The judgement has only been set aside ! They acknowledged there was a counter claim in court and she looked panicked. Also we have been told hagery were acting but then we had a notice of change of soliciter to say welcome were acting! But this woman was from ind ! Who do I write to? What should I write I don't know if to send my docs and case to! One documents signature is defiantly fake and also since issue the Fscs have said they have credited an amount to the balance ( which shouldn't even be there ) all very mind twisting! We still haven't had a full sar from them! Your advice would be massively appreciated x and I want to thank you all so mich for your help it means a lot!

We have done all the above! Today at the hearing inds rep said they hadn't seen a defence then I glanced and it was on her pile I said it was there, she tried to say it arrived late but had the recorded delivery proof! Thankfully it was set aside ! Anyone got any suggestions on what I should do now! I thought the welcone rep may have spoken to us after but she stormed out the building and didn't even look at us

I have no idea how they did we were shocked when opened it! The otherwise have even said they didn't get a defence but they signed for it as did the court! I will do it all tonight and get it copied in morning! Can someone else come in or will this not be allowed

Yes we did, file a defence and on time, then we got a judgement without hearing. We also last week got something official looking to say Hagerty were no longer dealing with and welcome we dealing with themselves! Yestereday we had a bundle for the hearing tommrrow, saying they are IND, they want £103 to attend the hearing, they ask my hearing be dismissed, I have not been in contact , I have written to welcome and all rec del, I haven't proved payment, everytime I have written I have included the recipet copy, they say they have now prior knowledge of the running of the account other than the documents, there are loads of letter and call fees, and TBH a load of entrys that are not applicable to me, say I was redundant etc, I have never been for the past 12 years. I have sorted all papers but this is so unfair I even paid £360.00 to issue a counter claim as I have lost the RTB my council home. I do not know how this can happen. I have had no chance to defend myself ! what do I need to do and what will happen at the hearing? do I need to duplicate copies of anything? can someone come in with me ? My wife is panicing as I will get so mad, this has truly ruined our life, I do not know how they are allowed to get away with it. oh and in the mean time they have removed the entrys from my credit file!

Thank you! We did respond and filed a defence all the papers were signed for recorded delivery ! I can't understand this? We have received some stuff today from ind now ! Was hagery then welcome now ind, saying they want to be awareded costs for attending and saying things that are contradictory and in some cases inaccurate ! It's my husbands account he is very nervous can I go in with him even if I don't speak he will get so angry I know it would be better if I can sit with him and take notes

Please can you flag ths for assistance as I don't want to try post again cause issues really hope someone can assist me, We have been fighting a case against welcome finance, the money was paid in 2009 and there is No way we owe the money, we also were not sent information we were requested, we if.ed the defence have sent welcome all the info we have and been ignored, the. Got a judgement with out a hearing. It said we could ask for judgement to be set aside which of course we have done! Yesterday we got a date for Monday coming for the judgement to be set aside, what do we need take, do etc. It's my husbands claim but he doesn't have a clue what to do or say , and he is getting panicked as am I, more so as we don't know what to expect and have little time to get everything together ! The claim has been involved with hagerty, ind and welcome! I hate them for what they have done they have just cost us our 1st mortgage to, loosing £86,000 rtb discount, Can anyone help us with what will happen and how to prepare what to take.

Very interesting my husband is being taken to court by the, for a loan we have paid ! It's lost us a mortgage and caused no end of problems They should be totally shut down if we run accounts like they are we would be in serious trouble! I was looking why all the info had vanished

They are on everyone at the moment we paid loan off in bran h and they are claiming we haven't, they have no signed docs and one gauged one, they have put loads of crap on the notes, I do honestly to know how they get away with it! Please contact watchdog the more people that do the more publicity in to their behaviour can be got to prove their tactics

Can anyone also advise about why the default status is important as they have removed the entry from my hubby's file all the sudden and we don't know why! Sorry to hijack post but we have gearing Monday and am home working ! P,ease all report to watchdog lets nail these liars

Omg , you are in a very similar situation to us, we got judgement without a hearing to, Monday we have a hearing to set judgement aside! They have screwed us. We paid the debt off In 2009 and have the recipe in branch, we are owed a large a,punt of pup and their charges are so unjustified to! They have sent us some documents which are not all of them, they talk utter rubbish about conversations phone calls etc, there are references to letters , no letters included in the sar! And guess what no signature on one document as they said they didn't need one, and the other one doesn't bear my hubby's signature! I'm so mad and very unsure of what to expect Monday we have always paid everything and this has caused us so many problems, welcome I know are in default and I wonder if this is the reason that they are playing Lear.y dirty! Wold you mind if I use your case of an example of the way they act, it's shocking! please please report this to watchdog the more people do the more chance there is of getting the, investigated. Good luck x

I tried yesterday as I couldn't verify security I have to write in! Trust me if I loose mortgage I will have them in court for a lot of money! I'm fuming with them not good seeing I only came out of hospital after heart surgery Friday! Grrr -

I paid by bank transfer on 20th June I refused to give my card details I didn't but they assured me yesterday all calls are recorded so I will request copies -

I rang out of anger they said a manager would call me tommrrow. No the account was never on file it was a savings account! They have put the default on months after payment and years after it supposedly went overdrawn
