  1. another day passed, nothing in todays post, nothing put into the bank account, day in court is looming.
  2. Hi Gavin, I'm taking on BoS, I got my charges and court fees back but they didnt cough up the 8% interest, so I'm due in court on Thursday to get that back too.
  3. confusing isn't it? I have had letters from bank of Scotland, but final letter came from Halifax.
  4. Letter in post, recorded delivery, to let the bank know the claim is not settled and is going to call in court this Thursday (22nd June).

  6. Nothing from BoS, I have just spoken to Sheriff court and the case is calling on Thursday as planned. It will be up to the judge whether or not they pay this 8% interest. I think I need a buddy ! I will write to BoS tomorrow to let them now its going ahead.
  7. I have written to them saying that the claim is not settled until the 8% interest is paid. Have you notified the sherriff court that the claim is not settled?
  8. i used Head office address in Edinburgh on my claim. Settlement letter came from Halifax PLC, Leeds.

  10. still nothing from HboS re- outstanding interest, they have told the sherriff's court that the claim is settled. I guess my concern is that they have not received my letter, considering faxing a copy through to them to make sure they have received it (should I have sent it recorded delivery?). Return date is this Thursday 15th June, and calling date is 22nd June.
  11. I followed Scotia's template, see here... http://www.consumeractiongroup.co.uk/forum/showthread.php?t=6165 got my refund within days of claim being served (BoS), but without the 8% interest, which I am now chasing.

Sounds a stupid question but is Bank of Scotland a Scottish bank? my claim went through branch level to Head Office in Edinburgh against whom the small claim was raised, but the letter about the settlement came from Leeds. I would be delighted if I could get the rest of my charges refunded in one fell swoop under the English system rather than having to repeat the small claims here in Scotland another 3 times.
  13. I wrote to HBos thanking them for their part settlement but stated I would consider the claim settled once the outstanding interest was paid. Letter was sent 29th May. No reply yet, just phoned Sherriff court to confirm return date and hearing date, Bank have sent letter to them stating the claim is settled ! Wondering what to do now, do I send another letter to BoS, recorded delivery this time to make sure they get it? sit tight, do nothing and assume they have received my letter? Sherriff court said to phone back day after return date 15th June. p.s. how do I get this thread merged with my original one (newbie...hand-holding) and get the title changed?
  14. I have had £35 charges on my HBoS account, on the print out that the bank kindly provided they show up "unpaid item"
  15. I know the mods police bank activity on the forum, but I have found several times that I have deleted replies to posts as I feel we are being watched. Once a litigation has started, someone (read 'bank employee') can identify you by your claim number and trace you to your account, and follow your threads, replies advice etc. Once my claim was served it was partially settled very quickly, suddenly monies were in my account, highlighting what ready access the banks have to it, to give and to take away.... or am I just geting paranoid ...? (cue wobbly music)
  16. My first claim, which is partially settled (8% interest has not been paid) was for charges in 2000 -2004. nowhere along the way has it been queried by anyone, bank manager, customer service, sheriff clerk.

  20. I've had success against BoS, I did have to issue a claim against them. Still need to repeat another 3 times to get full amount.
  21. This is what I am going to do, I just want to be sure that I had filled in the claim forms correctly.
  22. yes, claim had been served, letter states they were going to defend but on commercial basis of cost to them they are reimbursing charges and court fee, settling without admission of liability. Monies have already been paid into my account, but as I say there is no mention of the 8% interest claimed (£209).
  23. I used Scotias as a template, wording in box 4 "The pursuer claims from the defender the sum of £740 with interest on that sum of 8% from the date of service of each charge (together with the cost of bringing the action)"
