  1. No need to print out the whole thing, but you do need the front cover, section 1 "overview" and most importantly, section 4.21 "Disguised penalties". You should put this in INSTEAD of the OFT report summary from the Basic Bundle in the templates library.
  2. Not as I understood it, the Judge said they'd been struck out and that he was giving them 14 days to pay " after which I could send in the bailiffs"
  3. I proposed my directions in the AQ which the court then issued its directions against.....I had to submit my information and evidence by early May, the bank by 22nd May. I sent mine in good and early to the court and the banks solicitors by recorded mail. For some reason their solicitors completely failed to respond to either me or the bank. I turned up for my preliminary hearing yesterday where there was nothing from the bank. Consequently their defence was struck out and I won. Very pleasant if a little sinister. Anyone else had similar experiences
  4. I have my Preliminary hearing on Monday for which I had to put forward my case - which I did - by 08/05. The bank had to respond by 22/06 but has not responded in any way. Can I request on Monday that the judge strikes them out for not responding?
  5. Looking at the advice you've given me it seems I've sent everything except my statement of evidence.....how do I go about correcting this at this stage. My pre-trial hearing is next week.
  6. I have a five minute hearing with the judge next week prior to the main court hearing. I have presented the documentation listed in AQ but I need a set of Terms and Conditions to present.....can anyone help me?
  7. This is really un-nerving...I sent off all the documents I understood were needed but it seems that this may not have been enough. As this is a five minute preliminary hearing prior to the main court case later on....should I submitt these extra docs now or ask if they are required when I attend the hearing??????

  9. I have submitted the information requested by the judge for my hearing which was inline with the proposed directions posted here. As the case in Birmingham was lost due to not including a copy of the banks Terms and Conditions, should I submit these now and if so how do I go about it?

  11. I sent off my questionnaire which included the proposed draft schedule. The Judge has now ordered me to provide the following to be submitted to him and the defenant prior to a 10 minute hearing in June a] A schedule setting out each charge repayment of which is sought, showing the date, amount, and reason given (if any) for that charge being made b] Copies of any statement or other document relied upon as showing that each and every charge has been made c] A statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise d] Copies of decided cases and other legal materials to be relied upon Can anyone tell me exactly what to send?
  12. Thanks for your help Barty. I've just contacted the court who tell me a preliminary 10minute hearing has been set for eary June for wihich I must forward all the information listed in the proposed schedule (yikes)
  13. Hi....I'm at the stage where I've returned my questionnaire to the court and am waiting for a date....is there anything I should be doing now. In my questionnaire under the part about any further information, I included the document re the propsed schedule of events which said I would submit documents within 14 days... what are these and when do I send them - now or when I get my court date?
