Im trying to find the template letter for a CCA request but cannot locate it anywhere.Also I owe them no money as I paid back all debt as the constant hassle ground me down in the end. I am curently finishing off N1 but feel a CCA back up letter may help full charge and contractual interest claim cheers Baslow

Just putting finishing touches to POC but finally started to fill in N1 and no where is the info on what to put in the box " brief details of claim" Does this need to be legal speak or can I just say "claiming back charges and contractual componded interest on a credit card account" Thanks Baslow

Yes definately possible to claim. I was in the same position so I rang them up explaining that I had lost my account number.They sent me some paying in slips with the ac number on it. I then followed the advice here to ask for a SAR ( letter in bank letter templates) you will also need to include £10 cheque. While you are waiting read around on this site to get a feelwhat you need to know Cheers Baslow

Im still ploughing on with my POC and wondered if was worth mentioning in section "3. The Agreement was a Regulated Agreement for the purposes of the Consumer Credit Act 1974." that in fact the agreement was only an application form and no other paperwork was signed? would this comlicate matters? Any one know why the Cap1 POC template has been removed? Im in process of completing mine but worried that its been removed because of changes that have rendered it obsolete Thanks Baslow

Can I ask a question? If the CCA hasnt been followed correctly and only an application form has been signed then are we in a position to say that because Cap 1 acted 'wrongly' ( as per dpicks thread) then they should pay all charges as per schedule 1? Will they pay up in this instance with out resorting to an N1? Baslow

Im finalising my NI and a little worried about my Schedule 1 . I have calculated compound interest using a spreadheet( which ukavaitor very kindly checked for meand said looked fine), however I only made one or two purhase with my card amounting to £300 max.If prurchase interest was claimed would it be only on this £300? I thought Cap 1 paid up once you had logged a claim against them in court? Is this a change of tack or just a judge goung against the grain? Bas

A slight hijack..ok a big one! Mine was the same with definate ticks in the PPI when I never apply for protection on anything.So if it unenforcable how do I back my money back without court or it it ammunintion for a normal claim for charges? Thanks Baslow138

I rang them up and asked them apr they were charging me and it was 28.5%. Im still confused can I compound this or do I need to add 28.5% to each charge seperately? sorry for being particularly dim today! Bas

So purchase rate of interest would be say 28% applied to each charge seperately and not compounded? Can you claim 8% in addition as compenstaory interest? Thanks Baslow

Hi Bj I had picked that up but heven't reread my original one( done in sept) to find differences as yet. so basically claiming Compounded interest at the rate of 28.5%, is a non starter then? Bas

Ive noticed that Cap1 seem to payout after filing NC1 but only pay purchase interest only rather than CCI. Can anyone explain the difference to me please and perhaps attach a link to a purchase intersest applicable spreadsheet? Ive prepared a spreadsheet but with compounded interest is this useless? What worries me is the further action section ( Halifax default letter) 2.on or after the date shown( 30th Oct),we may take legal proceedings against you and/or instruct a debt collection agency to recover any amount you owe us on your account. Can the debt collection agency be stopped by the methods above as well as the orginal bank? will they resort to sending baliffs round or is there hoops they have to jump through first? yours hijackingly(sorry!)
