  1. Nope, not yet!!!! That could be due to the fact that I dont dare leave the house. Only joking. Will be a lot more alert in the future though,I hope.
  2. Well, thats just sods law!!!! Posted that yesterday and today got a letter saying they are going to start again with the 2nd case. However, would still like opinions on the starting a ppi claim in both the cases. Should we or shouldnt we?

  4. Thanks Gh, I hate to say this but Im not realy sure what you mean by this bit- but will struggle to show how the account was not terminated when they issued a claim for the full amount outstanding.
  5. Update on this one. I would appreciate thought on this please. The case was stuck out 4 months ago. (The paperwork from the court said neither side had complied with an instruction) I was under th impression that if they wanted to continue they would have to apply to have the case reinstated and would have to have a valid reason to do so. We have just sat tight and waited to see what happens. Today we have recieved a fresh default notice relating to the debt and a letter saying unless we make an offer of payment they may commence proceedings. (No mention of the earlier court case) Could this just be scare tactics or is it a sign of something more ominous Thank you
  6. Other half has a loan and credit card with Nationwide. In both instances he has gone through the process of sending for the CCAs and both went to court. In the fist case the other side pulled out at the last minute and in the 2nd case they did not produce the required documentation and so it was chucked out. Now we are going down the route of reclaiming PPI on one of his other accounts. As the 2 that went to court are the 2 biggest we would like to be able to claim the PPI on these as well but are worried that it may just start the ball rolling again with the court case. Could there be repercussions if we start a claim and if so is it better to leave well alone?
  7. Update time. Seems this guy can just get away with it. The council dont care a the street is 'unadopted' so hes not actually parking the cars on a public road. As far as the tax on them goes the same applies.
  8. Only a small thought but be careful, if they are offering you compensation for poss of wage and you let slip that it was taken as holiday then they may say you have not incured loss of wage.
  9. Cant believe Im so stupid. I just had a call from some woman saying she was from the Warrington Crime Statistic Survey. She asked to speak to the owner of the house. She then asked if we had an alarm fitted either privatly or by the council. I said we had but it never worked!!!! She asked if we were part of a nieghbourhood watch scheme I told her that even though there was one on the main road it didnt include our close.!!!! She then asked what type of property it was I told her it was semi!!!! She thanked me and hung up. Then I suddenly thought, B-----y H--l, Thats out of order ringing and asking people for those details. So I did 1471 - withheld number, theres a surprise. Then I realised, What a muppet, Ive just given all those details to a stranger. I think Im quite savvy really and am always telling people to be wary and careful and yet I just totally went with it. Am now going to start boarding up the windows!!!!
  10. Thanks Steve. I take all those comments on board. However in response to the points you make- The houses are identical in every way. There are 3 in a row all owned by the same landlord and rented out by the same company. They were built 6 years ago and have been on permanent rental from new. As far as the upsetting bit goes, I dont know why this would be as we have decorated ours, put new carpets down and improved the garden whilst the neighbour paying less rent next door, whilst not a bad person, lets her child crayon on the walls, has had them replace windows twice in the last 12 months because her ex has been round and put the window through and is- by her own addmission 3 months in arrears with her rent. She has survived one eviction notice by being bailed out by her brother. Our rent has always been paid on time and the rental office has already told us that they wish they had all there houses occipied by people like us. Im not saying we are a landlords dream but my opinion is that we have to call it home so want to look after it whilst we are in it. I cant think its a ploy to get rid of us. I think whats oirked me as well is that another house in the close has come empty and is up for rent from a different company an thats £70 a month cheaper. (and before anyone says- I do understand that we chose to take this house and its just a case of green eyed monster - but Im still a bit miffed)

