  1. Hi D I have been busy with other things, but now have time for CAG. The band San Leon are a bunch of spanish lads that we met last year in Barcelona, all songs are in english and written by Aldo the lead singer, he is also responsible for all the videos, (and he also owns and drives the bus!) they were recently voted best new indie band in a spanish music magazine http://www.youtube.com/watch?v=1plvBR02wDs Jolene - Dolly Parton
  2. O.K. So where does this leave us all with claims stayed, I was under the impression that something had to be done by 23 Dec to stop claims being dismissed
  3. From speaking to my local court today either Complainant or Defendant can apply for stay to be lifted or case dismissed, this action cannot be taken by court alone, and if either party wishes to make a move, the other party must be informed. hope this helps:)

My POC reads " the claimant contends that: a) the charges debited to the Account are punative in nature; are not a genuine pre-estimate of cost incurred by the Defendant; exceed any alleged actual loss to the defendant in respect any breaches of contract on the part of the claimant; are not intended or related to any alleged actual loss, but instead duly enrich the Defendant which exercises the contractual term of such damages with a view to profit. b)the contractual provision that permits the defendant to levy such charges is unenforceable by virtue of the Unfair Term in Consumer Contracts Regulations (1999) and the common law. " So will I need to change this or amend it in anyway? Thanks

Hi All, In view of recent kick in teef by appeal court I phoned local court to see what score is. case is still stayed as court can take no independant action and either I or Bank have to ask for stay to be lifted, ( this after court stayed case on its own). I am now at a loss as to how to proceed. from what I gather original grounds have been ruled out by appeal court but it seems that they left an opening under a different section of UTCCRs, Thus I believe that I can apply to court to alter original N1 conditions. any views or comments on this course of action?

Well folks, reply from HMCR Customer Service & Support Group informing me of general information about overpaid tax credits guide COP26, which I already know, and also informed me of decision reached " I have decided that the whole amount of the overpayment, £632.12, arose because we did not meet all of our responsibilities as set out in our code Of Practice 26. You do not have to repay this overpayment and I have updated our records with this decision." And signed by a real person in ballpoint ink. Another ***WON*** methinks, :D:D Thanks guys
