  1. this is very reassuring as i am about a week into my LBA period and am about to start the court process. Will someone who is just about to go to court PLEASE!!!! post as soon as they get a result to aleviate, us fellow lloyds claimants, our fears! BTW, mbna just settled when i sent them the LBA so all not lost yet!
  2. Just a though......just about to send my LBA. thing is there are more charges since i sent the first schedule. Can i add the new ones to the original schedule? Anyone got any ideas? Please help!
  3. hi all, I have just received a response from Lloyd after my first letter stating that they dont agree with the OFT's thinking on the issue and they are currently "talking it through with the" They have ssiad that i can complain to the Financial Ombudsman Service if i like and also that they see their charges as 'fair' when i signed up to the account. like i read somewhere, bit like someone telling you they are going to mug you then saying its legal anyway because loads of others do it! I take it this is where i send the LBA to them saying that i will raise a court action?

    just got 2 letters today, 1st one saying they are looking into complaint and the second....surprise surprise" we do not agree with what you are claiming"!!! firstly they are saying that the amount i am claiming is more than their records show(will recheck that), secondly they are only offering about half the amount i am asking for.But they will only put it in my account if aggree to this settlement. this they say is the difference between when they charged me £25 and the £12 they charge now! so they are only offering me £13 off the original £25 charges BUT none of the £12 charges. what they fail to realise is that in doing this they are admitting they are wrong, even if they try to preclude it with the "as a good will gesture" statement. Also there is no breakdown of the costs. they say they will keep the complaint file open for 8 weeks(which mbna did) How do proceed. I want to reject it and continue, they still have about a week until the deadline of my first repayment letter. Is there a rejection letter i can use? can someone give me a link to it please? thanks all in advance for any help.

Well, the very nice man at the post office delivered 6 yrs worth of copy statements, all in individual envelopes the other day!! he had a whole van to himself and my statements i think!! totted it all up and lloyds now owe me £2917.00 recorded delivery letter went off on monday asking for it back, so lets see what they do. i actually added a bit on the request letter about the data request being in language that was understandable to me and they did put in a "key" as to what the abbreviations meant. Not happy that one employee is able to put that i "stormed out" when they acted incompetent on the day in question as notes on my bank records!! Regards all and good luck all!! Neil

    hi, there are already interest charges on the statement for cash advances and these are labelled as cash advance charges. the thing that really got me was the fact the "advisor" had no idea what they were and neither did his supervisor or the other person he spoke to whilst i was on hold for 10 mins. i think i'm going to go with accepting the payment as a part payment only.     hi again, yep, i am going to continue as they owe me! they sent me back a copy statment of all transactions and also refunded my postal order. they then said that they have credited my account with £260 as settlement. this is the confusing part as i have not asked for anything back yet!! i am going to ask for the rest but am wondering how to put in a letter. do i just use the template letter for repayment and just alter it a bit to say that i accept the £260 as part payment only and request that they pay the rest? Also on he statement there is amounts for "special interest". what is this? i asked an "advisor" on MBNA telelphone number and they didnt know!! i think it is extra interest on the fees for when i went over my limit, thing is, i wouldnt have gone over my limit if it wasnt for the fees!!! regards, Neil threads merged Please keep to the one thread for each claim .This is for your benefit as you will recieve much more informed advice if people can see at a glance what you have done so far Thanks

    hi, sent data request letter to mbna. they sent all back but also they credited my account with £260. as full settlement before i sent request for repayment. this was about half what they took what do ido now to get the rest? Neil

    i am working out the charges to claim claim back. what rate of interest do i ask for? Or do i only ask for interest at 8% when and if it reaches court? I`m a little unsure. Neil

    hi all, great site by the way. just got back a letter from MBNA, standard "we are investigating further blah blah blah". All i sent was the access letter so presume this is their standard stalling/ nice type bully letter trying to get me to back off. this letter doesn`t extend their time frame of 40 days does it? Neil.

    thats great, will do in a"quiet moment" in the evening!!! Also, all they have sent is copies of the staements. As i sent the first template letter, should they have sent me anything else?

    hi, just got letter and copy statements back today from Skycard (barclay card in another guise). bit more daunting when it actually shows. do i just highlight the charges and send back with the next letter. Another point is if the charges change in amount, ie they are £25 then go to £12, this around the time that the charges were deemed to high, can i still claim for the new amount? Also,i cant see how, if i am over limit, but make a payment that doesnt bring me back within the limit, that i can be levied a charge, its not like i`m not making payment? the over limit charges are mainly the ones that got me in trouble in the first place and these were always more than the payment i was making, easy to see how, when you are over a barrel, that you end up in trouble. sorry for rambling at the end of this thread, but i need to speak to like minded people, not some mong in a foreign call centre!! good luck all, Neil lloyds SAR sent, 5/2/07 skycard SAR sent 5/2/07 statments received 17/2/07. MBNA SAR sent 5/2/07, blah letter received 16/2/07 (poor them the clock is ticking!!!)
