  1. A querey. We booked our wedding with a well known hotel chain last year for this May. We have arranged the full ceremony and after party with them and paid them as instructed on the relevant dates. When we asked for the final settlement figure they provided this and we paid. They are now telling us that they forgot to charge us room hire on the ceremony room and that we owe them a further £200. We are most disappointed as we have kept in regular contact with them and have trusted them to keep us informed as the event planners to allow us to concentrate on other areas. They state they did originally quote this but then have admitted that due to their error this was never charged. We have always paid and acted in good faith and have not received any invoices from them for any payments made. Should we have to pay this money with 2 weeks to go bearing in mind our budget is maxed.
  2. Firstly, I used to hit this forum with speed and now it seems to have slowed down... Now on with the main subject... I inherited egg debts from my ex wife some years back...I have albeit arrogantly paid them at the minimum rate as I am a bitter twisted ol man....however as this debt has been sold on from Egg to their in house collections, then to ARC for several years and now to Barclaycard...I am of the opinion that the debt value is not that much and it will have been bought for a nominal value...I would like to pay it (may my ex wife suffer-joke and meant in good spirits...lol)...any suggestions...??
  3. We purchased an indesit washer for use in father in laws small dry cleaner business. The purchase was from COmet and we told them that it was to be delivered to the shop and they agreed to install it. This was the latter part of January 2011. The washing machine has stopped working and the engineer came out. He stated it needed about £150 of repairs and that the warranty would not cover it as it was being used in a shop. Comet knew this from the start, they fitted it and did not ask us to sign any disclaimer about it being used in the dry cleaning shop. Where do we stand legally as we have a one month old none working washing machine that allegedly has no warranty?
  4. It was the GP that told us this. I have spoken to a local coroner and he says that this is rubbish.
  5. My sister in law died recently with little in the way of any estate. We want to make a complaint to the GMC for medical negligence. The doctors are insistent that there needs to be an administrator of estate forthis to be pursued. How do we go about this? We don't want to spend any fees on solicitors etc as there is no other estate to sort out. Sounds to us like the Doctors are just being difficult? Any help appreciated...
  6. The relative would have attended court had they been invited but they weren't and there was no letter before action. It was Bow Street in London (England).

  8. A relative of my partner has recently received papers from the small claims court from a customer he believes is telling a bit of a story in order to claim money from them. In the small claims proceedure it stated 'particulars of claim to follow'. This in mind and following the guidance from the leaflet enclosed with the small claims form. The relative did nothing except wait for the particulars to arrive (which they did not). On the 14th day following, the realtive wrote to the court and sent the letter special delivery to the court stating that no particulars of claim had been received and therefore queried if there was now a case to answer. The relative heard nothing back and then out of the blue the court have issued a judgment in favour of the applicant and said that the relative is now in default. It further states that should the relative wish to contest this it will be best part of a hundred pounds. No particulars of claim were ever received despite it stating that they were to follow and a letter was sent by the respondant to the court special delivery stating this. How come the court have still found in favour of the applicant and what can the relative do now??
  9. i'm currently being pursued for an old egg debt and arc/tm are sending me letters...what should my course of action be to determine if this debt is enforcable / lawful as the accounts date back to around 2002...
  10. On Monday 21st December 2009 we were due to fly back to Manchester from Las Palmas, Gran Canaria with Thomas Cook. Due to the weather situation in the UK we were told at around 0930 hours that we should expect lengthy delays though would be picked up and taken to the airport as normal at 12 midday. I asked the rep why we could not remain at the hotel rather than being sat at the airport for hours on end and was told that should they be able to fly in another aircraft we would need to be at the airport in order for them to take us (call me a cynic but i guessed immediately that this wouldn't happen given that an aircraft was already chartered to fetch tourists out...) We got to the airport and our rep told us that we would be left in the capable hands of the Thomas Cook airport team... We checked in and were immediately given a 10 euro voucher each that could be used in one of the food outlets in the airport. We very quickly discovered that 10 euros each didn't go very far in the airport and ended up having to use our own money to supplement something to eat. We then noted that other tour operators in similar situation had provided there customers with 12 euros each...not much but significant in the circumstances. Throughout this part of the experience when we could find a member of the Thomas Cook Team they gave very scant information and what they did was incorrect which we were quickly able to prove by speaking with family back home who had access to the tv and interent. When the TC staff were challenged with this they set off to discover the truth and managed to evade being questioned on this again. By now the staff were becoming hard to trace. 7 hours later we were hungry, had seen flights cancelled, seen people been told that flights were airborne en-route to collect them only to discover that they were still static in their country of origin. I managed to locate a member of the TC staff and asked if we were getting any more vouchers to assist us in eating at the airport. The staff member immediately started walking away from me and talking back as she walked telling me that we would be issued with a further voucher. I told her that all food places appeared to closing and she told me that she would hurry up and sort it...this was the last time any TC staff were seen...we ended up purchasing food with our own money... Our flight finally took off almost 10 hours after its scheduled time and we were not even offerred so much as a complimentary drink on the flight back... We paid for good flight times and a good service from Thomas Cook...we appreciate that the flight time could not be avoided due to the weather but felt really let down by the poor level of customer service. We felt like we were abandoned at the airport and the staff there had no intention of keeping us informed or helping us... Where do I stand with this?
  11. I have lived in my apartment for 3 years and the carpet/laminate flooring (which was not new when I started renting) has started to look a aged/worn...who is responsible for this? Should the LL make a deduction to allow me to get it done? I'm mindful that if its something they don't want they'll charge me to put it back when i leave...how do i go about this?