  12. We have ben in a rented property for 17 months. There are 3 identical houses all owned by the same landlord and managed by the same company. At the end of our first 12 months we had a letter saying that the rent was to be increased by £20 a month. Today we find out from speaking to our next door neighbour that her rent has never increaed over the 3 years she has lived in the house and she is currently paying £20 less than us each month. The tennants on the other side have only been in the property for 8 months so thier rent is also still at the old rate. I know when we moved in the rent was fixed for 12months so wasnt too surprised when we got the increase letter at the end of the 12 month period. However Im annoyed that our other side neighbour has never had an increase. Im going to ring the agent on Monday but dont suppose I will get far with them. Am I right to feel niggled?
  13. I have recieved an email supposidly from DHL containg a tracking number and it says 'they were unable to deliver a package because the 'recipitents address details were incorrect'. I havnt sent anything by DHL, nor am I expecting anything. There is a file attached (which I have not opened) and it says 'Please print out a copy of the attached invoice and collect the package at our office'. Anyone have any idea whats going on here please, Im curious but dont want to risk opening the file.
  14. Have you contacted the company you purchase it from and told them that you have proof that they signed for it on delivery?
  15. Thank you all for the replies, we did CCA them and the result was a valid agreement. Thats why we have been paying the token payments. The thoing thats worrying hiom now is the threat to start charging interest again. That will just eradicate all the progress he has made clearing the debt.
  16. Thanks for the reply Dx, its a Halifax credit card which was passed to them some time ago and he has been making a monthly payment for a couple of years. They have written to him a few times over the past couple of months and he has just ignored the letters but its because they hjave threatened to start putting interest back on that he has responded this time.
  17. Other half has been making minmum payments to BOS for months and has been getting letters asking him to up the payments as they are due for review. They then sent a letter saying that if he didnt contact them to review they would respond by putting the interest back on the account. At the moment he is just making payments which help reduce the balance and the interest has been suspended. He rang them to say he was even worse off than when he started the payments as things have gone up, rent etc. They have sent out an expenditure form for him to complete which I think he should ignore but hes worried they will carry through the threat of adding interest again. A few things I would like clarification on please:- They have asked for his payslips - Ive said not to enclose them as they know full well how much goes into his account each week from work. If he fills out the form then it will show he has more going out than coming in, are they entitled to my earning details? (I have been threatened by them as well but my Halifax account is in dispute so they are quiet at the moment) On the form is asks if you are married, single or divorced. Technically he is divorced, we live together but are not married. They will know from records that we are at the same address so whats the best way to handle filling in the form? I feel he should just state divorced and show that more is going out for him than coming in. If they dont accept the payment as it is, without any increase (which they are not going to get) whats the worst that can happen. We are in rented property and he has no assets as such so I feel he should just carry on making the reduced payment and tell them to do their worst if they think they can get more. He has never missed any payments so to take him to court when there is no more cash would be a bit pointless.
  18. Not been online for a few days so only just updating. Thank you for moving the thread Martin and thank you all for the replies. As far as claiming on the ex's pension, he wont have a full pension as was always workshy and I would be very surprised if he has enough contributions on himself. He is now remarried to a woman a lot younger than him who is supporting him as he isnt working even now. (Not a nice man!!!) Last year when I was not working at all we applied for housing benefit but were turned down because we are just over the threshold with other halfs wage. Its not realistic though because when they do all the sums they dont include the child maintenance he pays each month in the calculations so we are not left with anything like they say to live on. If I had to retire today we would be entitled to nothing and yet still be way below what we need each month for outgoings. I can see no option but to work until other half retires by which time I wil be mid seventies (assuming I can find an employer and my health allows it) and then when he no longer has a wage we may get some benefits.

  21. Hi All Just looking for some kind of thoughts on this predicament please. We are in private rented property having lost our home 18 months ago. No savings of any kind. Other half is 10 years younger than me and not in a highly paid job. Im approaching retirement age and not in the best of health but have no pension. Due to working in the family business for a long time and then finding out that my stamp was never paid, then taking time out to raise children and working part time I have never accumulated a pension. A messy divorce also made sure I could not have oart of ex hubbys pension. We are just able to afford the rent as it is with me working but I cant carry on working indefintely although intend to do so for as long as possible. Before I started the job I am in now we applied for housing benefit help but were just over the threshold with other halfs wage. He also pays child maintenence which isnt taken into consideration when you apply for benefits and this will continue for the next 9 years. My worry is, how we will afford to live once I have to stop work. Even if we were to move to somewhere cheaper we would still only be able to be about £50 a month better off and to do this we would have to accumulate another deposit before we could give notice on the current place. I just cant see how we can have a managable future. His wage wont keep the roof over our head, we wont be eligiblke for benefits and I will have no pension . Quite honestly Im scared of the future.
  22. Thank you for the replies. I will contact the council. I will also contact the DVLA but just out of interest, what would they get involved for? Is it because he is not the registered owner or because they may not be roadworthy? Im assuming the scrapyard are buying them and then just passing the paperwork straight to him so they will still be registered in the orig owners name. Its worrying because if they are scrapped by the owners then they are not being given any checks before being sold on.
  23. Can anyone tell me if there is anything I can do about a next door neighbour who is turning the cul de sac into a scrapyard. We are in private rented accomodation, both houses owned by the same landlord who dosnt seem to care what the tenant does. At the moment despite having 3 car space between every 2 houses he ha 5 cars in the street. The cul de sac has parking bays for each house but as we are at the bottom end the cars are all clustered outside in the bay and also in the turning spaces. It dosnt really affect the other residents too much as they can all drive in and out without having to come to the bottom. Today we have had 6 lots of viewers and its the same every weekend. They are open plan gardens as well so people are constantly standing on my lawn to look under the car bonnets. At the weekend I constantly have a stream of cars parking outside my window and often struggle to park when I come home. 20 mins ago a vehicle turned up with yet another car on the trailer and deposited it outside. The driver was wearing a high vis with a company name on the back and when I looked on the net it is a massive scrapdealers about 20 miles away. He hands them a wad of cash and then sells the cars on. Isnt it illegal to run a business from home which is what he seems to be doing, he dosnt work so must be making a living this way. Im really fed up of it but hes not the kind of guy you can approach. I have mentioned it to the rental agents but nothing gets done. What steps can I take please?
