  1. Hi People Please can you help me. I am preparing form N1, but the bank has paid part of the funds into my account, without my consent. Do I go for the remainder of the sum claimed, or do I go for the whole amount? I have requested that the Abbey take this money back, until the matter is solved. Does anyone have a copy of any wording that should be used on the claim form? Many thanks for your help Smiley
  2. Thank you for your recent message. I am about to prepare the N1 for serving. However, Abbey have paid a small proportion of the monies into my bank account. I have asked for them to take this money back until the matter is resolved. However, despite this request the money is still in my account. When issuing the N1 do I need to take into consideration the monies already paid when demanding the charges or do I remain silent on this. Many thanks for your help!! Smiley Face
  3. Thank you for your reply. I have issued the N1 form, to which an acknowledgement of service has been issued. Is it still a good idea to proceed with the claim, given recent ongoings in the media and courts? I would really appreciate your earliest response Many thanks Smiley
  4. Hi again people, I have just been approached by Nationwide, after receiving my initial letter. They are going to deal with the matter in due course and if things don't go well then the matter will be referred to the Financial Ombudsment. Do I: a: Wait the 14 days still; b: Arrange to speak to the Ombudsmen. If I do want to go to court wouldn't that be deemed to be not complying with the spirit of the Civil Procedure Rules?   5. Hello people Please can you help me? I have done the Data Pro letter and the initial letter to Abbey. They have responded saying that they will investigate the matter and revert back to me within four weeks. Do I need to go ahead and send the second letter after the initial two weeks, or do I hold fire until they have responded in four weeks? Any help would be greatly appreciated. Kind regards Smiley Pie