In the past 18 months the owner & registered keeper of the vehicle has received several tickets for several alleged offences at Tesco in one of their Yorkshire stores...we have written and asked for proof of the driver at the time of the alleged offences (bearing in mind that we are under no obligation to tell them who it was) and received no response. We did receive debt collection letters which we ignored in the absence of the proof we requested...it has now been several months since hearing from them and we suspect they have become bored of pursuing us as we clearly are not going to pay without a fight.. ***Please nobody enter in to any discussions with the parking officer in privately run car parks. Do not provide them any details and do not give them any personal information in relation to the vehicle/owner/yourself. In our experience the parking officers do not have a clue on legislation and therefore what they tell you is not in any way the truth or legally binding. We asked our local parking officer in Tesco what legislation he was issuing tickets under and his reply was "My Companies because they tell me to" we decided against trying to educate this fellow... UKPC are a waste of space and will do all they can to try and frighten you...do NOT pay them...Ignore everything regardless of how tempting it is to enter in to an argument...
  13. Also if you phone from a mobile phone you need to go in to your settings and select the relevant option to withold your number... I would also like to state that in the last 18 months, despite numerous tickets being placed on vehicles I have driven though are not always registered to me the requests for payment have been ignored and to date all the letters have stopped and I (nor the registered keeper(s) have not been asked to attend court...I always encourage people not to provide any information unless it falls under the road traffic act of 1988...which of course private property does not...
  14. done - thank you for that advice - if you hadn't of posted I wouldn't of known to do that. Apparently once I get the new car they work out the time I've been without and they credit my payments without me having any penalty...
  15. I have had a discussion with the DP at BMW and he assured me that my latest fault had been resolved only for me to get int he car, start the ignition and the light come on again... The DP immediately took the car off me and placed me in a BMW loan car telling me that he is going to replace this car...He tells me that he's going to find me a diesel car of the same spec and that i'm to use this loan car until it is replaced - can't fault their service so far on this occasion. Should I cancel my insurance on my car as i'm currently in the loan car and what about my payments for the car? How long should I give them to replace and should I end up paying more? He's also invited me to an exclusive evening with the Hull City tigers with comp bar / food...
  16. We purchased a 2 televisions from Comet 1 week back. We also purchased a monster power surge protector. Comet told us that as we were purchasing the 2 televisions they would do a deal on the monster socket and knocked £50 off the price. We discovered that the 2nd tv we purchased had no remote but were assured that it would be with us within a couple of days. We returned to the store 2 days later to be told that the remote could now take up to 2 weeks. After some discussion we were told they could try and have one sent from another store but this could take a few days (subsequently this has never materialised). We obviously became frustrated as the tv is not the easiest to operate withou a remote We therefore decided to go look at Currys to see what they had with a view to taking the goods back and shopping elsewhere. At currys we discovered that they had no 2nd tvs that matched the style or price range we wanted and that the main plasma tv was £50 cheaper than at comet. We returned to Comet and spoke with the manager who informed us that we'd had a discount and that we weren't getting anymore. We stated that the discount had been for the Monster item and not the tv so now we had found it cheaper elsewhere we would like them to price amtch. He told us that the salesman had taken the discount off the tv and not the monster item as he wasn't allowed to discount that! Is that not mis-selling? Is there not a fraud offence there as well? We then discovered only a few days later (less than a week after purchase) that the tv price has been brought down in price to match the Currys price. I have ended up returning the 2nd tv and had to purchase a more expensive one as the remote has not materialised and they have not been very helpful overall... What can i do?
  17. ***I think I am very unlucky and not meant to have one...*** I have now got a 2006 model BMW 320si, I have had this for 3 months. In the last month the oxygen sensors have failed 3 times! This has meant we have been again put in to a loan car and again we have been told 'don't worry we'll sort it' by BMW. The phrase 'start as you mean to go on...' springs to mind and as we had inherent faults with the last one how should we approach this fault now with the dealer? It has obviously made us feel that we are in the same boat as before as less than 3 months in we've had the same fault 3 times... Would this warrant giving the car back and how would we go about getting another one? Our concern as beofre is that we are getting an inherently faulty vehicle. It cost £15000 (give or take a few quid) and is less than 3 years old. We got a years warranty with it but are already seeing a pattern developing.

  20. I am seeking some advice on what are my lawful options. I bought a BMW motor car (on finance) from a BMW dealership. It was a used car and came with 1 year warranty. Throughout the year the vehicle has been in and out of the garage requiring work to be done on the warranty, to date the cost of repairs is in excess of £7000. I spend more time in the dealerships loan cars than my own. I have made numerous representations to the dealer principle (DP) as I bought the vehicle in good faith and all i have got is a vehicle littered with problems. Last month the warranty came to an end and I spoke at length with the DP as i was offered the opportunity to extend the warranty. I explained that I did not think it appropriate for me to foot the bill on the warranty when the car has been inherently faulty and that I did not want this car. The DP told me NOT to extend and that he would get me out of this vehicle and in to another one, he went on to state that in the interim the dealership would stand any further problems. Needless to say the vehicle has had further problems and I am again in another (very nice) loan car. The DP has told me that he can get me another car though it will increase my monthly payments by around £40. I do not want to do this as I budgeted for what I'm currently paying and do not see why I should have to pay more when they car I bought in good faith has demonstrated a history of faults. What can i do and what is my legal stance?
