Thanks Les I am just waiting for a settlement on my bank charges and as soon as I have the money in the bank I think I'll be going for this, plus my mortgage is up at the end of nov for renewal. Good luck with yours mate.

Hi Paul The analogy wasnt that bad mate... It seems to me that the mortgage companies havent got a leg to stand on TBH, they know they have been setting costs and fees well over and above a fair cost. Can someone tell me exactly what we can try and claim back of them? Obviously the charges themselves= £1600 approx but what about charging them interest on that? and in my case I added the £1600 onto my new mortgage and have been paying it off for the last 5 yrs with interest? Lastly the admin fees they ask for seem to be getting bigger and bigger, can we try and get these back? Thanks in advance

I have been considering wether to take Abbey to court for my £1600 penalty charge( ERC) whatever they wish to call it, so I have paid the £10 and asked for all my data on my mortgage. Anyway, I am trying to get my head around just how they are trying to defend themselves on this one, I undertsand its a bit different to the bank charges, but from what I am reading on these threads the abbey(and the others) and saying they calculate the amount they lose on interest? Now if this is the case how on earth can they tell you as you sign the contract for say 5 years that you will be penalise a set amount if you leave the contract early? wether you leave the contract after 1 yr or 4 and 1/2 the amount is the same pre-set and yet is meant to reflect there loss on the contract? Can someone explain if I am reading this situation wrong please?

From what Zoot has posted it does seem pretty clear that some precendent has been set in case law, I suppose its a case of convincing the judge of the connection between your circumstances and them -

Thats just what it is, As I say I ended up having to file a case with the courts to get my statements, they said was an over reaction on my part but it certainly worked.

Just carry on with the process and stick to the timetable, dont let then sway you, you are entitled to the data they hold on you. I ended up having to go to court to force them to give me my Data, despite actually acknowledging my original request. DONT GIVE UP.

I had a bit of fun getting my statements, I closed my account last year so could access online and they initially agreed to sne dthem, then never, I had to go to court to force them to send them, then I got about 6 copies of them all.... When I sent my request for refund letter they did reply with the offer which only amounts to about 3/4's informing me they are allowed to charge us interest and would not pay it back....I wrote back informing them they were not allowed to charge me interest on money they shoudlnt have taken, and I accepted the offer as a part apyment of the full amount, nothing since so I started proceedings for the full amount, plus the interest they achrged me, plus the interest I have now charged them, plus £50 my costs( days off work etc) plus £120 court costs, fingers crossed...

What did you do? I went to the courts today and started the ball rolling. They took just on £1100 in charges, but with the interest they charged me on that and now the interest I am charging them (8%) it has brought it to £1300 plus costs... Fingers crossed everyone.

I am in the process of claiming for a joint account and I did alter the wordings slightly to indicate a joint account. Good Luck, dont give up

THe 14 days I allowed them for my statements is up on monday, I have managed to get two accounts details online but cannot get access to my closed account. Is it worth confusing the issue and starting my claim for the two accounts I have details on or should I wait until I get the details of the third? One more question, The court I need to go to to force them to give me my statements, is a local magistrates court sufficient or does is need to be a different court?
