  1. Was this in connection with Current account bank charges ?

     

    A lot of courts actually dismissed the claims after the supreme court hearing. I am not quite sure if you do need to do anything.

    Yes it was a current account is there anyway that they can pay some of it back??? I am not working since 2007.

  2. Yes. Stick to the timetable.

    Fourteen days after the prelim, send the LBA.

    Even though it won't progress, your claim will be already in the pipeline when the stays are lifted.

    I am in the same boat, if you send the LBA do you state

    "I look forward for a full response to this letter within 7 days, otherwise I will commence court proceedings to reclaim my money." and then do you start a court claim????

    On your credit agreement does it state the interest rate they used, or does it state it as the apr?????

     

    How long did the term run for???? months/years

    The term was 5 years

    APR 10.9 it doesn't state the interest .

    Now there is a part2 Credit Insurance where it says

    "You apply for the following insurance cover AA Credit Basic

    If you have applied for credit insurance you confirm that you have been informed of and understand the eligibility criteria and that you (and when married your spouse) meet those criteria

    Name of insured date of birth"

    The problem with this was that I was working hourly paid so they wouldn't pay if something happen with my job .

  4. Well well I have been looking into other accounts loans I have and found more ppi, one is also with AA . Now I remember that this was like a bank account and I am sure it had a card and that was Bank of Scotland but I also have found a statement at the bottom is a bank giro credit (to pay and it is for Capital Bank Plc so now I don't know who is the company I had to ask for their AA credit care back, This was charged monthly and of course some months like at the beginning £3.45 but then £18.94

    I am sure I had more I am going to look at my files I now think it was good to keep old statements.

    I have put a couple of comments above for you.

     

    You need to work out how much interest they charged you for the ppi

     

    The £1860 would have attracted interest as well. Can you post up what it states on your credit agreement please

    I have been reading some of your threads and I think I have a case for reclaiming the PPI from AA Financial Services (Centrica Personal Finance |Limited) that I think is Bank of Scotland could anybody confirm this!! who do I have to send the letter.

    I got a loan in 2000 in the Credit Agreement Particulars of Loan 10000 + 1860 AA Creditcare Basic total loan 11860 . I also have a Bill Protection Plan Acceptance Form (St Andrews Insurance plc that I think I never signed as I have the form here it was dated a month later of the agreement it states monthly bill protector benefit 100 monthly bill protector premium 5.95 this have a Summary of Cover. I think this is something else.

    I cancelled the AA creditcare basic 7 months later when I realised that I could then they credit my account with 1362.86 so they charged me 497.14 for 7 months of cover.

    Can I reclaim the £497.14???

    I have send Letter 1 to M&S reply was

    blabla

    "In April 06 the OFT published their report on the level of default charges thay all creti card companies charged. They were of the opinion that, in some cases, firms were charging a fee thay was disproportionately high. They recommended thay default charges shoruld not exceed £12,00 andthat any charge above this level could be unfair.

    As a result of the OFT's recommendations M&S MOney lowered their default charges from £15.00 to £12.00."

    I regret that we are not prepared to make any refund f default charegs or provid eany compensation payments and apologise for any dissapointment this may cause you. "

    and bla bla bla

     

    Are they right??? or do I send the LBA

    I don't know if anybody has claim to GE Money from a Loan from First National Tricity - Capital Bank (I think all the same)

    Sent letter for data - reply with dates and charges

     

    Then sent letter 1 - reply sorry but because is a loan we cant pay back

    "GE Money is currently reviewing the OFT's recent publication of its findings into default gee charges. Our view remains that we are entitled to charge these fees (which is consistent with the OFT's view). As the OFT's ruling did not include loan products, unfortunately the fees to chich you refer are valid and will not be removed "

     

    Do I just go and send LBA?

  10. I had a a chargecard with them a few years back. I requested the statementsa and got a printout shee just showing opening and closing balance, min. payment expected for the foll. month and what payment was received.

     

    Can anyone tell me what M & S's charges were in 2002 onwards. I can assume they charged me for missed payments. I don't know how to find out about other charges?

     

    Anyone know?

     

    Hi The letter charges from 2002 till 18/7/06 were £15 then onwards £12

    Time for letter or visit to Court Manager.

     

    " Rec'd the Court's Judgement dated xxxx. Realise now that I should have been in court for hearing but assumed, wrongly I now know, case would be stayed because of the letter I rec'd from bank which said "Case will now be stayed".

     

    I meant no disrespect to the court in not attending and would ask that my claim be re-instated so I may go back to bank and negotiate a settlement and hopefully not trouble the court further."

     

    If court allows this, BC should settle.

     

     

     

    If not, write to BC afresh, as if you've never done before, with a new Prelim asking for chgs back. Then LBA. They may offer to settle just the chgs but not s.69 int't.

     

    If they don't offer to settle, sue them again and put this down to experience.

    Sorry to hear about this. Have you posted the whole of the Order rec'd from Court or was there any more - perhaps, along the lines of if either party object, they may do so withing 7 days or similar.

     

    Please post Directions in full.

    1 Claimant to file and serve details of the grounds of the claim together wirh a schedule of how the claim is calculated setting out the date, amount and particulars of each debit charge

    2 The case be listed on 8th October 2007 at 11.30 to consider whether the issues in this case are similar to the Office of Fair Trading test case.

     

     

    What papers do I have to produce????? there is no date to when post this

    "It is ordered that
