  2. I havent contacted Barclays yet. Just found this link that provides further information. http://www.hmcourts-service.gov.uk/courtfinder/forms/ex321_0406.pdf Ill call them tomorrow morning and hopefully reach someone who knows what they are talking about. The options I have a; to ask nicely for what is rightfully mine b; play hard ball and go down warrant of execution route. Has anyone else been in this situation? What did you do? What were Barclays actions?

Call Barclays? Notify the court? Send in the bailiffs with local press in tow? Ill of course be donating £50 to this site for all the free help I've received so thx to all ...
  5. Hi Everyone So here goes with my story and as always any help and guidance would be appreciated. I sent my claim letter to Barclays on 08/01/2007 for a total of £1,319.28 made up of £1115 in charges and £204.28 interest. I received a letter back from Barclays on 19/01/2007 offering £615 towards the total amount. I submitted a claim via moneyclaim.gov.uk on the 24/01/2007. The court sent it to the defendant by first class post on the 24/01/2007 and it will be deemed to be served on the 29/01/2007. The defendant has until the 12/02/2007 to reply. I have logged into moneyclaim.gov.uk to check on the progress and I’m presented with the following: Acknowledged (12/02/2007) with a judgement option of (Start). Barclays are allowed a total of 28 days from the date from when they are served with the claim to reply. So my questions are: 1. Do I start the judgement process, which has two options? A: The defendant has not filed an admission or defence to my claim (Judgment by Default) You will need to decide, how and when you want the defendant to pay. You can ask for the Judgment to be paid by instalment or in one payment. B: The defendant admits that all the money is owed (Judgment by Admission) If the defendant has given a new address on the form of admission to which correspondence should be sent, update the defendant's details within the following Judgment request. 2. Do I wait to hear from Barclays? Would this be via the moneyclaim website or via a letter from the courts and or Barclays Thanks for all the anticipated assistance, Ill keep you posted to how the case proceeds.
