  1. Well. reallu really nervous now We're in Court this Friday. Have heard absolutely nothing from Lloyds ...... deadly silence. So maybe O/H is the guinea pig. Gawd, I hope not. Surely Lloyds wouldn't leave it this late to settle if they weren't intending to go all the way. Please give me some hope people ....

  3. Thanks for the reply. After the 14 days how do I take them to court ? What I mean is I've already done a moneyclaim against Lloyds so I understand that process. Do I do a moneyclaim but specifying no amounts etc - just failure to provide info ? Thanks
  4. I can't get info re charges from Egg. Brief summary : '24/04/04 Sarn request plus £10 '13/05/06 Acknowledgement but asked for I.D. proof '18/05/06 I.D. sent '09/06/06 Acknowledged and originals returned. Confirmed they would send the info within 40 days. Nothing received. 14/08/06 Complaint to the ICO. I thought this would force Egg to comply. ICO response today. They will instruct Egg to send the info within 14 days. they will inform Egg they are in breach of the Act and request an explanation. BUT the case and file is now closed ie it was an open and shut case of non-compliance. BUT what happens if I still don't get the info from Egg ? The ICO have now done what they can ie tell Egg to comply. What happens if they don't ? What do I do then ? Thank You

  6. jamieadi I'm in the same boat. AQ return date 05/07/06 - since then nothing. I got O/H to ring Court a couple of weeks ago. Response, a court date would be allocated that week and we'd receive notice in a couple of weeks. Nothing yet. I think they are just deluged. I didn't think it would take this long either :o
  7. thanks mjanet I used the template letter and so, agreed, didn't ask for statements. To be honest I just don't believe there were no charges in that almost two year period. This Lloyds account was closed last year so no internet access. Not really sure what to do about it ?
  8. Got a couple of questions, if anyone has got any thoughts ? First : I just had a look at the list of charges starting 02/01/02. Data Protection Act request was dated 31/03/06. Because this is for O/H I didn't have a handle on this account. Lloyds never provided statements - just a list of 'view statement entries' ie charges and 'customer notes'. I used these for the Court Action. Now I've just looked at the 'customer notes' and these go back to 1998, so either there were no charges on the account 31/03/00 - 02/01/02 or I haven't been given all the information and the moneyclaim amount is wrong. Do you think I should get O/H to write to Lloyds asking for statements for this 'missing' period or their confirmation there were no charges during this time ? Second : This seems to be taking forever. Moneyclaim filed 15/05/06. Defence advised 16/06/06. Allocation questionnaire filing date 05/07/06. Since then nothing. I got O/H to ring Court about 2 weeks back to get an update and they told him the judge would be allocating court dates that week and he'd hear in a couple of weeks ! This is the Central London County Court if that makes a difference. Is this length of time normal ?? Thanks

  10. Can anyone point me toward a template letter to send to the Data Commissioners ? Initially wrote to Egg in March, they cashed the £10 but wanted a bank statement. Sent that off and have their letter dated 6th June returning statement, acknowledging £10 and DPA request saying would send the info within 40 days. Nothing rec'd to date. Can't do the LBA because I don't know what the charges come to plus the debt was settled by a short settlement so .... I may not even proceed with this. I can't really do anything till I know what the charges come to. But I need to report them for non compliance with the Info Commissioners to try and put a rocket up their whatsit. Any help ?
  11. An update for all the people kind enough to respond. I saw the specialist last week, he knew his stuff, was very thorough and I trust him. There's a lot wrong, individually not terrible but collectively ,,, it's no wonder I was in pain. Anyway I'm to have an operation to have all the metalwork removed and also cortisone injections. There are other issues, for one a joint under the ankle joint is damaged, but it may be too late for that .. we'll see. First thing. I thought the hospital had done a very good and professional job with the repair. In hindsight it appears it was good enough to deal with the immediate problem ( the break ) but no more than that hence the late complications now. Second thing. This chap said he always takes out the metalwork from patients as it can irritate after a time ( this is what is happening with me ). It's only neccessary for 2 months. I asked why my hadn't been removed, answer was cost. In the NHS the longest waiting list is orthapedics. Third thing - I hope I haven't caused damage to everything by ignoring the pain for a few months. I just thought it would sort itself out - stupid me ! Last thing. I know everyone doesn't have it, but I was SO grateful for having the NU cover via work. Never used it before, used to think it was a waste of money. Not now. Thanks again for everyone who responded.
  12. Help !! Just looked at our claim online ( which has been accepted ) now. It's showing ' Northampton County Court ' ????? I deliberately used the '48 Chiswell Street. London' address for Lloyds as defendents cos we, the plaintiffs live in London, and I knew if we went to Court it would have to be in London for us. Why have they allocated Northampton ? and can we get it changed ? Thanks

    Old Mbna Account

    src We are in the same position as you - an Egg & Mbna c/card both with short settlements. The DPA requests were sent but these two want you to send ID and fill in their form. We'll do that. The plan is .... to get the 'real' debt balance that O/H owed..... allow their interest on that ( extortionate ! ) .... and then see if it's less than or more than the short settlement agreed. If it's less i.e. he paid more than was actually owed ( interest & charges making up the balance ) we'll go after a refund. If his 'real' balance plus interest comes to more than the short settlement ... then we forget it. That's the plan .... just waiting on the info from them.

