  1. The garage carrying out the repair is Nationwide Autocentres not the garage I bought it from. The dealer I bought the car from is a small secondhand car dealer and doesn't have repair facilities and is based in Bolton. I live in South Wales so I wouldn't be able to return it to them for repairs anyway which was why I purchased the nationwide warranty.
  2. I purchased a second hand car back in March and purchased a 12 month warranty for it from Warranty Management Services. A warning light came on the dashboard a few weeks ago and the warranty company told us to take it to a garage and to contact them when the fault had been diagnosed. We took the car into the garage on the 14th July and were advised that the fault was the ABS pump. I then spoke to the warranty company who advised me that it was covered but that it was too expensive to replace so they wanted the garage to send it off to be repaired instead.   3. To be honest, I'm expecting a no as well but think it's worth a try! The only outgoing that I can cancel is Sky tv and I've been shopping around to try and reduce insurances etc. Thanks for your quick reply

As soon as I began my claim through the courts I opened a bank account elsewhere which my wages and direct debits now come out of so I haven't incurred any further charges with HSBC although I have incurred charges with my new bank because my outgoings are more than my incoming so I keep going over my overdraft limit with them. I'm not in arrears with my mortgage yet because I took out a loan last year which I have been using to cover my priority debts but that money has now run out and I am one month behind with my council tax.
  5. Hi, I have two claims with HSBC which have been stayed since August 2007. I would like to put in a claim for hardship but am not sure who the initial letter should go to. Does it go to HSBC or their solicitors DG? Also, are there any template letters for hardship claims? Many thanks
  6. Hi all, I have two claims against HSBC which I started about 18 months ago which are currently stayed. I stopped using the accounts when I began my claim, they are both still overdrawn but not over the overdraft limits. I stopped paying any money into them because the amounts outstanding are made up of their bank charges which are now in dispute. I have today received a letter from them saying I must make a payment into the account within the next 7 days as they have noted that there has been no payments made to the account for over a year and that it is a condition of my over
  7. Hi all, I started court proceedings against HSBC last year in the Cardiff County Court and my case was stayed along with everyone elses. I haven't heard anything from the Courts or DG since. I just wondered if there is anything I should do now the test case has been heard? Any advice would be appreciated. Thanks!
  8. Hello again, When I started my claim against HSBC I opened a new account with a different bank and stopped using my HSBC account. I received a letter from HSBC today telling me I had to pay back my overdraft in full by the 22nd September. This overdraft is made up mainly of their charges and I cannot afford to pay it back in one go. As my case has been stayed pending the OFT case can I refuse to pay the money back until the outcome of the case? I was planning to pay this overdraft off and close the account as soon as HSBC settled my claim. Thanks
  9. I've printed off a litigation spreadsheet for all concluded HSBC cases. Can I just attach them as they've printed off or do I need to put them into another format?

  11. Help needed yet again!! Both my claims in Cardiff CC (due to be heard on the 14th) have been stayed. I have completed an N244 and attached the Part C statement re Human Rights etc but should I also attach my Statement of Evidence and copies of all the letters previously sent to HSBC and DG which have been ignored?   13. Oops better check I haven't written impose in the letter!! I've now written my letters to the Court and DG enclosing my Statement of Evidence but I'm not sure whether to send DG a copy of my covering letter to the Court which basically says that I believe DG have been stalling and that I believe Judgment should be awarded in my favour given the exhaustive lengths I've gone to to resolve this matter!! Do you think I should let DG see a copy of this letter? Sorry for all the questions but I don't want to make a stupid mistake at this late stage.
  14. I'm going to write a letter to DG now enclosing my Statement of Evidence and informing them I will be appealing any stay imposed. I actually have 2 claims against HSBC but DG have only written to me about applying to stay the one claim. Do you think it is worth writing to them regarding the other claim saying that I will impose any stay? Thanks
  15. I have seen it and I've printed it off but assume I need to wait to hear from the Court that my case has been stayed before I submit it? Claire
