Thanks gizmo111, i was planning on just sending the cheque back and just carrying on with my claim, the only thing is i'm still a bit confused with the process actually, because my claim is for £2200 then another £400 for interest which comes to £2700 but her in scotland the small claims courts max is £750 so do i go with the ordinary clause which i think involves a solicitor? can anyone give me any info on this process before i carry on? Thanx J
  2. Thanx for the info guys! think thats wot i'll do. If i do it this way and accept part payment ( if all goes to plan) then i'll be able to issue them with a summary clause and there for no need for solicitors, is this right? I'll def NOT bank the cheque tho, just incase. Jo
  3. Thanx so much michael! Really wasnt sure what to do. Do you think the banks likely to back down tho? I'm a bit worried incase i dont win my claim in the courts and then I'LL be due them money?

Hi all! :confused: Can some one who is or has been in a similar situation with the clydesdale bank please tell me what to do, as the bank has now sent me a cheque for £1123.76 which is only half the amount i've requested? This doesnt include the interest. Although i have sent them a copy of all the charges plus interest which come to a total of £2700, which is alot of money to lose. Is there a chance i could get the full amount or even the amount less the interest? PLease help not sure what to do next? ( although i am very tempted by the cheque but i think thats there ploy to sway me to take it!! ) Any help greatfully recieved!!! Thanks J

  6. Hi all! Can i just say wot a brill forum this is and how helpful!! Thanks to you all!!!! Although can help me? I'm in the process of claiming my bank charges back from the clydesdale (scotland) and am @ the stage where i'm about to send LBA letter, but i've just come across a couple of statements which have charges on them in which i havent claimed for! ( i thought i had gone thru all my statements but these must have been overlooked, stupid idiot that i am!!) can i still claim for them when i send LBA or not? Also my charges are £2317.52 plus £424.33 intrest so do i file under Ordinary Clause or can i do a summery clause by claiming in 2 amounts? as the amount i'm claiming is more than £750 so cant go to SCC. Your help would be much obliged!!!! Thanks again! J
  7. Ok thanks, well my husbands in the forces down in england, so can i use his barracks address then? How do i go about that then if i've already started a claim & asked them for the last 5 yrs and another thing i sent them the spread sheet calculating the interest on it with the 8% & sent it to the bank:( so i now realise i've done this wrong. According to wot i've read so far on this forum, u dont do this until it goes to court. So have i made a big boob? Jo

If i'm claiming back my charges from the clydesdale bank here (scotland) but all the corresponance is coming from leeds well does that mean as it's an english company thats dealing with it, that i can infact claim back 6yrs charges (in england) rather than the 5yrs (in scotland)?   10. HI there to you all! I new to this posting & wondered if any1 can please help me? I sent my letter to my local branch the Clydesdale bank here in scotland, 2wks ago & got a reply back from the clydesdale bank (yorkshire bank) in leeds which i was abit surprised @ as i thought i would get a response from the their head office in glasgow! any hoo i got a response from them saying " we're dealing with your compaint & will hope to get back to you shortly"!!! My first Q's was " well how longs shortly?" their 14days are up and i'm not sure wot to do next, whether to send LBA letter or just w8??!! Can anyone help PLZ???!!!!!!! Thanx Jo x
