  1. Hello, Yes I am relieved. They left it until the last minute to refund my charges as the court hearing was due on the 21st feb! They seem to want to make you sweat so that you give up, and admittedly I was getting nervous but I hung in there so please do the same. The money was put into my account as a refund of charges so they haven't closed my account either. Good luck to you Donna

  4. Hi all and merry xmas, I have recieved my court hearing date for the 21st feb. As i have got myself in rather a pickle up to this point with previous documents I thought I would benefit from some help with my statement of evidence. Basically i am not totally sure what to write. Is there a template on the forum I could use? I cant afford to get this wrong after having to send in an amendment for my particulars of claim (and sending in the form without the actual amendment on the first occasion!). So if anybody could give me some pointers I would apreciate it a great deal. Thankyou Donna
  5. Hi everyone, I have received a letter today with a copy of lloyds Allocation questionnaire. The solicitors are asking me to acknowledge the receipt of this and send them a copy of my Allocation questionnaire. However as i simply sent it to the court without copying it I do not have one. Do I need to try to get one from the court? Am I required to confirm receipt of this? or are they just making life difficult for me? if anybody could advise on what to do i would be very gratefull.   6. Thank you Stadium A, I am afraid i cant even be sure of the year as it could be 11,12 or even 13 years ago. I willl have to take a trip into my branch as they wouldn't tell me over the phone. Its frustrating that these little things are delaying everything but thanks to all your help on this forum we will get there! One day!
  7. Hi Da2k, Are you sending the 2 copies of the schedule of charges to the courts? or are you sending a seperate copy to lloyds solicitors? Im uncertain of what to do here! I feel the same as you that i dont want to risk any small mistake they can use in a defence. Why do they have to be so picky, darn bank

Yes Pete the 8%, I thought i better check as i dont want to be sending in another amendment! lol I will be glad when i have got this sorted out but ive got to go into my branch to get the date i opened my account as it was over 10 years ago and they wouldnt give me that information over the phone! thats why i didn't put the date on my POC but as lloyds want to be picky I guess we have to jump through a few hoops! On the phone I said it was for a mortgage application but alas they just dont want to help me the rotten bank. Oh well Im getting there. Thankyou for helping me along the way ;-) Donna
  9. Hello again Pete, sorry to bother you again but i have one more question. I have completed everything ready to take into court but i am not sure which schedule of charges list to take in. I sent the bank my list of charges with the interest calculation omitted as recommended in the forum. At this stage do i now need to submit the one with the interest total added? Also member Da2k posted the exact same defence as i received today, so i was able to share your advice and you have helped someone else with this situation. Cheers, Donna
  10. I haven't filled in my N244 yet but I was advised to attach the particulars of claim as a separate document. Along with the list of charges. In part C explain why you are sending the amendment ect and take everything along to the court with the £35 fee. I need to find out when i opened the account, it was over ten years ago and havent a clue but aparently that should have been stated on my particulars so i need to get that information before i can even write an amended version! This set back is so annoying, I hope your having more luck than me with it

  12. Da2k, I did include my account number and still recieved the same defence as you. I used moneyclaim online and so could not attach the list of charges. If you read the other thread of mine you can see how to amend it as i got advice from another member. It costs £35 to amend it though! Im not atall happy about the situation but guess we have to do that? what do you think? maybe we could send in the schedule of charges with the allocation form?
  13. Hre is my particulars of claim, i copied it off the forum but if you look at my other thread concerning this you can see that another member thinks i should send an amendment in? Claimant has account XXXXXX with Defendant conducted on their standard terms and conditions. During the course of the operation of the account the Defendant took £972.00 in charges. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e. In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant is claiming the return of £932.00 taken by Defendant in charges over six years. Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from 01/06/2000 to 29/09/2006 of £230.00 and also interest at same rate up to the date of judgment or earlier payment at a daily rate of £0.21.
  14. Hi, I recieved the exact same defence 2 days ago! it is the same as yours word for word! I posted my particulars of claim to be checked on the forum so if you look at my other posting you can see what another member wrote about it. Im thinking of submitting an amended claim but now i know they have sent the same defence as standard to you i am not so sure. if you could read my other posts and let me know what you think i would apreciate it. maybe compare my POC to yours and see if they are similar?
