  2. have a look here to see if this is any help Bank Charges: Reclaim them, they're unlawful, get up to six years' money back... Fruity x
  3. Hi Leyla, if its any help I have identified the different charges as: Paid item £30.00 Unpaid item £39.00 unauthorised use of overdraft £28.00 however on my previous claims many of these were entered on my spreadsheet as 'charges' HTH Fruity x
  4. Martin Lewis has a section on the FOS on his moneysaving website here: Bank Charges: Reclaim them, they're unlawful, get up to six years' money back.... HTH
  5. I have a third claim underway against Bank of Scotland. I shall be following the summary cause route this time if necessary, although I am still going to have to make a fourth claim to get it all back.
  6. Thanks Roadrunner. its such a pain having to make multiple claims. I keep hoping they will just settle in full each time, but both previous claims I have had to raise small claims so it costs them more as they then have to pay the interest and the court costs.
  7. Here we go again! Finally pulled my finger out and got round to sending off my prelim letter (recorded delivery) yesterday for the outstanding charges on my account.
  8. Do you think they move around en masse? coz the lot outside Aberdeen Sheriff court where very intimidating!
  9. What I did.....preliminary letter asked for full amount back, enclosed spreadsheet showing charges and dates, but not interest. LBA, Letter Before Action, asked for full amount back, enclosed spreadsheet etc.as above. In conversation as a result of letters, indicated that would be severing claim and that each claim would include 8% interest. 1st claim: filed small claim for £740 plus interest and costs, spreadsheet including days since offence and 8% interest, got £740 plus costs but not interest. 2nd claim: filed small claim for £629 and 8% interest plus costs (worded claim differently) spreadsheet including days since offence plus 8% interest, got £769.15 3rd claim about to begin
  10. good idea, nothing to lose but £200 odd to gain Thanks EKELSEY
  11. brief reply 'cause I've had a cider or three and now quaffing vino: 1st claim against BoS claimed for £740+8%interest+costs got £740+costs hearing+unsympathetic sheriff/crossed wires payout stands at £779 no interest. 2nd claim against BoS £629 charges plus £101.15 (8%) interest Total claimed £730.15 plus costs settled. once I have notified sheriff court of settlement its on to claim 3
  12. Hi DB sorry not have picked this thread up before, wont answer much now as on the other side of a couple of ciders and now onto the vino! Well done so far will get back to you as I pursued BoS to hearing for my 8% interest and got unsympathetic sheriff and probably crossed wires. Cheers! Fruitycar
  13. Just had my 2nd claim against BoS settled and once again the settlement letter has not asked me to sign 'in full and final settlement'. Is this an oversight on their part or standard for BoS?
  14. Got another £1639 to claim back, which would be 3 small claims or 1 summary cause + 1 small claim or as you say MCOL. Not sure how it would be having made 2 claims under Scottish system to then go for an English claim. My hope is that when they receive next prelim letter asking for the full amount they will just cough up, will save them paying the interest and costs. You have to wonder why when they state in their settlement letter that it is not financially viable for them to defend, they go all the way to the claims stage and have to pay out interest and costs when they could just refund the amount asked for?
  15. I thank you, (sweeping bow) and yes there is more to come... time to start round 3, when do you think they will get the message? Gargoil, the monies were paid direct into my account.
  16. Despite no paperwork from Sheriff Court (will have to phone tomorrow) letter from BoS on Saturday plus deposit in account of £629 charges refunded plus £101.15 interest plus £39 costs total £769.25
  17. "12:04 Money Box 9 September 2006 Could banks be forced to cut overdraft penalty charges which the Office of Fair Trading says may be illegal. The Revenue asks three million people to pay more National Insurance, but then says they should think carefully before they do. Plus, Bob Howard investigates why people with good financial records are being pursued by debt collectors. All this and more. You can also visit the Money Box website for further information, to have your say, and to listen again."
  18. Yes I also included it in my particulars of claim. 'The Claimant claims from the Defendant a sum equivalent to the amount unlawfully debited from the Claimants account from xx-xx-xxxx to xx-xx-xxxx along with 8% interest for being deprived of the use of these monies, along with the costs of bringing this claim' So they should pay out charges plus 8% plus 8% judicial interest plus costs.
  19. You are correct, the Small claims limit is £750, Summary Cause is for amounts £750-£1500 but carries more cost to you if you lose. You can sever your claim in to £750 chunks, by date, or by type of charge or any other suitable division you can think of. The choice is yours whether to sever or go summary cause. You can request your full amount of charges back in your preliminary letter and your LBA and then submit a claim for upto £750 small claims, then go back and start again fot the remaining amount when the first claim is settled.
  20. Some forum members are including the unauthorised o/d interest in their charges and others are not. I have chosen not too add this in, as I pointed out to the latest bank employee that phoned, I am not denying that the bank have costs for sending me their computer generated letters, just that they are not £30-35 or more. My argument is that if we reach court stage, I can show that I have been reasonable in my claim.
  21. You can ask for all the information in one go for all 3 Accounts for £10 fee. You dont have to act on all of them all at the same time, maybe do the closed ones first and then the active one.
  22. my trip to court was unsuccessful. Under Scottish law the 8% paid out on a claim is judicial interest, i.e. 8% from the date of service, hence my inclusion of 8% as part of the claim.
  23. My first claim against BoS was from 28-07-2000 to 05-01-2004. I started it before the 5 year limitation in Scotland was brought to light on the forum. The date was never queried at any point, even once it got to small claim stage.
