  5. Ok, i thought i'd listen behind the sitting room door, to hear how he spoke and what his body language was like....

    So my friend answered the door, stated that i had gone down to the council tax office and paid £100 off, he IMMEDIATLY said

    "your lying, the council dont accept money once it's been passed to us, the baliffs, now let me in and we'll sort something out"

    Of course, this is where i step in, his foot that was, again, between door and frame, so i promptly put abit weight behind the door with a little speed.....and he moved it, explained that's twice he's attempted to gain entry by force without a warrant, or police escort....then i stepped outside and shut the door, his whole attitude changed, aswell as his language towards me/her.... i asked what he'd feel like if i began to bully him ETC then got onto the real details....

     

    I told him i'd just been down to the office and paid £100 cash to he cash desk (i did too) and he said the same as above "you didn't they can't..etc....". and grabbed his phone, "ok i'll call them" and he did, and they confirmed that i'd paid it, welll...that put him right in his place, i'd obviously called his bluff and won, now i had his tail between his legs, i told him to knock on the door all he wants, add all charges that he wants, but that i wasonly pyaing MY money to the council, and any charges he's made up....can be settled elsewhere/how.

    he then asked to 'just write on my notepad' on the drawer set in the hall way, well i'd caught straight onto this "let me in ploy" and told him no before she had a chance to say ok.... he then said, look your the householder, you have to answer, she said no, and he walked away saying i'll be back wanting more money ETC.... i've again been down today and paid a further £100 to the council and had a word with the women behind the desk, gave her an outline of what my friends going through with post natal depression, lack of money and taking her down to benefits place, she said she'd consult her manager and see what she can do....

     

    so now the baliffs will be coming o the door for a £250 debt.... i THINK it's cheaper for them to give this one up isit not?

     

    any help again greatly appreciated as my backs starting to ache sleeping on her setee now lol

  6. Help for a vaunrable friend if you please?

    Long story short, she got a council house with her then 'boyfriend' ready for parenthood, when it came to the crunch, he couldn't take it, and flew the nest, now she has suffered with post natal depression in a severe way since the both (not helped by an unhelpful boyfriend/father), and has fell behind with the rent a little (£250) and council tax by £450 (as stated by baliff letter, will confirm with council first).

    She's just been informed by her employer that her entitlement for sick pay has now ran out and she'll have to seek benefits, now to my knowledge, the benefits she's about to recieve, will JUST get her by yes?

    She's scared witless now, because last night a, in her words

     

    "a really big, mean looking guy knocked on the door, asking to come in, whilst putting one foot between the door and door-frame"

     

    Now i KNOW for a fact that he's seen she's a 22 year old, 5'3'' female with child and has tried forcing/bullying her into getting in, he told her

    'it's costing you everytime i come, and i'll be back tomorrow, and the day after'

    but of course, i'm there this time, i'm 6'1'' bodybuilder, so we'll see how he likes the aggressive size difference/bullying tactics. i've temporarily moved in with her on the setee as she rang me in histerics last night after the visit thinking everything she'd bought would be getting taken for the sake of £450 (TBC) weather she let them in or not...

     

    So.... my question is, i'm about to send the above mentioned letter to both ballif company (Rossendales) and local authority.... am i ok to say at the door

    "your not getting in, i'm in the process of contacting your company and local authority, but also the police for your attempted forced entry yesterday, and any payment for this debt will be made directly to the council?"

    From what i've read above, i'm within my/her rights to do this, as he wont be breaking any protection act with regards to my friend as he wont be giving me any details of amount owed, or whom to?

     

    QUICK RESPONSE if possible guys, he's coming at 11 today.....but not getting in either way

  7. Hey, not been around for a few months, had a few life changing decisions to make....but i'm back... and WOW this place has changed lol

     

    anyway....

     

    Ok, last year i bought a setee from SCS.... £1.5k, beautiful thing, but after a 3 week delayed delivery (got delivered crimbo eve) it eventually came. great.... around FEB/MARCH time 'my' seat was starting to 'sink' BIG style, so i changed seats with the missus.....but found hers was ALREADY doing the same.... cussions were STUPIDLY soft....and only THEN i decided to go to the store and test sit the setee they had....very hard indeeed compared to us.

     

    Rang up their customer service, got passed pillar to post (as with everyone) eventually get an engineer booked for 3 weeks later.........he comes, said they've been filled poorly....they have LESS than half the stuffing they should have..."usually elderly people get this as a request" he then said

    another 3 weeks past and we get a call...yes we are at fault we'll have new cushions made and get them fitted asap, you'll have a call in 4 weeks when they'll be back from italy and ready for fitting.....i ring back and make sure that they are ALL cushions (seats and backs)...."yes they will"

     

     

    fast forward to SEPTEMBER 12TH 5 MONTHS AFTER MAKING THE COMPLAINT! despite my nagging ETC....te guy comes, and REfills our cushions...i confront him "guy on the phone said ALL cushions were being replaced and the leather is now ruined with veins/fat marks that would NEVER be made on this if it was made properly first time.... "nothing to do with me i'm the middle man".......great

     

    So ring SCS back up...... they'll email the manufactrer to see what the problem was (WTF) can take 5-7days....so i allow 3 weeks (10 working days) for a reply....yet nothing, i've just rang now, got passed by 3 managers and countless 'gimps on the phone' and been told i'll be called by 12pm this afternoon....

     

    my question to any1 in the know....

    Where do i stand with this? their 0870 number costs me £6 for 30 minutes talking and i've phoned GOD knows how many times (will be checking bills and getting a cost together), their 'skills' are ****e, customer service ****e and setee is ****e.

