Hi thanks for your reply, the agreement was signed on 9th august 2000 but I can't be particualrly sure when I stopped making payments, I can only know for sure that it was 2001 but which month I do not know. I have copied letter template N off this site and have underlined at the top of it that I don not acknowledge the debt, is that ok?

Ok had a couple of letters go to an old address of line from red debt collection agencies, I know this debt goes back to year 200 sometime, I am currently dealing with other debts so pushed it to the back of the pile as I wasn't receiving the letters at my current address. Received a letter from mackenzie hall today stating they have been instructed by their client lowell portfolio 1 ltd to recover this debt. They put a payent deadline on the latter which was 3rd sept, latter is dated 27th august and yet I received it today 6th august. My first plan of action is to go down the CCA route and the whole statue barred thing, any other advice or info would be appreciated.x
  5. I wrote to ECI debt collectors for the CCA as they were the company who sent me the original demand letter, then it was passed to heatons who sent me a S.A.R instead of a CCA and has now been passed back to equidebt.

They are acting on behalf of the woolwich in this case, heatons have obviously not communicated with them at all as i the letter dated 30th july it has no mention of my request which I put through to heatons for the CCA, it just says any payment arrangment I have in place must now be made directly to them. Oh and MooseNoodles is the name my partner was using when I met him in an internet chatroom a few years back and I kinda pinched it.x

  8. The time limit is up, does anyone have the address for trading standards and should I enclose photocopies off all correspondence received from the mentioned companies?

Ok received a letter from ECI debt collectors on 27th March 2007 saying they were contacting me on behalf of their clients equidebt ltd for the outstanding amount of £1960.23, I sent off a CCA request the next day withthe £1.00 fee and they sent me a letter back on the 30th March saying they have requested the original document and that my account had been placed on hold. Then on 3rd April I received a letter from heatons solicitors stating we confirm receipt of letter via ECI and we have requested the documents asked for but it may take longer than 12 days etc etc. 24th April I receive a letter from heatons stating the documents I requested were enclosed and trust that I would be in touch to discuss the matter, the document they sent me was a S.A.R basically a payment list. I wrote to them again stating this was not what I had requested and that they were very soon going to be commiting a criminal offence as the time frame was nearly up. Received a letter on 30th July from equidebt stating that heatons were longer acting for the claimant in these proceedings, equidebt limited where it is named as the creditor above is now acting in person and for all other creditors acts on behalf of the claimant. The original creditor was woolwich by the way. Whats my best course of action now, I know I should write a letter of complaint to the appropriate people but don't know how to word it, can anyone help please.x

Hi there, I could really do with some advice as to what to do next, basically had a letter from a Hetons solicitors around march/april time I fired off a CCA request with the £1 fee they took frickin ages to get back to me and were certainly over the alloted time span they are allowed, I wrote reminding them etc etc and they finally sent me an S.A.R which was obviously not what I requested, wrote to them again telling them this and I received a letter in the post yesterday finally from Equidebt saying that heatons solicitors are no longer acting for the claimant in these proceedings. Equidebt limited where it is named as the creditor above is now acting in person and for all other creditors acts on behalf of the claimant. Not sure what all this means, the original creditor was woolwich and I have no idea what to do now. Thanks in advance.

I sent off a CCA request to ECI/Heatons debt collectors on 29t March 2007 along with the £1 fee, I received a letter back from them on 31st March stating they would forward me a copy of this, I then received another letter from them on 24th April 2007 saying they had the documentation I requested enclosed with the letter but all that was with it was a list of payments or an SOA as I think its called. I wrote to them again on the 27th April staing that the documentation they sent was not what I requested and that they will shortly have commited an offence as the time frame was nearly up but I actually think it was already up. The 12 day default was on 18th April and then if I'm right they get one calendar month to comply. I have heard nothing back from them as yet, can anyone advise me on my next move? Should I send a letter of complaint to the necessary people regarding this? Thanks in advance.
  12. Thanks so much for your reply, so just to clarify I shouldn't inform them that they have sent the wrong documentation and to just wait until 16th May (end of calendar month) to contct them gain regarding this?

Ok I sent a letter requesting a CCA on a debt that ECI seem to think I owe, I sent along the £1 fee and they got back to me within two days saying they wre looking into but could take longer than the twelve days stated in my letter, anyway I stuck to the timeline and the 12 working days excluding the easter bank holidays etc was up on 18th april with still no CCA. Today one week into the calendar month to allow them I have received a SOA with a cover letter saying this is the documentation you recently requested and we trust you'll be intouch within the next 5 days to discuss things further. Here's my question, obviously this is not the documentation I asked for, I am gonna write to them asking again for the original agreement but does the timescale start again or do they still have the rest of the calendar month to comply? On the SOA it says the last payment received for this loan was 06/11/2001 and it has taken them up until february 2007 to take action on this. Thanks in advance.
