Hi Littleli Pete has just mentioned you are in Cardiff too - along with me, Parian, De1954, Welshbaba and about 200 or more others on the same date - shame you won't be able to attend the party :( IF you haven't yet submitted anything for the Directions Hearing have a look at Lattie's suggestion, on Parian's thread. This is what I will be using. Once sent, I don't think you need to do anything other that sit and wait.. . . and send a copy DG with another nudge letter. Oh, mention to the court maybe that you cannot attend. Keep in touch.

  2. Hi Dee. I have directions hearing in Cardiff on same day. I don't think we will hear anything else from courts until the date of the Directions Hearing. My notification said that "the parties may appear in person or make written representations as to how the case should proceeed, provided a copy of the representations is sent to the Court and the other side at least 7 working days prior to the hearing" - so I will be sending something off along the lines of Lattie's suggestion (see Parian's link) in good time.

     

    To date HSBC have not filed their AQ - 7 days late. When I phoned the court to ask what happens in this case I was told that the Hearing will continue and that the Bank will be put in a bad light for their lateness or failure to submit. Meantime another nudge letter is on way with a copy of my AQ and Draft Order for Directions

  6. Filed AQ today including draft directions request. Court said I needed to file the AQ (and pay the £100) even though they had also sent General Form of Judgement Order notifying me of a Directions hearing in Cardiff on 14th August.

    Does anyone know what I have to produce at this hearing?

     

    Seems to me it is just like a "live" version of the AQ, so I am thinking of submitting the same Draft Directions request...or do I have to produce more??

    Any help greatly appreciated

    I am due in Cardiff at 10.30 on 14th before Judge Hickinbottom to give directions for the case...so see you there...or maybe not, but we could have a party maybe :) I had to file an AQ, but note that you and Sha haven't had to...confusing. Submitted draft order for directions with AQ today but expect I will submit the same at the Directions hearing on 14th

  8. Hi Sha. Any news from HSBC regarding your request for a copy of your contract including Terms and Conditions? I was thinking along the same lines as you, preparing for court bundle, as I can't find T and Cs for 1991 when I opened account with them.

    Also, filed my AQ today - dont understand why I had to do one and you did not have to - and included the request for draft directions. But have also received the General Form of Judgement or Order saying that Directions will be given on 14th Aug at 10.30 by Judge Hickinbottom, (same as you ?), so see you there!! I guess I will present the same request for directions then. I am assuming your court date on 14th is to hear directions - yes? We have until 7th August to submit written representations.

  9. Thanks for response Pete..will follow your advice.Yes, both letters from Cardiff Court, AQ sent to me on 18th June, then Directions hearing date letter sent on 26th June ...

    Obviously don't want to miss AQ deadline and risk claim being struck out.

  10. Need a little advice.

    Received AQ that has to be in by 5th July, but last week also got General Form of Judgement informing me that a Directions hearing will be held in Cardiff on 14th August.

     

    Does this mean I do not have to fill in AQ ?

    I was planning to include in AQ draft order requesting strike out as abuse of process and/or standard disclosure, but should these go instead in written representations to the Directions hearing?

  11. Hi again SV. I guess you are not with HSBC Bank as they use DG Solicitors, I don't know these CB Legal services, so ....I suggest you start reading threads relating to the bank that you are with.

    With regards to sending a list of the charges , yes send it to CB LEgal services. Even though you have already sent the list to your bank there is no guarantee they will have forwarded it on to their legal team. Don't forget to keep copies of everything.

    How was the list of charges? Did you use the spreadsheeet from this site? If not have a look at the section decscribing the different names they use to attempt to disguise thier unlawful charges. Make sure you list each and every one, the date, amount, and the exact wording they used to describe each charge. Of course the easiest way to do this is to use one of the spreadsheets here, but if you have not used it already, it is probably a bit late now. Make do with a typed list. Good luck

    I'm a few weeks behind you, HSBC has until 11th June to defend. I filed N1 with Cardiff so may just be there at same time if there are 300 - 400 cases to be heard, or are there really thousands of us in S Wales persuing the bu***rs ! ?

Not sure what the MMt steps are, but if you are at the stage of requesting payment ..(and interest ? ) from HSBC, yes, be sure to ask for payment by cheque...how else are they going to repay you? Msot ask for cheque just so they cannot deposit money in a live account, oly to take it away again to offset cc payments or whatever else ....

I filed my NI last week, compiled from lots and lots of examples here - am claiming 6 years 6 months worth of charges and interest (all the statements I have ) + compound interest on it all. Let me know if you would like a copy - I'll pm it you as I think we should not post such things here. Good luck

  16. Hi killer I think if you are on benefits you don't have to pay...have a look at the thread about MCOL (Money claim on line) here - sorry don't know how to paste the link - there you will find help.But...

    it may not get to that stage....they made me an offer last week of about 80% of the charges (they argued about those that were beyond six years back) BEFORE I submitted my court action...so you MAY get an offer that you might want to accept....
