  2. That's what I am saying. Default was June 2010. Then we got the letter in June 2014 saying they were taking her to Court, we sent in the N9a form to the Court recorded delivery only heard from Cabot now some 2 years on saying get in touch "We will not be persuing legal action at this time" - we don't get it? If it went to Court they would be knocking on the door sooner than this letter has come? What do we do next, do we email them, we won't call them we never call Creditors.

  4. We sent the form off to Court (Recorded delivery) over two years ago (N9a) but never heard anything until today?
  5. Two and a half years later we have received a letter from Cabot, debt now at £21,573.58, Wife has breast cancer and can't deal with this. We haven't heard anything since we sent that Court form off years ago and now this saying they are acting for Marlin but at present they will not be persuing legal action? Thought they took it to court years ago, confused.
  6. The default was from TSB on 29/06/2010. We didn't go to court as you can see from my posts, but did highlight that there was never an original signed copy and the debt was previous to 2002 which they were saying it was from. According to the credit report, the account start date, states however that it was 2nd May 2003, which we don't understand as originally it started in 1997?? It states Account End date as N/A? This is my post back in September, "Just an update really, I sent a letter and the form back saying we were not going to defend due to my Wife's Dad ill health but stipulated that TSB had never complied with anything but only produced a balance transfer signed form in 2002 but the original contract was from around 1997. They replied and said they were going back to TSB for their evidence and would contact us in time, 2 months ago now". I will send them a SAR tomorrow, but once again I have not heard from then since July?? But they are adding a £100 a month?
  7. Any help / advice please. We have not heard from Marlin since my last thread but have now got a copy of our Call Credit file. It shows the TSB debt now at £20,720.00 adding £100 per month for the last 6 months. How on earth can a debt of £10,420 nearly double in 6 months without going to court, I can't afford a Solicitor on this??Help please?
  8. Received a letter today off Mortimer Clark in relation to the 2 letters I sent to Marlin and themselves, which was a CCA request. The letter is very brief and says ,thank you for your letter dated 9th Oct 14. We confirm that we have forwarded your document request to our client and we will be in contact when we receive a response. (Now this is the bit I don't understand?) We further confirm that this debt originated with a Credit Card through Egg Banking Plc. The date of the original agreement was 22/03/2000 and bore the agreement number *************** This agreement was terminated on 8th March 2007. Your account will be placed on hold pending a response from our client. So I sent the Statute Barred letter and they say they received a payment on 24th Oct 2009, I would not have sent a payment if the agreement had been terminated on 8th March 2007??? Am I missing something here?
  9. Do I send the SAR to Egg? or Barclaycard? Also the fact that I haven't had an annual statement for over 5 years is that not worth anything?
  10. I guess you have received your annual statement like me today. I have just noticed I have £650.00 of interest bearing charges and an additional £285.84 of additional interest incurred totaling £935.84, can I try and claim all these back, does anyone know please?

Made a mistake with my dates the debt was only 5 years not six they wrote back and said last payment was 24th October 2009, which I have now found, they have enclosed an income expenditure form for me to send back. Should I now start the process from the beginning as no application form was ever signed?

  13. Bad news! Sorry, Wife has now said she doesn't want to go to court as her Dad is ill and she has enough stress going on in work...what should we do next, I suggested I go and defend it but she is saying no. Do we now write to the court or to the solicitor or both? and take a hammering....

Marlin Europe II Limited Date of issue – top right hand corner of the claim form – this in order to establish the time line you need to adhere to. Date of issue 30 June + 19 days What is the claim for – the reason they have issued the claim? By an agreement between Lloyds Tsb (“LTSB”) & the Defendant on or around 02/05/2003 (“the agreement”) LTSB agreed to issue the Defendant with a credit card upon the terms & conditions set out therein. In breach of the Agreement the Defendant failed to make the minimum payments due and the agreement was terminated. The Agreement was assigned to the Claimant on 28/11/2013. The Claimant therefore claims: 10420.00 2Interest pursuant to section 69 of the County Courts Act 1984, namely 9304.20 & continuing until judgement or sooner payment at the rate of 2.28. What is the value of the claim? Amount claimed £19724.20 Court fee £550, Solicitor’s costs £100 Total amount £20374.20 Has the claimant included section 69 interest (8%)within the total claim or is it shown separate within the Particulars but not added to the debt? As above Is the claim for a current or credit/loan account or mobile phone account? Credit card When did you enter into the original agreement before or after 2007? Original card was just sent in the post as a TSB trustcard back in 1991 with a low limit then kept increasing but in 2003 ssigned a balance transfer, the credit limit was more than I was earning. Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. TSB have given the debt to loads of DCA’s but Marlin have stayed chasing it. Were you aware the account had been assigned – did you receive a Notice of Assignment? Yes Did you receive a Default Notice from the original creditor? Yes Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No Why did you cease payments:- It was with a debt management company for a short time and I just paid them, but then I went back to paying my debts personally and missed this one. Was there a dispute with the original creditor that remains unresolved? Only that they only provided a reconstituted agreement not the original and interest and charges were never refunded on the account. Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan?Yes see above, we had our debts with a company called Hawkeye or something similar?
  15. Urgent!!! Received Claim Form off Marlin / Mortimer Clarke Solicitors for Court date in County Court Business Centre, Northampton today, issue date 30th June 2014. Suddenly the £10420 debt is £20,374.20.£9,304 in interest!!! Help please?.
  16. Back with a vengeance! We totally ignored Marlin who took over this TSB credit card debt but finally have a letter off Mortimer Clarke Solicitors saying they are starting court proceedings as we have failed to agree a reasonable payment arrangement with Marlin. Any help please??

I am late 40's self employed, have a very large mortgage, secured loan with GE for £44K, and £60K of personal loans and ccards which I have had all charges and any PPI's refunded, just seems like I will be paying them all for an eternity and having nothing left each month?? If I know I can keep the house for now but clear all the other debts I would be happier, I think?
  20. Hi, Is there anyone on here who is a bankrupt. I am seriously considering it but want to know do we lose our home, what happens with the mortgage (Basinghall Finance) etc.. . We have over £60k in credit cards and unsecured loans and it just goes on and on with no light at the end of the tunnel. If I go bankrupt, there is no equity in the house to pay any debts off anyway and I have a secured loan with GE as well? Help please?

Being a bit thick here, but if I haven't acknowledged anything since 2006, is this not statute barred now and if so why have they sent a statement for the first time since 2006 but not asking for payment, am I supposed to write to them and say why are you sending me this statement, don't know anything about this account ??? Help please.

  24. Yes I received a letter on Saturday from Marlin too, saying they have taken over my Egg credit card debt and to get in touch, I haven't heard anything from Egg since Sept 2006 until now??? Do we all just ignore them? Any help advice please??
