  1. I am just about to file a claim on these two accounts does anyone know if it is possible to add them both to the same MCOL claim or should I do a separate claim for each.

  3. You would have thought so wouldn't you but she wasn't having any of it. In the end I did mention that I would just write in using the CAG letters but she just said well in that case they wouldn't refund any of it! So I said fine you refund the half and I will chase the other half Talk about making it hard work:rolleyes: Thanks Speedo
  4. Hi there My daughter has been charged £38 for a bounced cheque. We telephoned Nat West who would only agree to refund half of the charge as a gesture of goodwill. This is the first time she has ever exceeded her limit and I see no reason why she should not get the lot back. Is it best to just send a slightly rejigged version of the prelim letter or is there a better way of getting back just one charge. Thanks Speedo

  6. No it's Bath but not that far away. So am I right in thinkning that all I have to do is send the non compliance letter (nothing else) to [problem] and the court? Sorry to be dense but do I need to send both of the letters or just the second because as far as I understand it at the moment I am not supposed to have submitted anything to the court. Thanks Speedo
  7. Hi there I have a court date on the 10th May but the judge appears to have asked for Lloyds to put in their bundle before I have to have mine in. This is what he put in the notice of allocatiion Parties to file and serve documents 14 days before the hearing The original documents shall be brought to the hearing Defendant do by 4.00pm 10 April 2007 file and serve: 1.an itemised statement showing how each and every item charged is calculated 2.a copy of the contract with the customer 3. skeleton legal arguments if points of law are to be argued relating to punitive and/or unfair contract terms.   8. Hi there Well they hadn't when I rang on the 13th but the person I spoke to at the court did say that they would be given a little leeway because of the Easter break. I really can't see Lloyds complying with the first point and as I understand it I don't have to put in my court bundle until 14 days before the hearing. Does anyone have any advice on how I would go about getting it struck out? Thanks Speedo

  11. Hi there As I said before I was sure that was the case but it is nice to have it confirmed. I think that I may put your quote from the OFT in my rejection letter this time and see if that helps them to make a "goodwill gesture" Thanks Speedo

Hi there I have now received a reply to the letter that I sent asking for the full amount in which they have said that they are sorry that I remain dissatisfied and again offering me the reduced amount.One paragraph from the letter reads: Given that we reduced our penalty fees in line with the OFT enquiry, we consider our offer to refund the charges you incurred prior to the reduction to be fair and reasonable. As such our original offer remains. I enclose a further declaration for your consideration. Any thoughts? Thanks Speedo
  13. Hi there Thanks for your reply Livelylad I was almost sure that was the case but just wanted to check. When you wrote your rejection letter did you mention the disputed charges or just ignore them and ask for the full amount again. Thanks Speedo
  14. Hi there I sent a letter to FD claiming back the fees on my credit card and I included the recent £12 charges. FD have sent an offer saying that they won't consider the £12 charges as they are in line with the OFT ruling. Has anybody successfully claimed from FD including any more recent charges after the OFT ruling. Thanks Speedo

Hi there I have today received an offer from Loyds solicitors with just 3 conditions 1 The amount will be paid by cheque to the company 2 Payment will be in full and final settlement of this claim 3 These terms and any correspondance entered into in reaching settlement, of which this letter is one, will remain confidential between you, us and the Bank. The amount that they have offered is the amount set out on my POC which was dated by the court 26th Feb they have ignored the daily interest rate that was mentioned (now I realise that this is not much but maybe I am getting a little vindictive in my old age:)) The other thing that I am not happy with is the last condition. So my question is do I reject this offer (because they have left off the daily interest rate) or do I accept the offer but mention the outstanding amount. I assume in either case I can at the same time reject the last condition. Thanks in advance for any help offered
  16. I have just got back the acknowledgement of claim for my 2 business accounts with Lloyds and the solicitor is Martineau Johnson in London. Is this because these are business claims or are SCM snowed under? Speedo
  17. Hi there Lloyds have now decided to inform me about the money if a little belatedly and I am trying to make sure that my figures are correct when drafting my reply. I have taken off the 750 from the newest charges by using the spreadsheet. When I am quoting the remainder that they must pay am I right in thinking that I need to have adjusted the daily interest rate to reflect their part payment. The daily rate that was quoted on my N1 was obviously for the entire amount that I was claiming and now should they choose to leave that money in my account that amount will be less so I assume that the interest will be less. Hi there I have just trawled through my statements and found all my charges but just before I send off my first letter could I just ask whether I can claim both OVERDRAFT FEE and EXCESS OVERDRAFT FEE as they seem to always appear together, some months I have both some months just the overdraft fee and some months none at all.   22. Well Lloyds have decided to make a totally unannounced payment of £750 into my account. Is my best option to accept it as part payment or to tell them to remove it and carry on with my claim Thanks Speedo
