  1. My case was stayed yesterday and I wasn't happy. This afternoon I, too, faxed and emailed a four page letter to the judge requesting he/she deny the application for a stay and also that as the Defence have not submitted any evidence documentation whatsoever, then please consider striking out the case. I am not too optimistic that this will have had any affect and I was told a response and further order from the court won't be sent out until Monday as there is no judge sitting tomorrow. You never know.......................

  3. The stay was granted at West London CC. I've had enough now, think I shall give it a rest until the High Court Case begins then get myself all fired up again....... *has little lie down* *changes mind, goes to the pub )* xx
  4. Just found out from West London County Court that Abbey has applied for stay on my claim. The guy on the phone stressed that it would not automatically be granted (think we all know what that means though:evil:) He said to be prepared to come to the hearing on Friday but I can call back after 4.00 today to see if the stay has been granted. Shall I bother wasting a phone call and ten minutes of my time????? Do we already know the answer??????? MOB

  6. Hello Feater - Another West Londoner eh? I am starting to cack it as I have two more days before the hearing and calling the court every day (you may have read my previous ramblings). Anyway, now the hearing may or may not go ahead depending on this latest news re. High Court direction, the Abbey may or may not apply for a stay either before or at the hearing. I doubt very much indeed that they pay up the day before as people have been suggesting!! :lol: (But you never know!) When I've called the court they seem a bit in the dark re stays of claim and just keep saying that the Abbey haven't applied so just stay cool and turn up for the hearing - hope that puts your mind at rest, you might want to give them a (daily lol) call yourself to see if you can find anything out. I shall certainly keep you posted if I hear anything else - and you pass on anything if they give you a clue, Best wishes and good luck, MOB
  7. Hi Leecabs - yes looks that way. I'm starting to get nervous now and ringing the court everyday to see if they have applied for a stay. Would you (or anyone) happen to know if the banks are appearing in court these days? If so, are they allowed to apply for a stay at the hearing? The lady I spoke to indicated that the banks are still likely to pay up just before or not bother turning up at all but I don't think the people who answer the phone there are very clued up. (Apols to any court staff reading this ) thanks, MOB
  8. Well I just called West London County Court who confirmed that is not the case and the Judge there is considering each case individually. Abbey have still not applied for a stay on my case (hearing on Friday) but they still have a couple of days and may even turn up for the hearing to apply....... Keep your chins up... MOB x
  9. Hi ICY I spoke to West London County Court this morning about the letter Abbey sent re. stay of claim (my hearing is next Friday). The lady looked at my claim and said nothing had yet been received by the Abbey, also that it would take a few days for the stay to be made to them (they are put in a box and the judge looks at each application; this takes a while). I should do nothing unless I hear otherwise and just turn up for the hearing. She seemed to not be aware of any stays there and I guess each case is being treated individually. I shall call again on Monday and see if I can find out anything further. MOB
  10. Hello all Good point Dsilverstein they don't mention the direct debit, standing order or bounced cheque charges which make up most of the claim. Hmm. I rang the court this morning asking how long it would take for the bank's request to stay to be granted and the lady said it would go into a box to be seen by the judge and it could take days for it to be granted and they haven't received an application for my case yet. Good news for those of us with cases within the next week then if the Abbey haven't even applied yet. She said unless you hear anything from the court, assume everything is going ahead as normal. (not sure what is normal these days???????? ) MOB

  13. Hello Boris Becca! We posted at the same time so I didn't get chance to read yours first. When you rang the court yesterday did they say that the Abbey had requested a stay but your hearing was going ahead anyway? I so hope so..... Very best of luck, MOB
  14. Hi there I got the same letter today - and my hearing is NEXT FRIDAY!! Aaaaagh!!!! Just one more week! I am only hoping that Abbey are as slow to process their stay of judgment as they are everything else. I'm really really hoping that if the stay is not in place by next Friday the hearing will go ahead. They have also not sent me their evidence so technically I could ask the court to strike out the case. I will ring the court in the morning and see what I can find out. Anyone spoken to the courts? Any likelihood of hearings going ahead in the next few days???? Also, is there any chance of requests for stays being declined? OK, I'm clutching at straws here but I really want my hearing to go ahead. :? Best wishes all, x
  15. Just read the entire thread and you are officially MY HERO! My case against Abbey is on 17 August and I was starting to feel quite wobbly - thank you, you have restored my confidence. I'm going to check out all your interviews now! xx
