  2. Had my letter today from nationwidetelling me that they have refunded me the money. just awaiting £795 in interest and court costs now. They told me it would be in my account tomorow. So I guess that is me finished. Good luck everyone else. Just stick with it. I didnt use the correct method and they still paid me before the deadline.

  4. I off of to China for 3 weeks - I got married out there in November and I am going back for the wedding ceremony. I will post a picture if anyone is interested. getting this money back is going to make such a difference. I will make a donation via paypal when i get a chance. Things very hectic at the moment. Thanks for everyones help and support. I hope that everyone else due in the next few days will be as happy as me at the moment.
  5. Thanks guys, I was so relieved, have got my wedding ceremony on May 2, and have been preying that it was paid before I go. The 28 days were up on the 28th, so I have been fortunate I think. It was a nerve racking affair for me because I didnt send a prelimary letter, and in my LBA i asked for all my charges over the last two years and explained that I reserve the right to claim for any further charges going back 6 years at a later date, or to add them on to this claim when the information is available to me. It obviously worked, but I would definately reccomend following the laid down proceedure as reccomended by all the wonderful people on this site. If anyone is interested i will post my letter as a template if any one is in my position. Just got back from celebrating with a friend. Stick at it and dont feel intimidated. You really have nothing to lose. :D

  7. YES, YES, YES Just thought i would check my account on the off chance and I have just found 3 corrections of £999 and one of £630. I guess that is it, just waiting for the interest. I am so happy now go on holiday on Friday. All you folks who had their claim served on or about the 31st March - keep checking your accounts. :D :D
  8. I believe it is deemed served about 5 days after it has been issued. The deemed served date should be on your notice of issue which will be sent to you by MCOL. They then have 14 days to acknowledge, if they do that within this time they then have 28 days from the served date to issue a defence. I hope this helps - i could be wrong but this is what i have been told by all the helpful people on here.
  9. Thanks for the info, mine was deemed served on the 31st March, so I guess I am about a week behind you. My calculations give them until the 28th April. I am travelling to China on the 27th for two weeks to get married, so the money will be very useful. I guess I will have to keep an eye on my online banking then. I am claiming about £4500 in total. So i guess you never got the chance to file your AQ?

  11. I dont suppose it is in their interest to demand the overdraft back until after they have paid out because they would hope that the payout would clear it. I have heard that they pay out and immediatly tell you that it is withdrawn.
  12. Hi Shychris, you might find that there defence is " we have paid the money". You might well find that you are paid next week. Because we all know that they have no defence. I have every finger crossed.

  16. Hi folks, I am just curious. Has anyone tried to claim back the interest lost on the savings rate on their accounts. I am not sure how you would do this, but surely if you have money taken out of your account you would be earning more interest if it had not been taken away.

Both of these calls were received by me when I was at work. And at that time I had not received any details of the above account in writing. I am of the view that you continue your harassment of me by telephone, it puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997. If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Please find enclosed a request for a copy of the CCA in relation to this account. When I receive a copy of this document I will contact you further. I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of my credit agreement on request. I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act. I understand a copy of my credit agreement should be supplied within 12 working days. I understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.   19. Allied International Credit - Phoning me up at work - before I had even recieved anything in writing
  20. Hello there, Would really like some advice from you folks if possible. A bit of background first. I had an amex card with a balance of about £6000 on it, because I was only making the minimum payments, they said that due to a revue they were withdrawing my facilities. I have been making the payments and have explained my situation to them on several occasions. the day before yesterday i was phoned up by a DCA called allied international credit, saying that my debt had been passed to them and they were demanding immediate payment of £6200. I was a little suprised by this and told them that i had allready paid off £750 of the account and asked why it was up to this amount. They toldme that a referal fee of £950 had been added and that i now owed them that amount immediately. He then started asking me lots of personal questions about wether I had a car and various other things. I explained very calmly that I hadnt had anything in writing yet and that I didnt agree that the adding on of the £950 was right. I also explained that because I hadnt had anything in writing I was uneasy about answering these questions when I was at work and at a disadvantage (I work on a building site), and that matters like this should be discussed when I have had time to review my situation and had all my documents at hand. He also rung me again and I explained to him that I still hadnt had anything in writing and that I didnt want to discuss anything while I was at work, and in front of my work colleagues. He then started to say things like " its because you didnt talk about this that your in this sort of situation" I replied " with all due respects I dont think you should be saying that sort of thing because you dont really know all the facts, and that I am happy to discuss the matter shortly because I am discussing the matter with a debt management company, and I will get back to you as soon as possible" He then very agressivly said " are you going to pay up or not?" " I replied " I cannot discuss that at the moment until i have had some advice from an expert" He then snapped " Well if you want to be like that, I tell you know that I am actioning the court action now" and slammed the phone down. When I returned home the letter was there and i am due to speak to the debt management people tonight" I dont know if I am right but surely they are being a bit out of order here, but surely I must be given a chance to seek advice before making any promises. Any input would be greatly appreciated. Thanks in advance
  21. I have just managed to open a step account with Nat West. Just like my old one with Nationwide, but without the cheque book, and without any overdraft facilities. The up side is that you get a debit card (Solo I think). Hope this helps. Bob

  23. Hi there to one and all. I have been reading over this forum with great interest over the last week or so and am about to embark on claiming back my charges on a nationwide account. What has been really annoying me lately is when the bank returns DDs when your account shows a credit on the same day as they they refuse to pay. Even though I am free to withdraw from the atm on the same day. Very sneaky to take the debits out at midnight and dont put the credits in until banking hours.!! Well, I was out of work for 3 or four months about 2 years ago, and am just started to recover. It is certainly not made easier by the bank who seem to actively causing the two steps forward and one step back, shuffle that people in the same positio know only too well. Over the last 6 years i estimate they have charged me over £3000. So good luck to everyone in the same position, and thanks to all the contributors for showing everyone what can be done.
