  1. hello! I'm in need of some help! I thought that this bank charges thing was pretty straight forward, that is until Lloyds TSB sent me a letter. Let me clarify... I sent LTSB a data protection request form for my statements for the last 6 years... which they sent me. From this I calculated a total which they owe me from charges relating to Overdraft excess fees and Unpaid Direct Debits, so I sent them a Prelim letter... Straight forward. But then LTSB sent me a letter back which basically said I'm not entitled to claim any charges back... and I quote "The office of Fair Trading has published new guidelines on credit card default charges. We're still talking it through with them, but the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations." Now this has thrown me! Is this just lloyds spiel to put me off reclaiming my bank charges or am I really not entitled to claim these charges back?? Whilst I was at University I had an overdraft of £2000 in my fourth year, and occasionally went over this as all good students do, but at no point did I ever "request to go over my agreed overdraft limit", So I never asked for this service they kindly provided me with and charged me for! Can someone please point me in the right direction because I am very confused right now! Cheers!