     

    i've got all calls recorded via landline plugin thingy off ebay (GREAT INVENTION) i've wrote down all names/dates and time of people i've spoken too.

     

    i want to know where to take this? whatever the outcome, it's going to MD's of SCS plus various other managers and to complaints dept (wow), i want to know if i can contact the FSA in relation to this? i've paid for something i've not got. then they've spent 5 months Fcuking me about....

     

     

    heres some pics of the setee AFTER they'd replaced the stuffing in the bottom cushions.... as you can see...the back are VERY much deflated on all seats...

    Instead of the missus being paid £800 onthe nose.

    She's been paid £8,140.14.... now when she said '£8k' to me i thought, oh they've added a 0 by mistake, but 140.14 has come from nowhere.... i've just taken the money from her account and put it in my savings to start earning me interest....and once they ask for it back...we do, minus the interest i've made.

     

    What would happen if we were to spend this money on paying off some of our debts? would it be a £20 a month repayment plan thing from her work or what? and what does the law state too?

  9. I'm TOTALLY outraged at this.... for the last year i've been living out my overdraft.....mostly has been fine.... but this month i was paid less than i was s'posed to...and only found out byt the time i was at £880 or my £900 overdraft...

     

    So i've stopped spending, but obviously couldn't cancel stuff that had already gone through, top-up,shopping and the like, or within 5 days of a DD coming out....

     

    Well i've just went online to be faced with this, which is an absolute OUTRAGE.... my balance is now £1,074....bearing in mind that my OD is only £900....i've been charged the max 3 times too in one month.... so the £90 charges have come off my already overdrawn...overdraft lol (AARGH)

     

    Surely, if my overdraft has been reached, they can't allow me to go over, let alone £174 over!??!?!!?!

     

    have alook for yourself and let me know what i can/should/can't do as i'm SEVERLY pee'd off by this, my next months wages would have covered me for the downfall i had this month, but now i'm going to be paying £174 just to get back INTO my overdraft. (PS going down the high street later to open a parachute account which is going to be my main one until this is sorted out)

  10. Oh well. he phoned back and said they've not only credited the FULL amount back onto the account, but also the interest incurred (£110) so i have no grounds to claim. and to be fair i dont now lol

     

    would have been nice to have £800 extra to go on holiday with though lol

  11. URGENT URGENT

    just hadhim on the phone, he's saying that because i requested in my first letter that i wanted the charges taken off my MBNA, that he has put them on there (later than the letter said), he's now saying that MBNA 'would prefer' to take it off the account to get the debt cleared (that little bit faster) and be done with me so to speak. now i've said well you didn't do what the letter had said, and so i sent you the letter stating that i wanted ALL chargessent to me (letter above) and he's gone to speak with the 'collections team#' what can i do/say? because he's saying that because they are putting the rest of the charges on the account, i have no grounds for a claim... .HELP

  12. Hmm....Interesting....

     

    Phoned up the number given in my last letter from them, and asked to speak with 'steve bailey' who was the one that sent the letter,

     

    Young lassy on the phone said can i help, he's off today, so i explained the whole situation, and she said she'll get intouch with the person dealing with all his queries, anyway, a few hours later i get a call from this 'gareth' that has been spammed all over the board recently......

     

    Explained why i rang him, i said "Yeah, just thought i'd ring and find out if you recieved the reply to the letter i sent which was signed for on the 26th of may, and if you'd replied, as i'm on money claim now and it's asking if i've tried everything i can do, to resolve the matter without getting the courts involved.

    He replied "well i dont think there's a need for the courts, what i'll do for you is i'll have a word with a few people about a few things, discuss it over with my boss, and get back to you by 10am tomorrow morning, is that ok with you?"

    of course that aint a problem.....so just waiting to hear what i get tomorrow.... anybody want to put bets on?

     

    I'll give you 7/1 they'll offer just over half what i requested lol

  14. well..... it's 8 days over now..... i'd LOVE TO TAKEM to court for it, but i'm on holiday on monday and have no money (other than spenders_ til i get paid at the end of the month!

     

    Sohuld i try ringing the guy on my previous letter telling them that if i dont have cheque for full amount by the time i get back then once i'm paid i'll be putting a claim forward?

    First of all I’d like to thank you for your last communication with myself, I will also thank you for your ‘gesture of goodwill’ for £300, which you stated had ‘already been put in my account’….. When I received my statement, this wasn’t true; there was no credit at all, other than my payments. But as this is not the FULL payment I requested (£800), I will be contacting the courts (through Moneyclaim) within the next 14 days to arrange a claim for the remaining £500 I’m owed.

     

    IF payment is made to ME (£300 already accepted then additional £500 or the Full £800 in one go) via cheque/direct credit to my bank account not MBNA account (phone my mobile for details) by the 06/06/06 then of course, I will not have any more problems with you and will not be taking any other action.

     

    Can I just say, I don’t want a ‘standard’ letter AGAIN, as I did request this the last time, everybody is an individually, so should receive a unique response, Also as a closing point, I ask you NOT to send me a letter stating that you will reply to me within x amount of days as I’ve clearly stated above, if I have not received the full payment of £800 to me by 06/06/06 then I will be contacting Moneyclaim

  16. Hmm...

     

    Recieved a letter saying that they dont agree blah blah blah but as a gesture of goodwill they 'HAVE' credited my account with £300 (of the original £800)....yet i've checked online AND on my statement i got today.... and they havn't lol

     

    What to do now?

  17. Yeah the actual naming of 'commision' i thought that if they took money from you, they had to state EXACTLY what it was for?

     

    and why it's NEVER happened before until now?
