  1. Hi all, well went to court about 3 weeks ago now and as suspected the stay was stayed, until the OFT hearing, didnt help matters that the judge on my case is known for not siding with the little guys, guess its a long wait then....:0(
  2. sorry could you provide a link to the POC
  3. thanks will get started, the fact that it has been passed to a debt collector doesnt matter ?
  4. Hi its direct from citi, signed by solicior
  5. Hi all, tried to scan the letter in but couldnt do it, anyways, wrote to citi requesting my money back from excessive charges, recieved a smarmy letter back from their solicitors stating, "i assume that your complaint was made as a result of the recent statement by OFT etc etc" well it wasnt i'm just after my money back after realising i could do It goes on to say " you have written in requesting a refund of charges sugesting that my client owes you this money as debt, however having reviewed yor account it is evident that your account charged off due to you failing to pay my client etc etc" My account had been passed to a debt collection agency It also goes on to say "Despite the fact that you may have paid default fees throughout the accounts life, the fact remains that you owed my client more than you have claimed back at the date of charge off. Earlier repayments do not warrant treating those monies paid as somehow debt due to you, conviently ignoring the later debt due to my client . As a result to refund anything would allow you to profit from your own default. I am therefore unable to agree to refund any such monies. Furthermore if you have paid any sums on a sold debt to a debt agency, it must be apparent that you have paid a third party and not my client , therefore you have no claim to recover sums paid to a third party from my client." Sorry for the long write up it was a rather long and boring letter, i only include the main bits.. Any advice would be grately appreciated
  6. thanks hedgy will try my best, will let you know how it turns out - even thoguh i'm well scared
  7. hi all was anyone able to offer any advice, since my hearing is pretty soon ? thanks in advance
  8. hi parkvale & barryboy , read the court letter properly this time lol, it says "notice of hearing application" "the hearing of the claimants application see attached application will take place at XXXXX on XXXX of October. it says i should attend, errr the defence and maybe the judge are gonna rip me to pieces, is there any paperwork i need to take, it does say so on the form, just a copy of my N244 applicaton ?, thanks
  9. Help, sent the form to my local court to ask for removal of stay, not sure if this means it has been removed but court has written back saying there is now a hearing for early october i did tick the "does not need a hearing" box when i sent the form in, does this mean i need to attend court ?, i wouldnt no what to say to the judge, help please, confused
  10. Sorry for the title, didnt mean to offend , writing my claim right now
  11. I succesfully managed to get back some cash from my bank, but in doing so signed a form to say it was full and final settlement of all claims relating to charges which they have since reminded of that fact. The original claim wasnt for the full six years. Silly question but legally am i now still able to make another claim for the full 6 years as my bank has slimely managed to add more charges, ironically nearly totalling what they had recently paid back.
