  1. I Had a settlement offer on Saturday and the money was in the bank today with no conditions imposed. I did open a fall back account to be on the safe side but never had to use it.
  2. They don't normally contact you at all. Once your claim is acknowleged it would have been handed over to DG solicitors. They normally enter a defence one or two day before the deadline... The court should have or will be sending you an acknowledgement pack over the next few days, it never hurts at this stage to send a copy of your breakdown of charges to DG Solicitors. 12 Calthorne Road Edgbaston Birmingham B15 1QZ Once they have filed a defence they you normally have an additional 14 days to submit your Allocation Questionaire.

  6. It's about time the banks had a taste of thier own medicine, for too long they have had a easy ride charging what they want when they want. I read the below in the Sunday Miorror last week, it looks like people like us are going to cost them billions    BANKS are on the brink of having to pay out £30billion to thousands of furious customers in the mass revolt over unfair overdraft fees. Growing numbers are threatening to sue their banks in a grass-roots rebellion which has already generated £20million for triumphant account holders. By the time refunds are claimed for the last six years - the legal limit for backdated claims - the final compensation bill is expected to be nearly £30billion. Complaints against excessive penalty charges, which rake in almost £5billion a year for the high street giants, have hit record levels. In the last year the number of people complaining to the Financial Ombudsman Service has soared from an average 60 a week to 7,000 a week" Marc Gander, of the Bank Action Group, said: "Our records show 5,146 people have recovered more than £7million over the last year. But we reckon this represents only 35 per cent of the total amount which is probably nearer £20million. They'll be another story in this weeks Sunday Mirror. This is going to include step by step instructions on how to claim back bank charges... so yet even more cases hitting the courts LOVE IT!!!!
  7. I personally didn't send that but i know people have... I'm of the impression that you only need to submit additional information to the courts upon request. The 'particulars of the claim' is normally enough information to get the ball rolling.
  8. I filed mine online so i didn't have to send any copies to the courts but have found this for you "If you are starting your claim in this way, be sure to make 3 identical copies of the form - 1 for you and 2 for the court." for further help look at http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/31460-step-step-instructions.html it's a great step by step info pack
  9. You sit back and wait. The bank will have 14 days to respond... Normally they will acknowledge the claim giving them an additional 14 days to submit a defence... It's a waiting came now, but the fun part has started. You’re fighting back!!!! I'm just submitting my Allocation Questionnaire (AQ) so I’m a few stages in front of you and we all feel nervous about the unknown, but trust me everyone on this site is going through the same things and there is an endless supply of information and help at your finger tips. GOOD LUCK!!!!
  10. Recieved my allocation questionaire which is not due until 25/02/2007, do I now send copies of all the charges to DG or do I do that later... bit confues on this section, does any one have any suggestions. Should I be phoning DG and telling them anything at this stage?????
  11. HSBC have entered a defence today, haven't seen all the details yet but noticed the status of my case had changed on MCOL. Another delaying tactic by HSBC I'll look forward to seeing the post when i get home The Sunday Mirror are running the story this weekend and gave a few interesting quotes in the paper on 4th (listed below) so I i'll be faxing a copy over to DG first thing monday just to give them a slight kick in the right direction "BANKS are on the brink of having to pay out £30billion to thousands of furious customers in the mass revolt over unfair overdraft fees. Growing numbers are threatening to sue their banks in a grass-roots rebellion which has already generated £20million for triumphant account holders. 12. Just phond the normal 08457 404 404 and spoke to the customer service department, took me about 20 minutes to get a positive answer but held strong and insisted on them refunding as a 'good will gesture' due to my ongoing court claim. If you don't get what you want from the call centre agents always ask to speak to the manager/team leader/floor supervisor they normally have the authority to refund upto £125 there and then.
  13. Had a phone call from Sunday Mirror today and they are going to follow the cases of five people that are fighting the bank against unlawful bank charges. They have interviewed me and are coming round friday to take pictures ready for a report that will be featuring in the Sunday Mirror over the next few week. The more media interest in this fight the better... I've made a point of telling the papers how useful this website is and what a great reference point it can be in winning the fight again the hugh street bank. I'll keep you updated on when the article is going to be published. 7 days and counting for HSBC to submit their defence or i win by default WOO HOO!!!!
  14. Spoke with HSBC this weekend about addtional charges they applied to my account this month. They very kindly agreed to refund this amount as a "Good will gesture" as i explained I was already taking them to court about the past 6 years of bank charges. They also informed me which i thought people may or may not know they are INCREASING there max charge per month for overdraft charges from £125 to £150 I guess they are trying to reclaim some of the money people are successfully winning from them.
  15. just sent a gentle reminder to DG that they only have 14 days left to settle or submit evidence.... Need to do something tired of the waiting Is there a way to push DG to make a decision or get them moving... Any suggestions?
  16. Just sent a fax to DG to give them a little nudge, sent them a spreadsheet and a copy of the letter I sent to HSBC just to remin them they only have 14 days left before I start judgement... Is there any way you can move them a long a little or do they tend to wait until 28 day dealine expired and i have to fill out a AQ thingy
  17. I've sent them copies of all the chargse and i'm just waiting.... Only realsied a few days ago that you actually had to send something to them. My claims been acknowledge and the 28 days expires on 10th feb... Playing the waiting game like 100's of other people...
  18. As far as i know you cannot add additional amounts to a claim already submitted... I have read other comments that say contact the bank direct and advice them you are taking action with the courts about past bank charges and you will pursue this one as well... My wife did the same and they refunded her current months bank charges back
  19. Hi Flunky I'm a few stages behind you but have done some research into the AQ form have a look at this thread, it gives great help and advise on what to do http://www.consumeractiongroup.co.uk/forum/bank-templates-library/11644-allocation-questionnaires-guide-completion.html Good luck!!!!
  20. Cheers maleo feeling more and more confident as time goes by.... it's just the awiting game that kills me... checking my back account about 40 to 50 times aday so see if the money's back on and as for MCOL the refresh buttom on my key board has warn out.
  21. Hi nettyg Just been reading through your thread.... It's a crazy ride that everyone is on, it is so reassuring reading everyone else has the same worries and concerns as me.... Felt like mine field when i first started but it's all becoming crystal clear after reading pagse and pages of thread. Good luck with your case, it's time to make HSBC suffer
  22. Hi all I'm one of the many thousands of people fighting back against the high bank charges. I have already successfully claimed back £850 of a £950 claim on behalf of my wife and am still fighting to get refunded my £3611 in charges. This amount has now risen to over £4300 with 8% interest and court cost. The bank as now acknowledged my claim and has been given the 28day to submit evidence, which ends 10th February 2007 Like many people I've never had the know how or courage to take on the banks, but I'm loving the whole experience, with help from sites like this, the money programme and the endless resources available on the internet. This is one fight the common man can finally win. I'll keep you updated with my success
  23. Hi KealeyKeel I'm new to this as well and also dealing with HSBC. I have been fighting against HSBC charges for years and never had much success, like you I have found sites like these amazing in clearing the fog that surrounds reclaiming bank charges. I am also one of the success stories. I received a payment of £850 no strings attached from HSBC early January for my wife’s account. I then received an offer on my account for £3200 no strings attached which I declined. HSBC seem to follow the line of. It will cost them more in time to process your claim than to make you an offer, and seem to prefer settling smaller claims at the earliest moment. Hang in be tough and make sure you get back what you are entitled too. Most of all BE BRAVE! Every case is different but there are people all over the country getting money back!
