Nothing in writing sent to me, but i have now sent them a letter explaining that whilst i'm aware there is an outstanding balance now on my mortgage this is their error and due to that reason they can not expect me to cough up an additional £700 in a month to cover it.. Just waiting to see what i get back.
  2. Wonder if you guys can help, Back in September this year i remortgage with Abbey, when i went to make my payment in September I was told that no payment was due till October... I called 5 working days after my payment was due, so surely it should have shown on the system. I didn't get any letters from Abbey for the month of September ... so this month when i called to make my payment i got the shock of my life by being told i was in arrears (never been in arrears before) and that i owed two payments. I told them i was able to make a £500 payment there and then and i would make the remaining £200 for the payment in October... I'm now being chased for the September payment, which i now don't have.... as this is Abbey's mistake, is there anywhere of making them take the hit....? I was willing to pay the payment in september, but i was told after asking in various different way that no payment was due or owed to my mortgage account. Do you guys know of anything that i could tell Abbey that can stop them chasing for their own mistake? Kerry

The debts are still with the original creditors, my husband is a very proud man and would never let the situation get to DCA's, as soon as he realised he could no longer afford the payments he spoke to various advise places and found Payplan, they could have offered him a smaller monthly payment, but he still wanted to make larger payments to clear this off quicker... personally after the way they treated him in the months after going on to the DMP i would have opted for the smallest payment possible, but thats just me.... He has advised Payplan numerous times about the letters and calls he is getting from the creditors about payments and making threats, but he is not getting much support, I guess with the financial situation at the moment, lots of people are requiring the help of places like Payplan. My husband got a funny call from Tescos a couple of days ago. after going through all the security questions the guy asked if Darren had his debit card available and could he take a payment of over £4k!!!! even my husband had to laugh at that.... are this people completely nuts and not reading the account profile before making time wasting calls????

He has a DMP in place with Payplan who he advised immediately about the redundancy and has changed his plan to £5 a month (£1 per creditor per month) for a maximum of 3 months. But within 5-6 weeks the creditors where chasing him for payments and calling and writing to him saying that he had broken the agreement in place and that the DMP was no longer in place and that they required the overdue payments and also interest would start to be charged to his accounts. failure to make the payments would result in Defaults and CCJ's My Question is, is this enforceable? what rights does he have and is they anywhere of stopping this. He has 3 debts with LLTSB, a Credit Card, Personal Loan and Over draft. A Credit card with Abbey and a personal loan with Tesco. Any suggestions... Kerry

  7. Hi Guys' after just winning my case against HSBC, I've come home to my statement from FD. Just done the spreadsheet and I've got £750 of charges to come back to me. One thing though, what the heck is a Tariff Fee???? I've got loads of this little £7 charges and i;m not sure what they are for.... any ideas????? Well I'll keep ya posted how this all goes.... Took me 3 months to get the money out of HSBC, but thats now done and with the wisedom and help from this website I am ready and confident to logheads with the next Bank!!!!! Bring it on!!!!!!!!! :o

  10. how would the wasted costs go? looking at other thread quicky this morning, as it never went to court, can i still ask for them? it seems £9.25p/h is the normal rate, so thats fine, i'd reccon about 20 hours to get all the information together... then postgage, ink, paper... so about £230.... when would i need to start trying to claim these back.... ? can someone let me know cheers K

Dear Rachel, Many thanks for you letter dated 25th June 2007 with the offer of £2795.82 in full and final settlement of my claim against HSBC and its bank charges. Whilst reading the letter, i decided to make sure and double check all the charges against the statements and spreadsheets and came across a few errors. I've attached a spreadsheet with all the information that came with your letter and have cross reference then against my court bundle which you should have received on Friday last week. The first two on the statement have not been included in your spreadsheet? Are these within the 6 years? Jan 2001..? The charges highlighted in red, are ones that have been missed of your letter, so i've also given you the page number to which the statement confirms a charge was made, or in the case of the last two in October 2006, 2 charges where taken from the account and only 1 refunded, so my claim for the one bank charge would still be correct i believe. The charge highlighted in yellow, was a bank charge that was taken, but i had not included in the spreadsheet as it was after the claim had began, and seeing that you've included it, the charges in mauve are the newest ones that have come out of my account. With this in mind, I would be willing to accept the offer off £3080.91 in full and final settlement only for this claim of bank charges made on my account between 02/01/2001 and 01/06/2007. I accept this offer without prejudice and I reserve the right to make any further claims should you apply future charges that may be considered unlawful under common law or in violation of the Unfair Terms in Consumer Contracts Regulations 1999 or Unfair Contract Terms Act 1977. I will be willing to withdraw my claim upon receipt of unconditional full settlement of my claim, once the money has been deposited into my account, I will inform Harlow Court that the matter has now been resolved. I am also not prepared to agree to any confidentially clauses you try to impose. I hope that this now concludes this matter, if not please call me on 0*** ******* to discuss, so that we can settle this in a timely manner before the court hearing.   12. the AQ fee is already included in D&G's full and final settlement, so they've already said they will pay it... So you think i will be ok in getting the extra owed then?
  13. guys, firstly, after sitting here and cross referencing the statements, spreadsheets etc... seems they've made a few mistakes. + added a few that i wasn't claiming, so checked my statements and found a few recent ones that i could add on to this claim??? so now the original £2795.83 has a increase of £154.76 which i have double checked and made sure its all correct. with the 3 other additional charges i've had, the total is now £3080.91, which includes the £220 court fees, which they have already aggreed to pay. only thing which varies is there interest calculations, they run theres on 25/06/2007 mine where done on the 20/03/2007. so i've amended mine to their calculation date, still differs though.... would you say i would be OK to send a mail/letter to them pointing out the mistakes and saying that i would be willing to offer in full and final settlement the £3081.91???/ Let me know.... this is nothing apart from what i am owed the the 8% stat interest.... Help guys....
