  1. Don't count on a quick reply from my experiences with Halifax they will delay as much as possible. Did you send of a fee when requesting details of charges? Halifax make a charge of £5 for producing last 6 years statements. If you did not send fee it might be wise to get in touch with them again as this omission on my part delayed the start of my claim. Good luck. Halifax have just settled my claim after issuing MCOL.
  2. Received claim in full following issue of MCOL, although they said it was because it would cost them more to defend than claim was worth and of course payment was without admission of liability. Claim was for £765 plus £31.06 interest plus court fees of £80 giving a total paid back of £876.06. Thanks everyone for help and encouragement.
  3. Kept to timescales as advised. MCOL submitted as no replies from Halifax. Halifax acknowledged claim giving them 28 days to defend. Got a letter from Halifax 10th May saying that it would cost them more than the claim is for to defend therefore they were paying the claim, interest and court fee into bank account, but with no admission of liability. Money now in bank. Total received £876.06. Also on 10th May got a letter in response to original complaint saying they had completed investigation and were satisfied that charges had been correctly applied. Thanks to everyone who contributes to this site. I will check posts and if I can be of encouragement to others will post replies.

  5. I am helping my daughter with a claim against Halifax for £789. We have sent of first letter on 9th Mar 07 giving them 14 days to reply accepting, unconditionally, the request in principle and letting us know a date by which we will receive payment. I also stated that if they do not respond, or do not respond positively, within this time period, we shall send you a letter before action giving you further 14 days in which to reflect stating that we believe that these targets are more than sufficient for a large company such as them with dedicated staff and departments. Halifax have replied stating that the industry regulator gives them 8 weeks to investigate and they will inform us in 4 weeks how they are progressing. Do I: 1. Accept this as it is what the industry regulator recommends 2. Write now stating that I do not accept their timescale and require a response within my original letter dates (what counter arguement do I use to the industry regulatir statement in their letter) or 3. Do I wait until the 14 days from the original as planned and send the letter before action? Also can some please clarify if the 14 days is taken as calendar days (ie our next letter is due 28th Mar (allowing a couple of days for post to reach them) or working days which makes our next letter due 2nd April? We will be grateful for aany advice on how to proceed. Great forum and knowing that others have been successful helps.
