i also fell victim to them taking money from my account without authorisation from me after they held my card details from 8 months previous without my knowledge or asking if they can do so !!!, infact it was yesterday that i was on the phone complaining about it and i demanded they refund my account back to that same debit card emediately and low and behold the suddenly dont have my card details anymore ( so called got deleted off system) strange that after they held em for 8 months and took payment day before then there suddenly gone when i ask for refund???, they tell me they will send cheque instead to which i refuse to accept , why sould i wait for payment when they took unauthorised transaction from my card?? i wasnt having this and again demanding my money straight away saying i will give them card details there and then for the refund and then magically my card deatils reappeared infront of the girls screen at that time !!! its amazing how these computers can come up with working credit/debit cards as and when they want to?? so she then says she has conducted a full refund on my card ( £157) but then says it can take upto 21 days to proccess??? ok im not having this and tell her so, she says its company policy so i explain i am not subject to there company policy or terms and conditions as they took unauthorised funding from me completely without consent and therefore i have not contractual agreement with them to follow there policy and refund should be emediate back onto my card ( which is possible anyway) she still maintians thats out of her hands and will raise a formal complaint on my behalf but she still has to say it can be upto 21 days??? well we will see what happens here but i do know that if a cheque arrives then heads will roll as far as i am concerned and i will do my best to raise this into the spotlight that the AA make a habit of taking unauthorised transcations from accounts and hold peoples card details without consent, oh while im off on one here what about my £75 invoice that i had to pay to a garage back in november to come out to me for a puncture i got and tha AA said i should call a garage and they will refund any costs involved?? so first you join the AA then you pay yourself after having to find someone willing to come out yourself with no help from AA at all other than them telling you they are too busy so find your own parage to deal with it !!! so now it JUNE and i still dont have my money back from that breakdown, welll all i ca say is A utomobile A ssociation errmm no , not quite i think its A utomatic A ssoles , sorry but it had to be said
  18. original post dont really explain the full story here !!! you say exhaust was hanging off??? in what way because MOT rules state the exhaust must be secure at its mounting points but that also means it could be a peice of string holding it as long as it is secure and obviously such a way to hold it would be considered botched and not acceptable to most, so you have to consider what the MOT tester had to atcually test and the merits and rules of that test! as for the shocker absorber MOT rules states they can fial for having negligable damping effect ( this could mean so soft or to stiff) alternatively they can fail for having a serious fluid leak ! if the leak is only minor then it should be an advisory item under the terms ( slight misting of oil) , however there is no rule book for determining where you draw the line between slight misting of oil or serious fluid leak and in most cases these cant be seen anyway unless car is jacked up so the weight is off the shockers, but because there is no rule on where to draw the line it becomes the opinion of the examiner as to whether he considers it a pass or fail and he is allowed to go by his opinion as long as he follows the guidelines of the MOT testers manual, if he found an item and couldnt actually make up his mind whether to pass or fail then benifit is given to the presenter ( in others if he is in two minds then he should pass and advise on problem), just in case you wondering if you havent realised by now i am a Class IV MOT Tester and i hoe all this helps, but your original post doent give enough detail as to the full details of fail or advisories issued, if you still belive you have a case against the tester in question then you can find all relevent details on what to do on the reverse of your V20 ( green MOT pass cert )
  19. they should have called you and if they didnt then you have a right to refuse EXTRA work , but going back to your OP you say they gave you a "quote" is this correct??? was it a "quote" or was it an estimate??, if it was a quote then that price stands if they did not contact you but if it was an estimate then by the very name it is just estimated and can change although even then they should contact you first to authorise extra work or if the origianl estmate differs substanstially
  20. springs can break ar anytime with cars , whether they are driven or stationary and going by what you say about the damage in the accident it doesnt really sound like it would have been from that or else there would have been some reasonbly extensive damge to the susupention which you would have known about, also when the car was checked over for the insurance estimate it would have been included in that estimate and replaced accordingly, to be fair to the garage this sounds to me as though the spring has simply fractured after completion of the repair ( perhaps even when driven outside the workshop) , its possible that they may have jacked up the car for the repairs to be done which is then disturbing the sring somewhat compared to how it would have been since it was fitted originally, sometime even that can be enough to then fracture once the weight is then placed back on the vehicle if the spring is already in a weak state to start with, i dont think this is one to place blame on garage , its just a weak spring that has finally given up just as they all do eventually, you never know though they might give you a good price for repair if you ask them considering they had the other job from you !
