  1. Has anyone had the cheek to make up some terms and conditions and send them in with the prem letter and schedule of charges? Wouldn't it be great to hit them with a £39 letter charge and a £200 administration fee to submit MCOL!?!
  2. Hiya Heatengine You can get the correct format here http://www.consumeractiongroup.co.uk/forum/bank-templates-library/25716-rejecting-offers.html but you'll need to edit it to suit and just put you'll accept this as part payment etc but you'll be pursueing for the full amount. Matt

  4. Hiya Got myself in a bit of a pickle around september and defaulted on my mobile, anyway they have since got Wesccot DCA involved and they are threatening the usual. Now the big confusion is if i send out the standard letter in the archive requesting a copy of my CCA will this apply? I'm pretty sure they won't have one as the contract was with singlepoint before the buy out so was hoping the debt would then be written off. I read through Dayglo's thread but couldn't get a difinitive answer as vodafone seem to apply the consumer credit act when it suits them then say it doesn't apply again when it suits! Cheers Matt

Well interesting enough is that the letter from the DRA- Wesccot, is threatening doorstep collection and at the bottom it says "All of Wesccot's door step collection agents hold a consumer credit license and are members of the credit services association" So to enforce this don't they need a signed cca?
  6. Hi Dayglo Just spent the last 2 days reading your thread, wow is this the longest recorded thread in history? LOL Anyway.....can i pick your brains on one thing pls? I defaulted on my Vodafone account in Sept 2006, they were very quick indeed to send it over to a DRA and demand letters followed! Now can i request a copy of the CCA and if they fail to provide will it wipe off the debt? I originally had the contract with Singlepoint who sold over to vodafone, i have since had upgrades though. Sorry to bug you but i couldn't actually work out if it is regulated under credit act or not? Cheers Matt
  7. Quick question....... On my Halifax claim i have a DRA chasing me for my default from 2003 and someone told me to send the letter requesting a copy of my CCA which i downloaded from the libary and did. Now if they can't supply it they have to wipe off the debt. My question is....With the Egg scienario i actually paid off that DRA last January. Can i ask them for my CCA and reclaim the money i paid them last year if they can't produce it? Cheers Matt
  8. Thats great thanks! I'll be surprised if it's still around. I opened the account in the early 90's, defaulted in 2003 then it's since been with a couple of DRA's. Do you think they'll still have it?
  9. Just a thought...... I've read on other threads that if you write to the DRA and ask for the original CCA they have only 12 days to provide it. If they fail or have lost in then they wipe off the debt. 1: Is this correct? 2: What does CCA stand for? 3: Do you have to send payment requesting this? Cheers Matt
  10. Just this second had a phone call from the debt recovery company again. I told them that i was in dispute with Halaifax about unlawful bank charges and the guy just replied, "you can only do that a year after they happen" is this their standard line to get you to pay? He also said that i should pay back the debt before the claim goes through. Mind you he changed his approach when i mentioned i had joined the CAG and he said ok i'll call back in a month or so to see how your getting on!
  11. Hiya Marta I found out this fax number which is apparently the fax number for the dept that dishes out SAR. It's 01422 394503. I would send a copy there along with the LBA about non comliance of request to provide information within the legal time scale and give them 7 days to comply. I would also post it as well.   15. Well i still have all the statements for the RBS one so sent the prem letter today, from the threads i have read they seem to buckle dead quick, even after the prem letter so fingers crossed! My prediction is RBS pay out first HBoS next A & L then but will go to the wire Cap 1 after, then Egg last Fancy a bet? LOL

Should i send it now or am i just being too impatient? 21st February 2007 LETTER BEFORE ACTION Dear Sir/Madam, ACCOUNT NUMBER: xxxxxxxxx I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I have requested a Subject access request so that I can fully calculate what you have taken. However from the statements I do have I can see that you have charged me overdraft interest on the sums you have taken as well. I have now written to you four times requesting refund of all charges applied to my account. This will be my last letter before action. I require repayment in full of all charges that have been applied to my account since I have had it and the removal of any default notices from my credit report. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus a claim under ss.7 and 13 of the Data Protection Act 1998 plus my costs and without further notice once the information is received from my subject access request.   20. Quick question for anybody listening! I've seen on some other threads that some people have sent off a prem letter and schedule of charges sheet for the amount they can work out from the statements they do have. They then add more on once they have all the charges when the SAR gets replied to. Would anyone recommend this? The big advantage is that the ball is already moving once the statements finally arrive! Cheers Matt
  21. Right, just typed out my prem letter and did my spread sheet. Total claimed is £304, i missed one failed DD earlier! Anyway down to the post office later so 14 days and ticking!
