  1. Hi all, I've wrote a draft up using the template for court proceedings. I thought I'd send that in complaint form to Halifax before going down the court procedure. Massive favour; could you please read though it and let me know it is okay? I'm absolutely rubbish and this sort of thing, and it is probably rubbish but any help would be massively appreciated.   2. Hello, Just a quick question. I am drafting up a letter to Halifax under BCOBS. Just to confirm: Once that has been sent directly to Halifax, I, at the same time, send a letter to 1st credit to say the account is in dispute... Is that correct? Thanks

  4. I know this is an old query but there's been some progress and I would really like your help on this please.... I wrote to them with a template I used here to have the charges removed for financial difficulties and to have the default removed. They have agreed to refund the charges but not remove the default. They again wrote to my old address so it was only after when I chased them up for a reply that they have finally after 3 years updated their system with the correct address. They are in the process of buying back the debt from dca and will apply the refund then hand back to dca. I am yet to receive this bill. My question is, they are refunding charges back to the date that the account was used correctly. i.e., no late payments. so if they are refunding this as a gesture of goodwill due to financial difficulties to go back to the point the account wasn't defaulted... can I get the default removed? Thanks in advance
  5. Hi, I hope somebody can please advise me. I opened a basic bank account with Halifax in September 2008. They upgraded my account to a current account which was an ultimate reward account a few months later. When the new overdraft charges were going to come into effect, I wrote to them to cancel the ultimate rewards account back to a normal account. As I knew this would cause me to go more into debt as I regularly go over my limit. They didn't cancel the account and continued to charge me 12.50 each month till they finally closed the account in February 2010. I was dumb not to check the account had been changed. I had a 300 overdraft on there, and with the monthly payments of 12.50 and overdraft charges this has gone up to £582. Of course I owe 300 and in all honesty would consider paying it all off but they have now passed my information to a DCA Iqor who have passed it to Jefferey Bourne solicitors. Basically, what I would like to know is, can I pay back just the 300 and if so how do I go about this? And, as there is a default on my credit file, which would not have been put on if they did not continue to take fees and charge me for going overdrawn due to these fees can I try to get this removed? I still have copies of 3 letters I sent to them. Thank you in advance

  7. Hi tomterm8. They have added about £50 of interest if I do not reply. Are you sure, tomterm8, they won't file for bankruptcy, I dont have a mortgage I live with my dad, I don't own this house its my dads. Thanks
  8. Okay cool, thanks nicklea. I'll go to court on Monday, am just on way to post SAR and the rest. Thanks for the link as well nicklea, its all very interesting reading, and quite scary how easily the DCAs can apply to make you bankrupt, especially since it doesnt look like a legit letter and arrives in the 2nd post, it could be so easy to ignore.   10. Hi nicklea, Thanks for your help but I am getting slightly confused. Let me just go through what I have to do and you can tell me if I am completely wrong, which I most likely am!! I send an SAR to bank, and an account in dispute to capquest, also file the set-aside forms at the local court. Can you please explain where do I send your letter, I really don't understand what its for. Sorry to be dumb.. Thanks:)
  11. Hi boyboynova, Thanks, I have downloaded the forms, they are petty straightforward but can I just ask for help on form 6.5. Section 2 on that form asks me to pick one of 8 suggestions why it should be set aside, I'm assuming its the first one but what do I put for the reasons? The first one is: Do not admit the debt because........? Thanks in advance for your help

  13. Thanks for getting back to me.. there is a court name on the letter, does this mean anything? If I send a S.A.R to natwest then do I send a seperate letter to Capquest saying it is in dispute and will this stop the statutory demand? Thanks again for your help
  14. Hi, Hope somebody can advise me on this. I had a student account with an overdraft with nawest that I defaulted on in 2005 for just under £3000, and didnt hear from NatWest at all till earlier this year I got a letter from crapquest saying they have bought the debt and I ignored the letter, I know I should have sent off for cca, but I didn't really get round to it. I have to admit when they first sent me a letter i rang them up and arranged a payment plan but then i had to cancel the direct debit and have not made any payments to them. I have now received a statutory demand from them first class, dated 29th April and the letter accompnying it is dated 30th April. Please can somebody advise me on what I should do, should i ring them to arrange a payment plan, I honestly cannot afford to pay this in one go. i think some of this ovedraft will more than likely be charges but I have not claimed those. I hope you can help Thanks

  16. hi iam new to this site and so pleased to see so much advice on here, but please please can someone tell me what i am supposed to do to claim my charges form lloydds tsb!!! i sent them £10 in july2006 and the have sent the money back to me 4 times and the letter is stamped as unknown address!! I was given the swallow house adress in birmingham. first i was asked to add the po box number (139) then take it off and vice versa!!! when i speak to them on the phone they send me on a wild goose chase and now i have discovered this web site. please tell me:- 1. Do i firstly get my statements to see my bank charges? and if so who from? 2. Do i send any documents with my request. 3. please help i dont know what to do this bank has been screwing me for years and i want to repay the favour. fairy 123
