  2. Sorry for being so dull but I am totally confused as to what letters we are supposed to be writing to whom! I have just recieved a stay for my husbands case that was supposed to have a directions hearing in November. I wrote to the courts a month ago and told them that his claim had been settled in full. I don't think they really know what they are doing at this stage and this is also further evidence that the hearings are all being blanketed.
  3. Not going - looking after friends children and my own, but any news from anyone who goes will be much appreciated. I had two hearings for tomorrow, one with Barclays - stayed, and one with Citi Cards - also stayed. The second should not be stayed due to being a credit card account, need to phone the court this morning to find out what is happening here. Anyway, goodluck to all those planning to attend and don't forget to report back all the action.
  4. but yes, you should have ticked yes to the hearing - see if you can change that by phone on monday. also, you can ask what will happen if you show up with a letter to lift the stay - We were all advised on our threads to tick no to a hearing but to be prepared to attend one as they would probably call for one anyway, so I would not worry too much about changing your N244 form.
  5. Hello all, Kashie from the neighbouring Barclays threads here.We have all been told that there is no point in turning up on Tuesday as they will turn you away. The stay states that the hearing has been vacated and its best to apply for the stay to be removed. how long this will take? We have no idea. Sorry to be of so little help, but we are all in the same boat I'm afraid.
  6. Thank you patdavies and Aviator for your responses. The windows are wood effect, but there is a distinctive pattern in them that runs down to give a stripe effect. The new doors are like the inside of a cut down tree with a knot effect so, no aviator they are not dirty, and they are under warranty against fading, which has not happened. In response to pat davies, thanks for advice I have found thier email address and emailed them saying more or less above and giving them to the close of business on Monday to ring or I will assume they intend to do nothing and will seek legal advice. I am really concerned about the fact that I cannot lock the doors properly and that this as far as I am concerned is more of a priority. What do you think?
  7. Hello, Please can someone advise me what to do in this situation? I purchased a set of french doors from a company that had previously fitted my double glazing (7years ago). The doors were ordered and the salesman agreed that the doors would be of the same colour etc as the windows we already had. This is why we went back to this company. On fitting the doors on thursday 9th August, I was pleased with the workmanship and how efficeint they were at installing the product. It wasn't until later that sitting in my garden admiring my new doors that I realised they did not match the original doors and windows installed 7 years prior. I telephoned and explained the situation to the boss stating that was the reason we came back to them to have an exact match and he told us that they had dscontiued the old range over 3 years before. I explained that we were not told this at the time of order and that we were not happy that we were not informed about this. He asked me what I wanted him to do about it and I told him that they could either refit our original doors, or compensate us for the inconveinience. (I think thats how you spell it.) To this he replied he would get back to me. That was thursday, it's now Saturday and still no reply. I telephoned them again this morning and explained the situation to another gentleman and also reported the fact that we are now having trouble locking the doors. He explained that the lady who deals with this sort of thing was busy on the other phone and he would get her to ring back asap. That was 09.15 this morning and still no reply. Can someone advise me of my rights as a consumer and how much time I must allow them to return thier calls before I can take this any further? Thank you.
  8. Am I correct in believing that the stays can only be applied to banks and not credit card claims??? I had two directions hearing scheduled for 14th August at Cardiff CC but one was for CitiFinancial for a credit card claim. I recieved a letter today informing me that this has also been stayed. I am wondering if maybe the court has made a boo boo here and just sent a standard letter to everyone with claims due for this date. Any advice???

  10. Please help I'm really confused now. My claim with Citi was due for a directions hearing on 14th August next week. I sent off the relevent paper work weeks ago along with the same paperwork for my husband who also had a claim to be heard the same day. (Also with Citi). My husband recieved a full settlement in the post a couple of weeks ago. I recieved this letter this morning. Quote: I act on behalf of CitiFinancial Europe plc and enclose a letter to the Court for your attention. Yours sincerely MR Brian Smith. Solicitor. Directions Hearing 14th August I act on behalf of Citifinancial Europe plc and write furthe to the Order of DJ Hendicott. I must repectfully decline to attend the Court on the 14th as this matter is a small claim amounting to no more then £637 (which the Defendant avers has not been paid) and to attend the Court for an allocation hearing and a final hearing would render the matter entirely uneconomic to defend. Wtih this in mind, I would resectfully submit the following suggested dirctions to the Court to assist it in the conduct of this case: 1. Each party shall deliver to the other and the court copies of all documanets on which they intend to rely not later than 14 days before the hearing. 2. Signed statements of witnesses shall be prepared and copies included tn the documents mentioned in paragraph 1. This includes the evidence of the parties themselves and of any other witnesses whether or not the witnesses are going to come to court to give evidence. Yours faithfully Brian Smith Solicitor. Can someone tell me what I have to so here?? I also received along with this letter this morning a letter from the court stating that this claim has been stayed pending investigation from the test case with the OFT. This reads: Before HIS Honor Judge G Hickinbottom sitting at the Cardiff County Court, Cardiff Civil Justice Centre Upon neither party attending Upon reading the file And upon it appearing that the issues in this case are to be considered in litigation currently before the Commercail Court (2007 Folio 1196) It is ordered that The claim be stayed with immeadiate effect pending the ulitmate determination of the Commercial Court litigation. Permission to apply to lift the stay. Any application shall (i) be made on the notice to all other parties, (ii) include reasons why this claim should proceed before the ulitmate determination of the commercial court litigation and (iii) shall be reserved to the Designated Civil Judge (unless specifically released by him). Unless the court has directions in the meantime, defendant shall, upon noitce to the claimant, apply for dierctions within three months of the ulitmate determination of the commercial court litigation. The hearing listed for the 14th August 2007 had been vacated. Dated 06 August 2007. Please correct me if I am wrong, but I was under the impression that the Oft was only taking the banks as part of the test case proceedure?? and that this did not include credit card companies. If this is the case are they within their right to put a stay on this case???? I am really confused and can only assume that because a huge amount of cases (Barclays) that were due for directions in Cardiff that day have been stayed that mine has been done also - possibly by mistake???? Any advice please?????
  11. Recieved the leaflet from Barclays this morning what caught my eye is the last paragraph of the letter. Qoute: As a general matter, we will ensure that your claim will not be adversely affected by the stay of your court proceedings. What does this mean?????
  12. olden, first sorry for not answering sooner, yes the application notice n244 is required and the information for section C is the objection letter so print and attach that. I phoned Cardiff yesterday and was told that they are not charging the fee for the applications at the moment so that is good news. I don't know what to suggest as for as cutting and pasting is concerned, not brilliant with computers myself, but it may mean you will have to copy the whole thing out yourself! Sorry!!

  14. Phoned Cardiff County Court this morning as I did not include any payment in with my application (n244). Was informed that they are not going to be charging for the bank charge applications at all. Do you think this is because they are going to be ignored???
  15. Oh my god!! I just realised that I did not include any money in the letter I posted today. Will it be too late to send this off separately in another letter tomorrow?
  16. Yes I did. Even though had no reply to the question I thought it better to have more than one arguement towards litfting the stay.

  21. Hello 1234debt, I'm interested in what you are saying here as my charges were also taken out of money given to me from the benfit office. How does this affect things?
  22. Also recieved identical letter to Mr Dinkle this morning. Do I have to ask the court to send me an N244 form before I can apply for the stay to be lifted?
