  1. hi Rob, thanks for the reply.im the registered keeper of the vehicle, i think i received the nip within 14 days. I DID NOT RESPOND TO THE POLICE THAT SENT THE NIP AND I HAVE RECEIVED SUMMONS. IM NOT SURE WEATHER I WAS DRIVING THE CAR OR MY COUSIN WAS DRIVING THE CAR. IM NOW ON THE SUMMONS STAGE

As i said earlier its purposes is not for avoidance of debt but to help people to benefit from settlements. In this case I foresee the bank making a counter claim and winning it
  6. I Raised The Issue With The Cra And For The 1st Time They Took It Serious. They Took It With 1st Credit And Amended My File. Previously They Would Refer To 1st Credit And They Would Be Told To Ask Me To Contact 1st Credit. They Seem To Have Sensed Danger And They Are Co-operating. I Will Take 1st Credit To The Cleaners
  7. Will double check this again with my brother who specialises in consumer law. will update on Monday. What is clear is that this right does not prevent us from paying debts. We are obliged to pay debts, but not on settlement payout. Hope it sounds a bit clearer
  8. Sorry I should have empasized that that you are merely entitled to request this right of appriation. if you do not request it, then you do not get it and the banks will not have broken any laws
  9. Hi Glen Right of appropriation in a settlement is as simple as it says. What you gave above is an example of where it can be used. In any settlement you have a right to invoke this right so that the resultant settlement payouts are not used to settle other debts. It is advisable though to state this requirement with the 1st and subsequent letters. This automatically stop banks from using the settlement to cover od or other debts. Hope you find this useful
  10. Can anyone help please, IM said to have defauted on a citi account in 2000. The debt was later sold to 1st credit who then registered a default with cra dated september 2003. I have since queried this with the concerned cra and I have written to 1st credit requesting cca. I genuinely believe this debt was paid off ages ago and they have been asking me for evidence. I am asking them to prove that I owe this money. What should I do if they do not respond to my CCA. As my name says, I want to take these moroons all the way. If it is proved that the default is fraudently registered what is my recourse. Any suggestions?
  11. HI peeople, im new to the site but thought i might help. There is something called 'right of appropriation in settlements' that is you can ask the banks to pay you directly into another account or a cheque that you can deposit into any account

  13. Hello good people. I have finally managed to create a thred. I requested for a total of all my bank charges from hsbc and they sent me my statements last September with their usually 'if we do not hear from you within 8 weeks thi compaint is closed'. I have not contacted them so far and I NOW WANT TO CLAIM MY CHARGES, HOW DO I procced. My initial letter was merely a polite request for duplicate bank statements
