Hey all
Halfway through claiming a few charges back through Nationwide at the moment and they've said if I go to court they'll close my account.
Surely this breaches the banking code as it seems to be a retaliatory action because a claim has been made.
Can you tell us who said they would close your account.
I would then write to Charles Bacon (a Nationwide Solicitor) stating that you consider the action threatened as being against the code of practise and possible unlawful

It would appear to me that if they can provide statements for £3 a copy then they can provide the same statements under the DPA.
I would wait the 40 days and report them to the IC

Keep to your own timetable. You are not making a complaint, you are claiming back unlawfully applied charges.
The 8 weeks is a diversion in the hope that you go away.
File the court papers and wait for your money

Most organisations have some type of sick monitoring policy. The sector of the Civil Service where I used to work had a system of days taken and numbers of absences before the procedures would kick in

I am taking the view that i have been depositing all the charges I have incurred into a savings account and now it's time to withdraw this cash and hey, if it goes to court I get the full term bonus of 8% interest!
I'll let you know what happens

It seems to me that things are changing from when I got my charges refunded. Calling in an overdraft is starting to be petty and vindictive in my eyes.

Also I believe the maximum claim allowed in the Small Claims Court is £2000.00

Final question, I also have a current account and savings with Nationwide so I use their online banking. Is it worth me sending them a 'friendly' secure message before sending out the official letter? Of all the financial institutions, I do see them as the most 'human'!

I too want to keep my accounts with NW but I just sent off the Preliminary Request letter.
If your account is generally well managed then I really think that closure is very, very unlikely

I would send it to Charles Bacon as I did and got a very swift result as I believe someone else did.
There are no guarentees though that you will get a quick result but persevers and you will reap the rewards

I too sent a DPA request to Tesco re credit card but to date I have had no reply at all. Its now about 11 days so time yet I suppose

I would imagine that there would be conflict of interest issues if any of the court staff attending the function later had to work on a claim against the same bank.

It would be a good idea to start your own thread and that way you can keep us informed of your progress.
its daunting for everyone at first but remember the banks do not want to take you on in court, its your money you are claiming and this forum is full of people like yourself that will support you.

Received a letter today from Deborah Desborough, Member Account Servicing, thnking me for my recent letter, cannot refund charges blah, blah.
I got the charges paid into my account on the 15th of April:D
Someone should tell Deborah what the rest of Nationwide is doing