  15. Well finially got the Moneyclaim submitted. I was stuck for ages within the number of words but too many lines - not realizing what was wrong and why the thing wouldn't submit. Anyway - done now. Quick question. Because I was only able to say total charges £xx between date and date, and total interest £xx, do I need to get O/H to write to Lloyds enclosing the spreadsheet itemising the charges and interest calculation ? Thanks
  16. Lizzie Just saw what you wrote. Well Lloyds can't threaten O/H with anything because he closed his account with them last year ( think they were glad to see the back of him ). And if I don't do this for him - it doesn't get done ! I think his 'financial' gene got missed off at birth, anything to do with money and he just glazes over. Prime fodder for a bank lol.
  17. Sorry Lueeza. You can tell I'm getting a bit stressed by this ! I was on holiday last week but got the second 'get lost' letter during last week. So it's on to filing the moneyclaim claim. Between catching up on work and filling in the moneyclaim particulars, I'm wibbling like crazy
  18. I'm filling in the moneyclaim particulars. Using the library guide notes. After I do the narrative in the particulars, it says lay out your calculation. When I tried saying total is 1.7k ( xxx 03/06/05 xxx 04/07/05 etc ) i.e I gave each charge and date to total the 1.7k I am claiming - I ran out of space. I was also timed out lol. I can't attach a spreadsheet to this claim ? if I can how ? But if I can't how do I spell out the detail of the charges totalling 1.7k without running out of space ?? Many Thanks

  20. So does the 40 days start ticking from the date they received the original DPA request, or from the date they get their filled in form plus ID ? The original DPA request asked for info on a credit card & loan, both account numbers supplied. Plus the £10 fee....... The response only deals with the credit card charges and says ' on this occasion they've waived the fee'. So absolutely nothing so far about the loan. Maybe it's a different department ? More likely they've just 'lost' the loan bit of the request.

    Mbna Question

    We sent off a DPA request & £ 10 for an Mbna credit card and Mbna loan. We have had a response on the credit card but nothing on the loan and they've returned the £10 uncashed. The credit card info is a list of charges for the 6 years but nothing on the interest. This credit card had a balance of about 3.2k on it when O/H got into debt trouble and Mbna agreed a short settlement of 1.2k. The reason we asked about this card was O/H thought the 3.2k balance was mostly made up of charges and interest. The charges listed are 1k. What I suppose I need are statements so I can identify the 'real' balance and then track the charges and interest to see how much of the interest relates to charges. Obviously if his 'real' debt was 1.2k or greater we won't go any further with this ( the short settlement ). A couple of questions : Does anyone have a letter template spelling out we want the complete history? Does the original date of the DPA letter stand ? even though this was geared towards charges ( letter from library ) which they've supplied, plus returning the £10 cheque bit, does this muck it up ? Also they've ignored the loan info. We really need the copy agreement and a full history like the credit card above. I'm again concerned the DPA letter didn't cover what we wanted. Do we start again spelling it out ? Also do we have to send the I.D. they've requested ( if we need further info ) inasmuch as they gave us the charges without it. Just feeling confused about what we do and don't need to do next, what they can demand, and feeling a bit messed about at the moment. Any thoughts appreciated.
  22. Thanks sweet & lizzie LBA being done now. It's strange, it's kind of scary and a bit exciting mixed together. Never done a small claims court thing before either. Seems weird issuing proceedings against a big financial institution ........ but I got a lot of comfort from reading other people's posts. They've gone through this same cycle and as long as you do it properly .... hopefully ( fingers crossed ) we'll get this money back.
  23. Received the standard 'get lost' letter today. Geeze Lloyds are fast ( which is good ). They were very polite i.e. ' Thank you for taking the time to contact us about your account ' Plus we got the mandatory leaflet ' How to voice your concerns?' plus they will help refer the complaint to the FOS if required. What we expected from reading other posts. So letter before Court action goes out tomorrow.
  24. Ok mispatient now I understand. That isn't good. But it explains why they are chasing you for the arrears. Since you as an individual signed a lease for a set period of time, you personally are responsible for the rent for that period, even though the shop ceased to trade. I know you said earlier you can't afford to pay. I don't know what your financial situation is like but probably not good if your business failed. If the debt is vaiid, and it sounds like it is, I think you need to get advice/help asap. Try the CAB as a starter. There's also an excellent debt site that I've listed below. It's a bit like here, you can post a question ( explaining your situation ) and those with better experience of debt matters will explain your options to you. I know they have debt counsellors and Insolvency Practitioners on there who really know their stuff. http://www.debthelpuk.co.uk/forum/ Sorry that it's not sounding great - but get as much info as you can. You can't pay what you haven't got. But if your landlord is going to pursue this, you need get advice re your best way to deal with it. Good Luck
