  3. hi judge If the claim is for £1969 im assuming that the claim is for a private account is that correct as u then state that they charged u £4500 on the business account............. Have u claimed for the bus account?????? If not start claiming for it, look at CI as they are probably charging u 29.8% interest ?????? Please clarify what is happening and we'll see if we can help further Scott
  4. hi guys If u have had a CCJ registered against u and u werent informed (moved address ETC)u can apply to the court to have a ccj removed from your credit file.. I had a £3000 CCj registered against an old address by the inland revenue in my name I didn't owe IR any money and i was empolyed, it turned out that someone with the same name as mine owed the IR and they couldnt track him down so thet registered the CCJ against me at my old address....... That was nice of them!!!! the ccj had been on my file for 3 years... IR gave me a letter there & then (As i wouldn't leave) which i took to the court, they gave me a certificate and the CCJ was removed within 48 hours....(this was about 10 years ago) Scott

  8. i would have thought that u coulnt claim it back......but the banks aren't going to defend it in a court,so u could include it in the claim and argue your case..... The worst that would happen is when they settle they deduct the fee from the settlement figure..... This is a very similar argument regarding overdraft arrangement fees as this is also linked to unfair bank charges.......On business account its the norm for £200-300 being charged per year for renewal of overdraft facility..... If u required the OD because of unfair bank charges that would mean that it also is reclaimable...... I dont think there is a definative answer to this, try to claim it and see what the banks response is..........the worst outcome is they refuse to refund that charge to u....... Scott

  11. I will have a closer look at the thread - looks to me like a lot of work! No u just wait for instructions from the court If I don't do it, the court will allocate my case to the small claims track and give me a hearing date at some point, right? YES Is that the date that the NatWest pays up 3 days before? They can pay out at any time, but normally close to a hearing or court date U just need to be patient now...............there is nothing u can do to speed the process up so good luck and relax Scott
  12. hi Try ringing nat west and ask 4 the money back if they refuse explain that u have already had a successful claim against them, if they wont give u it back explain to them u will proceed with a new claim to reclaim the charges.......... It might work........ If not Prelim Scott

  15. Hi hope congrats on the offer....... a differcult decision to make,no one can really advise u on this as its really your decision and your decision only........ I cant see anyone advising u 2 go to court as no one really knows what the outcome will be........ i agree that the banks willnot have to disclose costs as they have settled that side of your claim........... So the only argument I can see is the CI, they will pay the stat 8% but will they risk a court case with CI ??????????? I would love to see someone go the whole hog with the ci claim as im waiting along with many others to claim CI,the rewards are huge if someone wins but on the other hand the cost implication are also high if u lose............. good luck which ever way u turn Scott

Paul try ringing cobbetts and tell them u will enter judgement unless they give u a reason not to.........ie a cheque is on the way....... if a cheque isn't on the way ask them why haven't they filed the defence within the permitted timescale..threaten them with judgement and see what happens...... i would expect they will be rather embarrased as they have probably forgotten to file the defence, give them 24 hours to pay u in full or u will enter judgement........see what they say...........   20. hi Paul the 28 days isn't up yet ......cobbetts will normally fax on the lasy day and u will be notified 2-3 days later..... so just hang in there and be patient there is nothing u can do to speed it up............so chill...... Scott

  22. Hi u havent got to do anything apart from waiting 4 the cheque to land on your mat...... The judge has basically said that "disclose costs by may 30th" which we all know they won't so u will get paid out b4 the 30TH congratulations in advance Scott
  23. hi did u send a SAR letter (Data protection Act) if u did, act as steven has said, if u didn't send a sar follow it up with a SAR letter from the library(ask 4 all info not just the last 6 years)......... Regards Scott
