  1. Just recieved abbey's defence this morning. Can anyone tell me what happens next please? I am awaiting a letter from the court saying which court will be dealing with my claim, does any one know how long this may take and how long i may have before i have to attend court. (The defence denies everything)

When you say you read about someone else, what was it that you read? and how did you add on other costs to your claim after you filled the MCOL i.e. postage, cost per hour to yourself for preparing the court bundle and is it possible to add on other charges which have been added to your account after i have filled?

    Bank charges

    After applying at the court how do i then know if Abbey have filled a defence or replied to the claim before i file a judgment, have not heard anything yet and there time is almost up.
  5. That was a reply from the first letter sent. I have decided to acept this offer as i now wish to start the other claim with them for £700, i am aware that the courts don't allow more than one claim to go through in scotland so thought i would just take this offer and see what happens with the second claim, this runs before the original but is still for £700 so going to try my luck The amount they owe me in charges well exceeds the credit limit on the card and is almost double what the outstanding balance is lol.
  6. I made a claim with capital one for £300, i got an offer of payment this morning for £214 to be paid to my credit card this month. What i wanted to know was, my claim was for charges made onto my account last year as i had not recieved any statements from them so just made the claim on what i had. I have however recieved the statements from capital one and have now found out the charges total £1000 (so £700 more than what my original claim was for). Does anyone know if i would be able to make a seperate claim for the rest of the money and should i accept the offer or fight for the rest??
  7. Thanks for that. I'm getting a bit nervous and excited now, don't really want to have to go to court but needs must. Did you claim back the £9.25 an hour for the time it took you? if so, how many hours did you put in and did you cliam anything else? I have worked it to be roughly 1.5 hours a week from the start (which was in January)

  14. Can you let me know how long it took for you to get a reply after you filled your court claim? I just done my MCOL this morning and don't have much patients when it comes to waiting on other people. I started the ball rolling in January, suppose i have to just wait and see. It will be worth it in the end to get the money back that they unlawfully took. Any help would be much appreciated lol and CONGRATULATIONS on your win, hopefully i will be a winner as well.

My next question has nothing to do with my AAbbey claim but one i have with Monument, i have started a thread on another link yesterday but to no avail. so here goes and sorry for posting it in this thread. After requesting my charges back from Monument, I recieved an offer of £108 from a claim of £318. I recieved the following letter yesterday morning. I wont right it all as it is 3 pages long; The investigation of your complaint has now been completed. I am sorry that we have been unable to reach a mutually satisfying resolution, BLAH BLAH - In the circumstances, for the purpose of the financial ombudsman service you may regard this as monuments "final response". It then goes on to talk about terms and conditions and how they believe they are being fair. They will not take into account any of the charges apllied to my account that were for £12, then says they are prepared to credit my account with £108 good will gesture. Unsure about what to do next, should i contact the ombudsman and carry on with the full claim contact monument or accept the offer?? I have an LBA alredy to go but not sure if i should send it. Any help would be greatfully appreciated, thanks

Also how do i claim back the expenses to myself e.g. the cost of posting the letters etc.
  24. Cheers very much, just read it although it didn't make much sense to me. I read on here that you could claim back the cost to me for doing this, i have been posting all my letters via next day recorded delivery at £4.10 a time can i get this back?
